He sentenced a teary-eyed Gallegos to
12 years in prison followed by five years of parole for child abuse resulting in death, a Class 2 felony.
"Common to every living creature, from mudworms to human beings, is the instinct to protect the young," Robbins told Gallegos.
"If you wanted to play house with Mr. Montoya, fine. That's your business. But you had no business bringing Neveah into that situation."

Amico painted Montoya as a manipulator bent on covering his tracks. An hour after Neveah died, he called Gallegos at work and asked her to come home.
Montoya had the couple's song, "Always and Forever," playing when Gallegos arrived to find her daughter dead, Amico said.
"He said, 'They're going to blame both of us. . . . If you love me, you'll think of me too,' " Amico said. "Quite sadly, quite pathetically, that was all it took."

A judge declared an immediate mistrial Thursday at about 2 p.m. in the deadly child abuse trial of Angel Montoya.

it was Gallegos' actions on the witness stand that caused the mistrial in the original murder trial.
While Gallegos was testifying about what happened shortly after she discovered her daughter was dead,
she referred to Montoya as a sex offender.
While Montoya was a registered sex offender,
the defense had won the argument during a previous hearing to have that information omitted from the trial.

Montoya will stand trial on June 30, 2012, for first-degree murder of a child by a person in a position of trust.
