Nine days after he examined the jacket, MacDonald drove the jacket to Halifax to hand-deliver it to the RCMP forensic lab for testing. He picked it up eight months later.

He transported the jacket to the lab again on Oct. 26, 2012, and picked it up on Feb. 14, 2013. Cuttings of the jacket were subsequently sent for analysis.

"DNA extracted from three of the bloodstains found on the brown sports jacket Dennis Oland wore when he visited his father on the night he was killed matched his father's profile, a DNA expert from the RCMP forensic lab confirmed....

On Tuesday, the court watched some of Kearsey's videotaped testimony from Oland's first trial. The Crown and defence agreed to play the video rather than recalling her as a witness.

The balance of Kearsey's testimony will be heard on Thursday.

The retrial is scheduled to resume Wednesday at 9:30 a.m. with an unusual application by Oland's defence lawyers to have hearsay evidence about the unsuccessful search for his dead father's missing cellphone declared as fact.

Crown prosecutor Jill Knee said the court will also hear from another witness in the afternoon. She did not name the witness, but it's expected to be John Ainsworth, one of two men who heard thumping noises coming from the victim's second-floor office on July 6, 2011, the night he was killed...."

Interesting defence that Richard Oland was so touchy-feely that he got blood on Dennis’s jacket, to the extent it was still evident after dry cleaning. One could surmise that there would be clothes in all of Richard’s friends’ closets with his blood stains on them...yuck.
 
Final Crown witnesses to take stand in Oland trial as prosecutors near end

"SAINT JOHN, N.B. — Legal arguments dominated the second-degree murder trial of Dennis Oland on Wednesday and led to an early adjournment before a key prosecution witness could take the stand.

Crown prosecutors are nearing the end of their case at the lengthy trial, which began hearing evidence in November.

It had been expected one of their final witnesses would be on the stand Wednesday afternoon, but defence and Crown lawyers said new information would have to be examined and the adjournment was called.

It is still anticipated that John Ainsworth will testify on Thursday.

He is one of two men working in the building where Richard Oland was bludgeoned to death on the evening of July 6, 2011....
Other legal arguments on Wednesday concerned contradictory evidence about the first time Saint John police searched for Richard Oland’s cell phone – the only item taken from the crime scene on the day of the murder.

Claudio Cusin, an investigator with Rogers Communications, told the court on Wednesday he believes he was asked by police to “ping” Oland’s phone on July 9, 2011, in an attempt to locate it. But a police witness, Sgt. Dave Brooker testified he asked for the ping on July 7 – the day the body was found.

The phone could not be found, instead producing a “roaming error” report.

It is not clear why the Oland defence team wants Brooker’s testimony accepted as fact, but Justice Terrence Morrison has asked lawyers on both sides to provide him with briefs on the matter. He said he will rule on the issue next week.

With the Crown close to wrapping up its case, the defence will begin laying out its arguments sometime in the next couple of weeks. It is already known that Dennis Oland, 51, will testify in his own defence."

"...Defence lawyer Alan Gold advised the Saint John courtroom that the Crown "recently came into possession" of some "material," which has been disclosed to the defence.

Gold said he wasn't at liberty to discuss it but did say "counsel are agreed … it's significant in the sense that we must devote some effort and time into following it up."

He requested court adjourn for the day and resume Thursday at 9:30 a.m.

The retrial was scheduled to hear from another Crown witness Wednesday afternoon. Although the name of the witness has not been revealed, it's believed to be John Ainsworth, one of two men who heard thumping noises coming from the victim's second-floor office on the night he was killed.

Wow... this whole police investigation is just brutal.. the guy should never have even been tried for murder considering all the seeming errors police made.
Can't WAIT to hear what this new significant evidence is..
I wasn't/haven't really been heavily into this case.. but I read some stuff on the weekend which just blew my mind. Like.. the police didn't even do any real investigation of RO's 'girlfriend's' husband. I realize the man was like 87 years old.. but.. if he'd found out his younger wife had been screwing around for 8 years, with many in town knowing about it.. I could see that being cause for a lot of anger.. I doubt if he 'did it', but.. he certainly could have hired it.
