If Allen really did use Garland's ideas and design for the pump why didn't Garland take Allen to court and SUE him?

I hope they do have evidence. The more evidence the more solid the case. I just remember during the Bosma trial waiting for the evidence that he was shot in the field and then in the end no evidence of this was presented.

The crown at Bosma did not say where Tim was shot in the opening statement. Nor did they say definitively in the closing that he was shot in the field. This is from the opening statement:

The Crown intends to prove that on this date in the late evening hours, Tim Bosma was killed in his truck, shot by the two accused at close range, while on a test drive with his truck; his body then incinerated hours later by the two accused.

It was put to Smich in cross that Tim Bosma was shot in the field and was presented as a theory at the very end of the trial. So it's a bit different from here although you are very right that it will be circumstantial evidence used to try and prove the theory.

ETA: Added in direct quote to show the field is not mentioned, only inside the truck, which the Crown definitely proved. It would be a big tactical mistake to say you're going to prove something, as the Crown did here, and then not prove it.

It didn't even occur to me that at the Bosma trial the crown didn't say that in their opening statement. Since the crown in this case brought it up in the opening statement you are right. It is different.

Even in the closing, Leitch said something along the lines of we believe it was the field but there are only two people that know and they have completely different stories so the Crown at Bosma was never anywhere near as definitive as the Crown has been here.

If Allen really did use Garland's ideas and design for the pump why didn't Garland take Allen to court and SUE him?

That would have been the rational thing to do if he thought he had a right to some compensation or had any rights to the patent.

DG was not rational and I suspect his motivation for the murder went beyond just compensation. I am guessing his hatred of him was part of the motive. I think he built up a hatred and once there he would not let it go.

It almost sounds like when two neighbors begin feuding and nothing seems to be able to stop it until it comes to a head and something bad happens.

For people on the outside looking in the things they feud about seem "petty" LOL but to the people living through it the emotions get very heated and serious. Its hard to talk sense into people when they are going through something like that.

If Allen really did use Garland's ideas and design for the pump why didn't Garland take Allen to court and SUE him?

Exactly, he seemed to have no problem using legal avenues to get what he felt entitled to. I question whether this "petty" disagreement is the only motive in this case.
