Never underestimate the power of human stupidity.
But I for one do not believe for a moment the jury will have a verdict other than GUILTY.
Yeah, and the cases that people tend to cite as examples of jury stupidity, generally are nothing like this one.

Casey Anthony being the biggest example.
 
Human tooth found near burn site on Kelsey Berreth murder suspect’s property, expert says

While sifting through the charred area, investigators found a fragment that appeared to be a tooth. Later, they sent it to Dr. Diane France, a forensic anthropologist who regularly analyzes cases in Colorado.

“I think this is a human tooth,” France said.

She also said the tooth was broken, which could indicate it either got so hot that it cracked or had been broken in another way.


“There’s no evidence it was heated to the point it would just crack hard, it looks like it was blunt trauma,” France said.

After France analyzed the tooth, it was sent to the Colorado Bureau of Investigation, which attempted to conduct a DNA test.

Caitlin Rogers, a forensic scientist with the CBI, was in charge of that analysis. She also took the witness stand on Wednesday afternoon, and said that when she swabbed the tooth, she was able to find evidence of human DNA.

“I attempted to develop a DNA in the profile and unfortunately there was not enough DNA present in the profile,” she said.

The tooth was later sent to the FBI for what’s known as mitochondrial testing. This test also proved unsuccessful because scientists said there simply wasn’t enough DNA left on the tooth to gather any information.

Five of Berreth’s former coworkers and supervisors at Doss Aviation also took the witness stand Wednesday, the eighth day of testimony in the trial. One witness even pointed to a potential motive in the alleged crime.

The former manager of human resources, Jennifer Barks, said Berreth listed Frazee as the beneficiary of her life insurance policy at some point during her work at the Pueblo pilot instructor program. But Barks said Berreth’s life insurance may not have been active because the company changed ownership about the same time that Berreth was reported missing and she never enrolled in the new owner’s life insurance program, Barks said.

Prosecutors also asked Berreth’s coworkers if they ever saw signs that Berreth had problems with drugs or alcohol, as Frazee had told multiple people in Teller County. Each said they saw no such signs.


Her coworkers also said that Berreth loved being a mother to her and Frazee’s daughter, Kaylee, and that Berreth never talked about giving up custody of the child. Frazee told others that Berreth had given up all her rights to the child and abused the girl.

Frazee told multiple people that Berreth went to rehab for addiction, testimony on Tuesday showed. But Berreth’s friends said that wasn’t true.
One friend, Peter Sergev, said that Berreth went to California for some days in 2018 for treatment for depression and anxiety.

Her coworkers described Berreth as a hardworking, sweet young woman who did not often speak of her private life.

“She was quite a strong woman,
” said Carolyn Sharp, a pilot instructor at Doss who worked with Berreth.
 
So what if this all isn’t enough, and he’s found not guilty?:(

I think I might gag myself for saying this- forgive me all, but I have seen many guys hold their babies like this in a photo. I didn't think much of this one.

Agreed. I don't think that pic by itself is all that terrible. It's more that it's similar to that whole video of PF holding her by the red truck outside the lawyer's office. It just feels like he's always kind of lugging her around without much affection or tenderness. But I agree, if it was just this picture by itself, it wouldn't really raise flags. Just in the context of PF - well, looks about right. jmo!

At this point, PF couldn’t say or do anything right in my eyes. Similar to when someone starts to annoy you everything they do somehow becomes annoying. :p
 
Rogers also testified about the DNA found on various items in Berreth’s condo that tested positive for blood. This included near the fireplace, on the baby gate, two chairs that had been used as a TV stand, and on the floorboards.

The prosecution pointed to samples that contained Berreth’s DNA, though some of those swabs also included DNA that likely belonged to Frazee, Berreth’s mother and brother, and the last woman who lived in the condo.

Lee claims that Frazee killed Berreth on Nov. 22, 2018 — Thanksgiving Day. Lee said Frazee called her that night and said there was a “mess to clean up.” The next night, Lee said she drove from Idaho to Colorado to clean up a bloody crime scene in Berreth’s apartment.

After putting Berreth’s body in a tote, Lee said Frazee stored it on top of a hay pile at a ranch he leased to run cattle. A search of that ranch revealed black discoloration on a hay bale, but Rogers said CBI was not able to find human DNA on a sample taken from the area.

Now back to #KelseyBerreth trial. Today we heard from the previous owner of the condo where Kelsey lived. This woman testified that she lived there for 26 years, moved out spring 2018. (Prosecution appeared to be explaining why someone else’s DNA might be found there)

Dr. Diane France, an expert in the field of forensic anthropology, took the stand this afternoon. One area of her expertise (shes written books on this topic) is looking at bones and determining whether they are human or animal

Dr. France said she was asked to help review what investigators found when they searched the Midway Landfill for #KelseyBerreth’s remains. (Ultimately, they did not find remains there)

Dr. France was also asked to review possible tooth fragments found near the alleged burn sight on Patrick Frazee’s property. “They are both tooth fragments, that’s pretty clear” she said, referencing photos shown in court. She testified its consistent w/ a *human tooth

Prosecutor points out there could be other animals on Patrick’s property – dogs, horses, cow, etc. Prosecutors asks Dr. France (again, expert in human vs. non-human identification of bones) if the tooth could belong to any of those animals – France says no. “I think its human.”

Next we hear from serology and DNA expert Cailtlin Rogers, who works for CBI. She handled majority of DNA testing in Kelsey Berreth case.

This is super complex science, but best I can explain it is this: she collected DNA belonging to Kelsey, Patrick, their daughter, Kelseys mom & brother, previous condo owner/resident, and Krystal Lee. Then she used those DNA profiles as references as she tested items of evidence.

So in simplest terms, Rogers testimony explains how she matched Kelsey’s DNA profile to samples collected from Kelsey’s bathroom and toilet, possible blood on Kelsey’s fireplace, a baby gate, pieces of hardwood living room floor, and furniture

Lot of DNA samples collected from pieces of the hardwood floor, a few of those wood pieces were shown in court. Remember previous testimony that investigators ripped up that floor after Krystal told them about blood there

Many of those samples had other DNA in the mix, too. Lots of DNA from the bathroom and several floor samples also matched the previous condo owner (who testified that she had hardwood floors installed about 2 decades ago).

Some of the DNA samples from floorboard also had potential matches to Patrick Frazee, Kelsey's mom Cheryl and her brother. Some of those results said DNA match were more likely/accurate others.

Rogers also tested a sample of hay from the barn at Nash Ranch, where Frazee allegedly stored Kelseys body in a tote. Rogers said that sample, when tested, did not indicate presence of human DNA

Rogers also tested the tooth fragment found on Frazee’s property. She testified that she could detect 2 things: there was human DNA, and it wasn’t male. However, Rogers says there wasn’t enough DNA in the sample to get a profile (meaning WHO it belonged to)

Rogers says the tooth went to FBI for more testing, still not enough DNA to develop a profile. We’ve previously heard about “consumptive testing” in this case, its a testing process that “consumes” the item. The tooth is, essentially, gone now due to the testing it went through

After a full afternoon of testimony, Rogers ends by saying bleach can destroy DNA to the point where it cant be detected or analyzed. Remember Krystal said she cleaned Kelsey's home with bleach

And with that, day 8 of testimony is finished. Court resumes tomorrow morning at 8:30. And if we continue moving at this rate, the judge says we could hear closing arguments by the end of the week.

DNA testing on two key pieces of evidence in the murder trial of Patrick Frazee did not result in a match with the Florissant rancher’s alleged victim and former fiancée, Kelsey Berreth.

A sample of discolored hay from the Teller County barn where prosecutors’ key witness said Frazee hid Berreth’s body tested negative for human blood and for any trace of human DNA, an analyst from the Colorado Bureau of Investigation testified Wednesday.
The tooth recovered from Frazee’s ranch – near where he allegedly burned Berreth’s body – was identified as human, but analysts could not draw a DNA profile from the fragment or match it to a person.
