Monday hearing clears path for closing argument in trial of James Holmes for movie theater shooting

ARAPAHOE COUNTY, Colo. - Attorneys met in court Monday to settle debate about instructions for the jurors and clear the path for closing arguments to be presented Tuesday in the Aurora movie theater shooting trial.

Much of the hearing Monday was about the semantics of the jury instructions and the language that would appear on the verdict forms for the 165 counts in this case.

CENTENNIAL - There is not a debate on whether or not James Holmes went on a shooting rampage on July 20, 2012 in a crowded Aurora movie theater. That is not what the jury is deciding in the historic case against him.

WHAT THE JURY DECISION MEANS
If the jury finds Holmes not guilty by reason of insanity - what his defense attorneys are arguing - he will likely be sentenced to spend the rest of his life in a state mental hospital.
However, if the jury finds Holmes guilty, he will either face the death penalty or life in prison without the possibility of parole.

Court will convene at approximately 9 a.m. and start with the reading of the long list of instructions that were finalized Monday. After a likely recess, the closing arguments themselves will begin. District Attorney George Brauchler is slated to go first. Both sides will have only two hours total for their closing arguments but, as Recht points out, the DA has indicated that he plans to save about 30 minutes for a rebuttal.

Judge and attorneys are taking a brief break before #theatershooting jurors enter the courtroom for instructions and closing arguments.
 
Judge says attorneys will get chance now to review each other's demonstrative exhibits 10 minutes ago

Defense confirms they want the judge to inform jury about defendant's right to not testify Prosecution not requesting any changes to instructions or verdict forms Defense requests no additional changes to instructions or forms, but says they 'maintain" all previous objections. Reminder; Jury is not in the room yet. This is a final meeting before a short recess and then the jury will be brought in for their instructions Phil Tenser

They played the 911 tape - that is so powerful to me. It's the one you can hear the 'boom, boom, boom' of the gun shots. It was said you could hear at least 30! The thoughts of terror of the people when I hear the shots! It's just, I have no words.

I predict a verdict Thursday, probably mid-afternoon. I think the jury wants to be thorough, but not so much that they will drag out their decision. There is a chance my opinion will change pending closing arguments; we'll see. Any other opinions?
 
Originally-scheduled start time for court was 9am so we are on standby for things to resume anytime Phil Tenser
