Prosecutors on Thursday introduced evidence defendant Steve Pankey requested immunity in exchange for information about the 1984 disappearance of Jonelle Matthews nearly 35 years later, inciting the investigation that resulted in Pankey’s indictment.

Greeley Police Detective Robert Cash, who took on the case in 2013, made an April 2019 phone call to Pankey that changed the course of the investigation, according to his testimony to Weld Assistant District Attorney Robb Miller on Thursday morning.

Four people testified about their involvement with Jonelle’s remains, which included collecting evidence from her body and determining the cause and manner of her death. Weld County Coroner Dr. Michael Burson testified Thursday that Jonelle’s death was deemed a homicide and caused by one front-to-back, downward gunshot wound to the head.

Forensic Anthropologist Diane France said Jonelle’s body was buried by someone and appeared to be between the ages of 12-13, but she couldn’t determine the exact date the burial happened.

Prosecutors played a recording of the phone call between Cash and Pankey for the court, highlighting suspicious statements about Pankey’s knowledge of the case, his requests for immunity in exchange for giving out information and his relationship with Russ Ross, the family friend who dropped Jonelle off the night she went missing.

Cash initially called Pankey to find out more about Ross after learning from the caseload that the two had a “dynamic,” Cash testified. Former testimonies revealed Pankey hated Ross, the two had a few “run-ins” and Ross was the manager of Pankey at a 7 Up distribution company while Pankey was actively suing the company and its former manager.

Pankey also told Cash he learned Jonelle went missing six days after Dec. 20, 1984, while driving home from California — an assertion he repeatedly made during the call. Defense attorney Jessica Brazil, one of two representing Pankey, argued his assertion about when he gained knowledge of her disappearance has been a “consistent assertion” since 1984.

Pankey then conveyed during the call that on the night Jonelle disappeared, he, his wife and their son were packed up and ready to leave for California the next morning. Directly after, he made a comment that “something unique” happened in the driveway the night of Dec. 20.

Cash was confused by the statement, but Pankey never clarified what he meant. Brazil cleared up this portion of the call with Cash, who testified Pankey later indicated police came to his house and pulled into his driveway on the night Jonelle went missing.

At one point, Pankey started to respond about his relationship with Ross and the two dates, but he requested a “firm deal” before going further.

“If I reveal circumstances in my life, I need to have an ironclad deal,” Pankey said.

Frequently throughout the call, Pankey changed the subject to discuss other cases, including asking if Jonelle’s case had any connection to the 16th anniversary of a Zodiac Killer victim. While prosecutors argued Pankey inserted himself in Jonelle’s case since Day 1, Brazil emphasized the other cases Pankey has been invested in.

Cash testified Thursday that Pankey made comments about other cases, but he wasn’t sure if he would classify that as inserting himself in them.

Shortly after, Pankey started inquiring Cash about a Channel 9 story on the 34-year-anniversary of Jonelle’s disappearance. When Cash misspoke and said the case is 35 years old, Pankey quickly corrected him on the exact year.

Although Pankey asked for immunity, he made it clear he had no information about the case, Brazil argued. Her cross-examination received a confirmation that Cash hung up with a lack of “evidentiary value.” Additionally, she mentioned her client didn’t have to cooperate in 2019 by calling Cash back or answering questions, but he voluntarily did.

Brazil asked Cash why Drake, who died in 2007, was ruled out.

Cash answered the timeline simply didn’t match. He said Drake’s mother gave statements back in 1984 that her son left around 9:30 p.m., when Jonelle was already missing from her home. However, the defense argued the vagueness of the time, since his mother said “around,” while also stressing that Drake’s sister said he left between 9-10 p.m.

But what really confirmed Drake’s alibi, according to Cash, was his family’s statements that he watched the Cosby Special with them, which aired from 7-9 p.m. They also said he left right before the 10 p.m. news came on.

Since the weather was snowy and shoeprints were found outside in the front- and backyards of the Matthews home, Cash said, the lack of shoeprints leading from Drake’s mother’s home to the Matthews house excluded Drake as a suspect.

When Angela Hicks arrived back in Greeley in December 1984 from a drive to California, she was eager to return home.

Hicks and her then-husband, Steve Pankey, along with their young son, had just visited Pankey’s family in Big Bear Lake, California, more than 15 hours away. They were in Big Bear Lake for just two days before heading back to Greeley on Christmas morning.

Instead of returning home, Pankey continued past their residence at the time at 6086 10th St., and went to the Safeway at 10th Street and 35th Avenue, according to Hicks’ testimony on Friday in Weld District Court. He asked her to go grab that day’s copies of the Greeley Tribune and The Denver Post, after he had her tune into radio reports of a 12-year-old girl that had gone missing from her Greeley home just days earlier.

Keith Olson, who led the investigation into Jonelle’s disappearance in 1989, returned to the stand Friday morning after it was discovered there was more video of Olson’s 1989 interview with Norris Drake, who the defense has offered as an alternate suspect. Olson began his testimony Wednesday and was set to continue Thursday until the new evidence was discovered.

Detective Grady Jackson, who’s worked at the Greeley Police Department for more than 15 years, testified Friday about his involvement in surveying the area where Jonelle’s remains were found in July 2019. Jackson previously farmed in the area and was familiar with how it looked in 1984.

Angela Hicks, Pankey’s former spouse, took the stand for her second day of testimony Monday morning. The remainder of Deputy District Attorney Robb Miller’s examination focused on the 1990s to 2019, when Pankey’s suspicious statements, legal filings and writings revolving around Jonelle’s case led Hicks to reach out to law enforcement.

On Friday, Hicks testified about her relationship with Pankey, as well as their lives together in their home at 6086 10th St. in Greeley. Hicks said it wasn’t unusual for her husband to leave for the day in the early morning and not return until anytime between 4-11 p.m., which is why she couldn’t recall what time he came home and what he was doing on Dec. 20, 1984, the day Jonelle went missing.

Defense attorney Peter Harris brought up the burning car with Hicks, asking if she knew the make, model or color. She didn’t. She was also unaware of the functions of the car, including if it was driveable, according to her testimony.

However, she told the court it was the only car to ever catch fire on their property.

In 2002, Hicks and Pankey finalized their divorce, and on July 4, 2008, their son Carl was murdered. Pankey, Hicks and their family members joined together later that year on Aug. 6, to celebrate their son’s life on what was supposed to be his 21st birthday.

Hicks and her sister, Vanesa Sakulenzkia, who also took the stand Monday, both testified they stood near Carl’s urn when Pankey approached and kissed it.

Deputy District Attorney Lacy Wells called Deb McDonald, formerly known as Deb Moon, to the stand to briefly discuss her romantic involvement with Pankey back in 1977 — which would later end in Pankey’s ex-communication from the church.

After McDonald decided to break things off with Pankey, an incident occurred between the two of them that led to the arrest of Pankey. Charges were filed against him but were later dropped.

Weld Judge Timothy Kerns advised the jury the allegations against Pankey cannot be used against him. The testimony was only introduced with the purpose of highlighting his ex-communication from the church, which bolsters the prosecutors’ argument of his hatred toward the church and law enforcement, Kerns said.

Steve Pankey, the 71-year-old man accused of kidnapping and murdering 12-year-old Jonelle Matthews in 1984, told a police officer in the late ‘90s that he buried bodies in Colorado, according to testimony Tuesday.


Lee Edgerton, a former Idaho police officer, took the stand Tuesday afternoon in the second trial for Pankey to discuss two run-ins with him between 1996-1997.

In 2019, Greeley detectives Robert Cash and Mike Prill called Twin Falls Detective Jon Daubner to assist in making contact with Pankey in Idaho. Shortly after this call, Pankey and Daubner spoke on the phone on Aug. 19, 2019, which prosecutors played for the court Tuesday.

Weld County District Attorney Michael Rourke asked Peggy Drake if she was taking the stand Tuesday morning in Pankey’s trial to defend the good name of Norris Drake, her deceased brother.

Peggy responded, “In a way … because I know he didn’t do it.”

A transcript from last year’s testimony of Kenny Andersen, who has since passed away, was introduced Tuesday morning by prosecutors. Andersen owned a car sales and salvage company.

Before the trial day ended Tuesday, Mike Prill began to testify about his involvement in Jonelle’s case. When reviewing the case, he said police reports from a former lead detective on the Jonelle case made him note, “… Pankey, what’s his deal?”

Prill said Jonelle’s coat was found partially zipped about an inch above the waistline and inside out on her remains. The cuffs were tucked into the armpits, and hand bones came out when he pulled out the cuffs, indicating her hands were located underneath her armpits when she was murdered.

Other testimonies included forensic scientist Kiera Wuensich, Greeley lawyer Don Janklow, former Weld County District Attorney Al Dominguez and retired Idaho police officer Mark Lockwood.

Prill will continue testifying 8:45 a.m. Wednesday.

Directly after Steve Pankey became a suspect in the kidnapping and murder of 12-year-old Jonelle Matthews, he started taking interviews with news outlets and accusing law enforcement of involvement in her death.

In continuation of Tuesday’s testimony, Mike Prill, one of two lead detectives from the Greeley Police Department working the case, took the stand to discuss his interactions with Pankey. Prill testified about Pankey’s multiple requests for immunity in exchange for details in Jonelle’s case, which began in 1985 and continued up until 2019.


Jennifer Yewer, a former district prosecutor in Lincoln County who testified Wednesday, said in her one encounter with Pankey in 1993, he requested her help because he was a person of interest in a Colorado case. He then asked her to contact the Weld County District Attorney and request immunity in exchange for information.

Greeley Police Detective Robert Cash and Pankey shared a phone call on April 8, 2019, in which Pankey said he wouldn’t reveal any information he had without some sort of immunity. A few months later, after Jonelle’s body was discovered, both detectives drove to Twin Falls, Idaho, to Pankey’s residence.

Prill testified it was clear from the get-go that Pankey didn’t trust law enforcement. Going into their in-person conversation with Pankey, Prill wanted to show Pankey they weren’t like the police back in the ‘80s and that they were accepting and understanding, he said.

The recorded interaction was played for the court Wednesday, beginning with detectives buzzing Pankey’s intercom and stating they came to chat with him.

In a podcast that was published in November 2019, Steve Pankey accused law enforcement of knowing the location of the body of the 12-year-old girl Pankey’s now accused of kidnapping and murdering since her burial in December 1984.


Pankey, 71, is on trial for the disappearance of Jonelle Matthews on Dec. 20, 1984. In October 2021, a jury found him guilty of false reporting to law enforcement but was hung on the kidnapping and murder charges.


Jonelle’s remains were uncovered by oil and gas workers in July 2019. That same year, podcaster Ed Dentzel, who hosts the podcast “Unfounded,” interviewed Pankey for his show.


Dentzel testified Wednesday afternoon into Thursday morning about the interview with Pankey, who claimed to be falsely accused of kidnapping and murdering Jonelle while directing the blame to “trusted adults” at the Sunny View Church of the Nazarene and Greeley Police Department. The interview stretched on for more than three hours.

Hicks testified earlier in the trial they had no plans to go to California, and their car was not packed at all, conflicting with Pankey’s alibi. Larry McConnell, a former Sun Valley police officer, spoke with Hicks in the ‘90s about her suspicions of her husband’s involvement in the case.


During McConnell’s testimony Thursday, he backed up Hicks’ story about the family’s trip to California back in December 1984 was not planned and how she “hurriedly” had to pack up the car to leave town on Dec. 22.


He remembered she told him Pankey “took care of their dogs,” who she never saw again, as well as Pankey’s fixation on the case through media coming back into town on Dec. 26, 1984.

Norris was across the street at his mothers that night and easily could have seen her dropped off. He could see that no one was home when she arrived and the friend's dad who dropped her off left (the person who dropped her off said the lights were all off until she flicked the light on). He goes across the street and looks in a few windows to make sure and then more than likely rings or knocks on the door. Jonelle knew who he was. He left his mom's house that night around the time she went missing and is unaccounted for that night.

There is also no evidence that Pankey would have known she was home for such a short amount of time before the dad got home. He lived about 3 miles away and it was the dead of winter in Colorado. I think he is just a weird guy who got himself involved in the case. Norris or the dad are the only two that ever could make sense to me.

*Trial continues (Day 12) (@ 8:30am MT) – CO – Jonelle Renee Matthews (12) (went missing on Dec 20, 1984 after entering her home at 8pm, Greeley, found July 23, 2019 by construction workers at an oil & gas site in rural part of Weld County near County Road 49 & County Road 34½) – *Steven Dana Pankey (33 @ time of crime/69/now 71) indicted (10/9/20), arrested & charged (10/12/20 in Meridian, ID.) with 1st degree murder after deliberation, 1st degree felony murder, 2nd degree kidnapping, with sentence enhancers for using a weapon in a violent crime & 2 counts of crime of violence. Plead not guilty. $5M cash-only bond. Bond reduction denied (11/8/21).
Mistrial declared for counts 1 thru 3. Guilty on count 4, false reporting to authorities.
Re-Trial began on 10/4/22 & ended 10/6/22 with jury selection. Trial began on 10/7/22. (thru 11/4/22).
