Breaks my heart because I suspect that Elijah might have been neurodivergent. I think he was highly functional. The man calling 911 mentioned a mask and odd hand movements - maybe tics or stimming? And, of course, it is difficult for neurodivergent people to state their case even in a calm situation, but the three cops didn't even give him that chance. They attacked Elijah while he was trying to explain that he was an introvert, poor kid. And try to stay calm when three cops incapacitate you for no reason! And how is "looking suspicious" (although they didn't even see him, just a mask), justify chokeholds?

(CNN) — Jury deliberations are set to resume Thursday morning in the trial of two Colorado police officers who arrested Elijah McClain, an unarmed 23-year-old Black man who died in 2019 after being subdued by police and injected by paramedics with ketamine.

Randy Roedema and Jason Rosenblatt have pleaded not guilty to charges of reckless manslaughter and assault in connection with  McClain’s death. Rosenblatt was fired by the police department in 2020 and Roedema remains suspended.

The court recessed Wednesday evening without the jury reaching a verdict after the panel deliberated for eight hours. Jury deliberations began Tuesday after closing arguments and will resume Thursday at 8:30 a.m. local time.

The jury on Wednesday asked the court several questions throughout the day, including three related to the two officers’ field experience. The court told jurors they had “received all the evidence and testimony you may consider in deciding these cases.”

Following the verdict, Attorney General Phil Weiser released a statement thanking the jury and calling attention to Elijah McClain and the McClain family.

"Today’s verdict is about accountability; everyone is accountable and equal under the law. And hopefully today’s verdict is another step in the healing process for the Aurora community and the state. I recognize that some people may not agree with the verdict, but we all must respect the jury system, which is a pillar of our democratic republic," he said in a statement. "The people who served on the jury are our neighbors, regular Coloradans who interrupted their lives for weeks to hear the evidence in the case, to deliberate, and to deliver justice. I thank the members of the jury for their service.

"We are here today because Elijah McClain mattered. He was just 23 years old when he died, and he had his whole life ahead of him. His mother, Sheneen McClain, has had to relive that tragic night repeatedly for the last five years. Yet I, and all of us, are inspired by her courage and devotion to her son. Sheneen has been incredibly resilient and determined to not let anyone forget about Elijah. I want to thank Sheneen for her strength, grace, and understanding. Elijah’s memory lives on as a blessing," his statement read.

The EMTs at the scene, Jeremy Cooper and Lt. Peter Cichuniec, will be tried together at a later date in connection with McClain's death.

Woodyard will be tried separately because he was first on the scene and applied the hold, according to a court order.

 
BRIGHTON | Aurora police officer Randy Roedema was found guilty of criminally-negligent homicide and third-degree assault, and former officer Jason Rosenblatt was found not guilty of all charges by an Adams County jury on Thursday for their roles in the 2019 death of Elijah McClain.

While Roedema had been charged with the more serious crime of second-degree assault, jurors found him guilty of the lesser crime of third-degree assault. Rosenblatt had also been charged with criminally-negligent homicide and second-degree assault.

Roedema, who kept his head bowed after the verdict was read, faces up to three years in prison on the more serious homicide charge. Rosenblatt hugged his supporters as he walked out of court.

McClain’s mother, Sheneen McClain, listened to the verdict from the front row, where Attorney General Phil Weiser had his hand on her shoulder. She held her right hand high in a raised fist as she left the courtroom.

She expressed disappointment in the verdict.

“This is the divided states of America, and that’s what happens,” she said as she walked away from the court house.

Jurors delivered their verdict after deliberating for part of the day Tuesday, all day Wednesday and most of the day Thursday.

“When I first spoke with you during the jury selection process, I tried to communicate that, other than military service, voting and a few other forms of public service, there’s nothing that our citizens do that is as important to one of the pillars of our democracy as being at a jury trial,” Judge Mark Warner told jurors after the verdict was read.

Jurors Thursday convicted an Aurora police officer of criminally negligent homicide and third-degree assault and acquitted another in the 2019 death of Elijah McClain, a Black man whose name became a rallying cry in protests that led to sweeping police reform in the state less than a year later.

The 12-person jury found Aurora Officer Randy Roedema, who is currently suspended, guilty of criminally negligent homicide and third-degree assault. The paramedics are accused of injecting a significant amount of ketamine into McClain, which officials said led to him suffering from cardiac arrest on the way to the hospital.
 

APD terminates officer convicted in Elijah McClain's death​

AURORA, Colo. — The former Aurora officer convicted of criminally negligent homicide and third-degree assault in the 2019 death of Elijah McClain is off the force.

The Aurora Police Department terminated Randy Roedema’s employment following Thursday’s conviction, according to APD spokesperson Ryan Luby.

Roedema had been suspended from the force prior to the jury’s decision. They found officer Jason Rosenblatt not guilty of all charges in connection with the fatal arrest on Aug. 24, 2019.

Woodyard was the first officer to respond to the area of Billings St. and E. Colfax Ave. after the police department received a 911 call of a “sketchy man” in the neighborhood with a ski mask who was reportedly waving his hands in the air.

The former officer ordered McClain to stop and grabbed his arm as Rosenblatt and Roedema arrived at the scene to assist in McClain’s arrest.

Woodyard is accused of putting McClain in a neck hold that rendered him unconscious as paramedics arrived at the scene to give a powerful sedative that officials eventually determined played a key role in his death. McClain, a massage therapist known for his gentle nature, was walking home from a convenience store after purchasing some iced tea. He had committed no crime.
