Friday, October 18th:
*Pretrial Readiness Hearing (@ 9am MT) - CO – Kelsey Berreth (29) (last seen Nov. 22, 2018, Woodland Park; phone pinged 800 miles away in Gooding, Idaho on 11/25/18 @ 5:13pm, reported missing Dec. 2, 2018; not found) – *Patrick Michael Frazee (32) “fiancé” arrested (12/21/18), charged (12/31/18) & arraigned (4/8/19) with 2 counts 1st degree murder (to align with the prosecution’s theories on how he did it), 3 counts of solicitation to commit 1st degree murder, 1st degree felony murder (death during attempted robbery) and charged (4/5/19) with 2 counts of crime of violence (sentence enhancer). Held without bond.
Trial set to begin 10/28/19. Jury selection will start. Expected to last 3 weeks (thru 11/18/19).

9/5/19 Update: Child: review hearing held. 9/5/19: Next review hearing on 12/5.
A request by prosecutors to compel Frazee to reveal whether he intends to present an alternative theory about who killed his fiancee at his trial. Sells said he will hold a hearing on that issue by Sept. 16. Next is Pretrial Readiness hearing on 10/18.
9/16/19 Update: Frazee's attorneys had until 11:59 Monday night to file paperwork accusing someone else of killing Berreth late last year. The spokesperson for the Colorado Judicial Branch confirmed with 11 News Tuesday morning that the defense team did not file anything. Next pretrial readiness hearing on 10/18.
*Krystal Jean “Lee” Kenney – plea deal-plead guilty to one count of tampering with physical evidence, a class 6 felony, with an open sentence. Review hearing on 12/2.

Poor Sam, we have asked a lot of him:

Renovate that 100 year old courtroom to fix the acoustics.

Violate the decorum order by posting live video of the proceedings.

Construct a chair adjacent to the judge, so he can hear better.

Transplant one big toe to each hand, so he can double his Tweeting speed (my latest request).

If anyone can do all these things it’s Sam, unless he isn’t really the intrepid reporter he claims to be.

On the docket today is a pre-trial readiness conference. Essentially, both sides will say whether they're ready for trial, which is scheduled to begin with jury selection on Oct. 28.

Again, today’s the last chance to decide on any outstanding motions before the trial, which begins with jury selection on Oct. 28. It would also be the final chance for a plea deal to keep this from going to trial.

Yes, why does PF get any special (good or bad) treatment??? He should be escorted in like any other defendant. Grrrrr, it makes me so mad.

Judge now looking at a defense motion to include “in-life photos”. Sells says he presumes the Safeway surveillance video will be played. Prosecutors say yes — and object to the defense motion.

Prosecutors say it’s necessary for people to introduce photos of #PatrickFrazee and #KelseyBerreth in order to show their relationship. They say there are photos he asked for from Kelsey’s phone after the murder.

Reed says it’s imperative to prove a relationship between Berreth & Frazee through the use of in-life photos. She says they also help prove Frazee asked for some photos off Berreth’s phone. They also plan to use the missing person flyer.

May says they have a photo of Berreth’s family from inside her townhome that he says has clear wipe marks on it, suggesting the cleanup. Reed says she can get them to the judge by Monday.

Judge says he’s a bit skeptical on the use of that, based on case law, but he needs to see the photos first. Stiegerwald asks the court for a deadline to see those photos. Both agree they could discuss during jury selection.
