Cold Case Homicide Arrest​

In the early morning hours of June 5, 1988, the body of 24 year old Mary Lynne Vialpando was found in an alley behind businesses in the 2600 block of West Colorado Avenue. The investigation into her death revealed that Mrs. Vialpando had been sexually assaulted and died as a result of blunt force trauma.​

Earlier today, September 20, 2018, the Colorado Springs Police Department’s Cold Case Homicide detectives obtained an arrest warrant for the suspect in this investigation. James Edward Papol, a 46 year old male, was arrested for First Degree Murder and was taken into custody in Pueblo, Colorado. Follow Twitter for Papol’s picture.

"According to police, Vialpando argued with her husband after returning home from a wedding and ran away. Her body was found in an alley the next morning. She had been stabbed, sexually assaulted and beaten.

"Papol was 15 at the time Vialpando was found dead, but he is being tried as an adult."

“She was beautiful,” said Cynthia Renkel, Vialpando’s sister.

Renkel said she had never heard of the man accused of killing her sister.

“I was shocked at his age more than anything,” Renkel said.

In the years since the gruesome death, Papol has faced a slew of charges for other crimes, including kidnapping, robbery and harassment.

Were she still alive today, Vialpando would be in her 50’s. Her then-young daughter is now grown up.

"Three months ago, James Edward Papol asked his mother to visit him at the Colorado Mental Health Institute at Pueblo, where he was a patient.

It appears Papol wanted to explain to her why he was about to be arrested in the rape and fatal stabbing of 24-year-old Mary Lynn Vialpando, a Colorado Springs murder that had remained unsolved for 30 years....

Papol is facing charges of first-degree murder and felony murder predicated by robbery, rape and theft, 4th Judicial District Attorney Dan May said in announcing his arrest last week...."

Murdered Colorado Springs woman's family gets first look at suspect in 30-year-old case

"Thirty years after Mary Lynn Vialpando was raped and stabbed to death on Colorado Springs’ west side, her grieving relatives got their first look Thursday at the man police identified as her killer.

Her daughter was among those who sat quietly in a front row — tearfully holding a framed photo of her slain mother — as James Edward Papol was led into court for his first in-person appearance in 4th Judicial District Court....

Because Papol was 15 at the time of Vialpando’s slaying, his legal team may petition to have the case moved into Juvenile Court, attorney Richard Bednarski told the court. Alternatively, his attorneys may ask to have the case dismissed on the grounds that charges should have been filed in Juvenile Court in the first place.

The legal debate pivots on differences in juvenile law in 1988 versus today — and the question of which laws should prevail....

Papol, a repeat felon, was tied to the killing by DNA collected from the Vialpando’s body, cracking a stubborn cold case, authorities say. The Colorado Bureau of Investigation made the match late last year during a routine check of known DNA profiles against those from unsolved cases....

Before he was arrested in September, Papol met with his mother at the mental health hospital and told her he had found a woman’s body that night, touched it and taken jewelry, leaving his DNA on the body, according to the arrest affidavit...."

COLORADO SPRINGS, Colo. - The 46-year-old man arrested for a murder that happened 30 years ago will not have his case moved to juvenile court, but there's a chance that he could be sentenced as a juvenile if he's convicted.

Man accused in 1988 Old Colorado City murder to undergo mental health evaluation

"A man accused of raping and killing a woman in Old Colorado City in 1988 was ordered to undergo an evaluation to determine if he’s mentally fit to stand trial.

James Edward Papol, who authorities say has been tied by DNA to the murder of Mary Lynn Vialpando, experienced “a significant decline in his mental functioning” after going eight days without his anti-psychotic medication at the El Paso County jail, one of his defense attorneys told 4th Judicial District Judge Robin Chittum during a pretrial hearing.

After testimony from investigators and forensic experts, Chittum ruled Friday that the prosecution has enough evidence for Papol to stand trial on charges including three counts of first-degree murder, each for a different theory of how the crime unfolded.

But the competency evaluation, which Chittum ordered be done at Colorado Mental Health Institute at Pueblo, could put his case on hold for months or longer.

“This is going to come up again,” said Chittum, who set another hearing for April 5 to discuss progress on the evaluation. “This is a case that he needs to be actively participating in, down the line.”...

Dressed in an orange jumpsuit, Papol trembled in his chair at the defense table, bouncing up and down slightly. The judge denied a motion by defense attorney Richard Bednarski to delay his preliminary hearing due to his mental state, but allowed Papol to leave before witnesses were called after Bednarski said he was too disturbed to “understand what’s going on.”

When Chittum asked if he wanted to stay for the hearing, Papol quietly replied that he preferred to “go back to jail.”..."
