Agree. Each motion takes time. But also it increases defendents dread so MOO its a wash.
Doing this now keeps prosecution on secure ground by ticking off all the boxes to prevent a reversal on appeal.

She is crazy just not the kind of crazy the court recognizes as specifically incapable of understanding the harm they do.
Insanity defense loopholes got cleaned up decades ago in most states.
@Boxer Thank you for pointing out the benefit to those seeking justice for Gannon. Geeez-us, this woman is frustrating!

While I completely agree that she is a danger to others as discussed earlier, this is because she is desperate to escape, IMO. Not because she is hearing voices or is delusional. She is plotting and planning (premeditation), attempting to buy assistance from others, (collusion), requesting evidence to be destroyed, (concealing evidence) and measuring herself to see if she can fit through the window to ensure her plan will work (intent).

We can clearly see what her defense might be (unless she is found to be legally sane). Her legal team doesn't have much to work with at this point. Although she may attempt to be found insane by lying and pretending, I don't believe she will be successful. She may be a pathological liar, have depression, and have narcissistic tendencies, but the legal definition of insanity is quite hard to prove in a court of law.

The insanity defense is one of the most controversial defenses. Additionally, it has one of the lowest success rates among all criminal defenses. [...]
A person may be considered psychotic but still not meet the legal definition of being insane. [...]
A person should be determined to be guilty and receive sentencing if he or she had the free will to commit the crime and the intent to cause harm. [...]

Insanity is a mental illness of such a severe nature that a person cannot distinguish fantasy from reality, cannot manage his/her own affairs, or is subject to uncontrollable impulsive behavior. [...]

1. Letter is written TO "SWEETIE" use the words from the legal document. It was not addressed to Harley.

2. This letter is written to Sweetie and it "SHE is out of jail or is free" . LS did NOT say I
3. Harley is written on THE BACK that means HARLEY IS THE TOPIC OF CONVERSATION.

You don't write directly in prison, you know you are watched. If I want you to move Right, I'm not going to tell you. Instead, I hit you with a stick on your LEFT and you automatically move Right without me saying a word :D

Edit: Jail, locked down or Psycho Ward opportunity. I will try opportunity. TB gives up letters, gets good stuff possibly (IF IM LE GIVE HER NOTHING) and LS goes off to different setting with different opportunity.

Edit2: Can't sleuth others but um birds of a feather come to mind

She's always slithering she's a snake

From your link:

...If Stauch is ruled incompetent, she can be held for indefinite treatment — up to the rest of her life — under the first-degree murder charge...

I think she's guilty, and I want her punished, too...but whoa. This is terrifying.

She's not staying there long. She's competent very in fact. She systematically did/does things. Insane people don't. Being incompetent would of been just sitting there in a horror scene bumbling to yourself til LE showed up.

MOO her crime and cover up were crazy and maybe she is progressing to fully psychotic.
If not, a criminal mental facilty is as bad or worse than prison as she will find out.
Trying to play crazy n doing crazy things isn't going to help her stay in a mental hospital. She's gonna have to rev things up to stay-which I'll be expecting and sadisticly enjoying.
Sitting in a cell hearing things from criminals in other cells about what they'd like to do or what was possibly done? Versus someone medicated and looking out a window. Easy choice to me.

Great post imo.
I've felt sorry for HH. She's young, raised by a nut of a mother and an only child. Now this? Can you imagine? What a horrible position to be in!
It's interesting to me that LS's note to HH was still all about LS basically. I think the point of the letter was to remind her to stay focused on what their "plan" was. I think LS is afraid of HH talking. I wonder if HH hasn't been taking LS's calls or writing her. Idk.
Yes I agree. LS is losing the hold she’s had on her daughter, to a certain degree, and trying to retain it in any way she can. It is very selfish of LS to implicate her daughter or throw her under the bus in any way. This is JMO.

Would she be held in a state psyche ward for treatment or sent back to jail? I kind of think the state psyche ward. Those places can be scary. jmo

This isn’t the place she is being sent to (Pueblo doesn’t have much info on their website) but I came across this after reading one of 10’s posts and found it interesting:

California Department of State Hospitals - Atascadero

I haven't been under the impression yet that LS is trying to implicate her daughter of throw her under the bus, but rather needs her to stick with the narrative they discussed. I doubt HH will as time goes on. I just can't imagine the position she's found herself in. So confusing. I really feel for her. :(

"Competency to stand trial" in Colorado criminal law cases

1. What does it mean to be competent to stand trial in Colorado?
Competency to stand trial or, as CRS 16-8.5-101(4) calls it, competency to proceed means:

that the defendant does not have a mental disability or developmental disability that prevents the defendant from having sufficient present ability to consult with the defendant's lawyer with a reasonable degree of rational understanding in order to assist in the defense or prevents the defendant from having a rational and factual understanding of the criminal proceedings. (emphasis added)1
In order to stand trial in Colorado -- whether it is in Arapahoe County, Denver County, or any other county or jurisdiction -- a person must be “competent” before being prosecuted for an alleged criminal act. A defendant's constitutional right to due process of law is violated if he or she is actually incompetent to stand trial but is tried nonetheless. 2

Perhaps you are right. But nothing TS says or does is for the benefit of anyone but herself.

Does anyone else get the sense that LS is one of the dumbest criminals we have ever had the displeasure to get to know? I mean Wow!!! Escape plan, the things she says? She actually thought she would be able to escape and told her daughter not to worry if she hears she is no longer in jail. I am just so floored by this person.

Exactly, just like Julie Scheneker did. I don’t think many people would have the energy TS had to do everything she did for weeks on end. Kind of makes you wonder what was “fueling” her.
