Accused Alberta bomber’s DNA taken from napkin at fast-food place
Court has heard Malleys DNA was found on part of the packaging that was used to disguise a homemade pipe bomb as a Christmas gift.
Litzenberger, who works at the RCMP’s Edmonton crime lab, then testified that an analysis of a piece of tape and lined paper recovered at the bombing scene found a mixed DNA sample that is consistent with the DNA profiles of both Malley and Shachtay, as well as trace amounts of DNA from a unknown third individual.
"One in 490 million are the chances of someone picked at random would have the same DNA profile."
So do we know for a fact that the trial is proceeding? Are there legal arguments underway delaying proceedings that the public can be made aware of?
It really does boggle my mind that not many Canadians have heard of this case....a case involving the bombing of a young handicapped mother. smh.
Former assistant declares Malley 'killed' Shachtay
But judge in murder trial warns jury that testimony is opinion and not admissible ...
... The third week of the murder trial of Brian Malley -- charged in the premeditated killing of Innisfailian Vicki Shachtay – ended with an emotional declaration by the accused’s former employee that her ex-boss committed the bombing slaying.
However, Court of Queen’s Bench Justice Kirk Sisson immediately interrupted the testimony of Barbara Tblus, had the jury removed from the courtroom and adjourned court.
After a lengthy adjournment, Sisson ordered the jury brought back into the courtroom and told them they were to disregard Tblus’s last statement as it was opinion and therefore not admissible.

Six weeks into 2015, the sadness and loss just keep piling up for the retired mechanic, a gentle-looking man who speaks softly and ambles slowly in and out of the Red Deer courthouse building throughout the day. For the past month, a murder trial has been underway, with the youngest of his kids at the centre ...
Earlier in the week, Malley’s former business partner Bob Yanew reportedly testified he spoke with the accused during a visit to Red Deer Remand Centre a few days after Malley’s arrest on May 25, 2012.
Yanew testified Malley asked him at the time to purchase a container of gunpowder.
During a search of Malley’s home on the day of his arrest, police found a 454-gram container of gunpowder, as well as a number of small light bulbs in packaging, and an unused light switch.
RCMP bomb experts testified earlier in the trial that they built gunpowder-loaded pipe bombs similar to the one that killed Shachtay.
Defence opens in lethal pipe bomb trial
When the family contacted the gas company about an underground line where the work was taking place, Poelzer said a representative told them to encase it in a protective sleeve before pouring the concrete slab.
Don Christal, a private investigator hired by the defence, testified he went to the Poelzers’ home in May 2014, when the gas company was there to do additional digging on the property and retrieved the items used to encase the gas line under the patio: a length of pipe threaded at both ends and a galvanized pipe cap.
Defence wraps up its case in pipe bomb trial ...
Malleys lawyer, Bob Aloneissi, concluded the defence case by questioning an RCMP investigator about a discrepancy between how Shachtays name was spelled on the package that contained the bomb and in documents Malley had prepared while working for Assante Wealth Management as her financial adviser ...
I wouldnt put as much weight on the spelling as much as the DNA, said Williams.

"Brian Malley trial: court hears final arguments in death of Victoria Shachtay ..."
A central Alberta financial adviser showed no emotion Tuesday night as a jury found him guilty of first-degree murder for killing his disabled client with a pipe bomb disguised as a Christmas present.
Brian Malley, 57, will serve a life sentence with no parole for 25 years after killing Victoria Shachtay, a 23-year-old single mother who died in her wheelchair when she opened a gift bag that had been left on her doorstep in Innisfail, Alta., in 2011.
Unbelievable cruelty in this case. It doesn't get much worse than a young, single, disabled, mom who opens a Christmas gift that is sent by a financial advisor to explode in her hands and kill the young woman, for goodness sake.
The definition of pure evil in my book. imo.
