Case against man accused in brutal 1984 hammer murders moves to trial

ARAPAHOE COUNTY, Colo. — After a hearing featuring sometimes graphic testimony and extensive discussion about DNA evidence, a judge ordered Alex Christopher Ewing to stand trial on multiple counts of first-degree murder in one of Colorado’s most notorious cases – the 1984 slayings of three members of an Aurora family.

Ewing, 59, was serving a 110-year sentence in Nevada for a late-night attack on a couple in Henderson when that state's Department of Corrections required him to submit to a DNA test. Once the results were entered into the FBI’s national DNA database, it led to a “hit” to genetic material left at the scene of the Bennett murders.

Ewing also faces four crime of violence sentencing enhancers. The judge set Ewing's arraignment for Aug. 27.

Ewing also faces murder charges in the Jan. 10, 1984, rape and murder of Patricia Louise Smith in Lakewood. A judge ruled last month there was sufficient evidence to take him to trial in that case. He is scheduled to be arraigned in that case Sept. 1.

Tuesday's hearing in the Bennett case began with a prosecution motion — approved by the judge — to drop eight other charges against Ewing, 59, because the statute of limitations had run out. He was arrested in late 2018 after DNA linked him to the brutal killings.

Strange... I just looked this up on the court site & it is not showing anything for him in Arapahoe County. I "know" it was there yesterday.... I guess I'll check it out later to see what comes up!

JEFFERSON COUNTY, Colo. — A long-simmering dispute between prosecutors and defense attorneys in two high-profile cold cases – 1984 hammer murders in Lakewood and Aurora – flared into the open Tuesday in a Jefferson County courtroom, with attorneys for the accused killer leveling accusations of prosecutorial misconduct and calling for sanctions.

The unusual scene played out in a hearing for Alex Christopher Ewing in the Jan. 10, 1984, rape and murder of Patricia Louise Smith, with defense attorneys urging the judge to remove Jefferson County’s district attorney from the case and impose penalties.

Despite the fact Russell denied the defense motion, the hearing laid bare a conflict that has unfolded largely out of public view, one that began shortly after a DNA hit in July 2018 linked Ewing – then behind bars in Nevada – to both Smith’s killing and the murders of Bruce and Debra Bennett and their daughter, Melissa, six days later.

The Smith murder is being prosecuted by the office of District Attorney Peter Weir in Jefferson County while the Bennett killings are being prosecuted by the office of District Attorney George Brauchler in Arapahoe County.

Within weeks of the DNA hit that led investigators to Ewing, prosecutors in both offices began the process of trying to extradite him to Colorado to face charges in the two cases. And the Colorado State Public Defender’s Office entered appearances on Ewing’s behalf in each of them.

Weir and Brauchler both subsequently objected – and judges on both cases ruled that public defenders could not represent Ewing until he was moved to Colorado, something that didn’t happen for more than 18 months.

He is scheduled to return to court Oct. 8 in Arapahoe County and Nov. 6 in Jefferson County.
 
Wondering how his cell-mates might treat him now that he has been accused of the brutal sex assault of two little girls?
Anybody going to respond to his date profile now?

I can't support rape under any circumstance, including within the prison population. But it's tempting to wish that upon someone like this. I can see how someone would.

JEFFERSON COUNTY, Colorado — The worsening COVID-19 pandemic led a judge in Jefferson County to again delay the proceedings in the case of a man accused of four brutal hammer murders in the Denver area in January 1984.

He had been scheduled to be arraigned in that case Friday morning – the step in the process where he would enter a plea – but District Judge Tamara Russell granted a defense motion to delay it indefinitely amid concerns about the pandemic.

In Friday’s hearing, Judge Russell said that three people who work in the Jefferson County courthouse had tested positive and, as a result, a total of 14 workers were quarantined and working from home.

Katherine Spengler, a public defender representing Ewing, filed an emergency motion after business hours Thursday attempting to stop Friday’s hearing – but it was too late for Russell to take action. Then in court Friday, Spengler argued that the arraignment should be delayed.

Prosecutor Robert Weiner expressed frustration at the prospect of another delay in a case that’s already had several of them.

“There’s no reason to continue this yet again out of what amounts to as yet a guess,” he said.

But Judge Russell noted that prosecutors have a seven-page witness list – and that new restrictions have been ordered that will limit her courtroom to 10 people.

The judge scheduled a status hearing Dec. 10. It’s possible a new arraignment date could be set then.

In the meantime, he is scheduled to appear in an Arapahoe County courtroom Nov. 16 in the Bennett case.

Colorado man pleads not guilty in 1984 slayings

DENVER (AP) — A Colorado man has pleaded not guilty after he was accused of bludgeoning four people to death with a hammer in 1984 in two separate attacks.

Alexander Ewing, 60, entered his plea Monday in Arapahoe County after DNA evidence connected him to the crime scenes, The Denver Post reported.

Prosecutors said he will not face the death penalty but instead faces life in prison with the possibility of parole after 20 years for each of the first-degree murder counts he is charged with. Ewing is being represented by the state public defender’s office, which does not comment on cases.

18th Judicial District Chief Judge Michelle Amico ruled Friday that Ewing could not face the death penalty in connection to charges related to the slaying of the Bennett family, arguing the death penalty statute violated the state's constitution.

A trial date in Arapahoe County was scheduled for April.

“With parole possible after 20 years” is beyond disturbing.

*Motions Hearing (Jefferson Co) (@ 2pm MT) – CO – Patricia Louis Smith (50) (Jan. 10, 1984, Lakewood) - *Alexander Christopher Ewing (25 @ time of crime/58/now 60) charged (8/10/18) with 4 counts of 1st degree murder & 2 counts of committing a crime of violence. $1M bond. Jefferson County
DNA genetic profile match in CODIS. Ewing is serving a 8 to 40 year sentence in Nevada. Extradited on 2/28/20.

11/6/20 Update: District Judge Tamara Russell granted the defense's emergency motion to delay arraignment hearing due to concerns about the pandemic. Prosecutors opposed it. Next status hearing on 12/10/20 to set arraignment date. And motions hearing 1/11/21 @ 2pm.

CO – Bruce (27) & Debra (26) Bennett & daughter Melissa (7) (Jan. 16, 1984, Aurora) – *Alexander Christopher Ewing (25 @ time of crime/58/60) charged (3/2/20) (Arapahoe County in CO on 8/9/18) with 3 counts of 1st degree murder after deliberation, 3 counts of felony murder, 1 count of attempted 1st degree murder after deliberation, 2 counts of aggravated sexual assault, 1 count of assault with deadly weapon, 2 counts of sexual abuse of child, 1 count of 1st degree burglary with weapon. Plead not guilty. Held without bond. Arapahoe County
Trial set to begin on 4/19/21 thru 5/21/21.

11/16/20 Update: Plead not guilty. Next motions hearings on 2/3 & 2/4/21 & on 2/23 & 2/24/21 & trial will begin on 4/19/21 thru 5/21/21. 12/9/20 Update: Judge rules the death penalty is off the table in the 1984 hammer murders of Bruce, Debra & Melissa Bennett. Suspect Ewing faces a maximum penalty of life in prison with parole possible after 20 years, according to ruling.
