Nine years of investigation, five potential alternate suspects, fading memories of witnesses, debates about investigative standards and the incredibly complex life of slain Grand Junction woman Paige Birgfeld are some factors that will challenge 12 Mesa County jurors as they begin deliberations Tuesday to determine whether to convict accused killer Lester Ralph Jones.

Attorneys on both sides of the courtroom presented their closing arguments Friday in Mesa County district court.

Following themes from the past five weeks of testimony, prosecutors laid out Jones’ alleged obsession with Birgfeld, his suspicious behavior the week of the her disappearance and his past episodes of violence. Defense attorneys pointed at missteps in the investigation, what they said was law enforcement’s fixation on Jones as a suspect, and the behaviors of five other potential alternate suspects who might have killed Birgfeld nine years ago.

On the second day of deliberations in the Paige Birgfeld murder trial, jurors asked the judge for all 7½ hours of video of the interrogation of the suspect. They wanted to review it in the jury room.

Jones’ defense team objected to the interrogation tapes claiming that allowing the jury to play different parts of the tapes over and over again would be unfair to their client. The judge did not agree.

Jurors will continue deliberations at 9 a.m. Thursday.
 
The foreperson of a jury hearing the trial of the man accused of kidnapping and murder in the slaying of Paige Birgfeld told a judge Friday morning in Grand Junction that progress toward a unanimous verdict is unlikely.

Chief District Judge Brian Flynn ordered the jurors to keep deliberating in the case, telling them: “You are not advocates, you are judges of the facts.” Flynn said he believes the jurors could use more time in the case.

I was more worried about an acquittal than a mistrial. At least they can have another trial for Lester Jones. It doesn't even seem as if the alternate suspects had a significant role in doubting the jury.

There's still a chance that a plea deal might be reached, if both sides can agree on one. The state has 90 days to set a new trial, which could begin this winter.

The 12-person jury that heard five weeks of testimony in the murder trial of Paige Birgfeld’s accused killer might have been hung, but its members were all in agreement on one thing — the evidence, as it was, pointed at Lester Ralph Jones and at no one else.

Nobody on the jury thought Jones was innocent of wrongdoing in the 2007 disappearance and death of Birgfeld, a Grand Junction soccer mom by day who moonlighted as an escort, according to five jurors who agreed to speak publicly to the media Friday, after Mesa County District Court Judge Brian Flynn officially declared a mistrial in the case because of the jury’s inability to reach a unanimous verdict.

“By no means does anybody really think that he didn’t do this …,” said juror Bobbi, who herself was one of three jurors in favor of acquitting Jones. “It’s the fact that there was not enough evidence for them to get past the reasonable doubt. … (The prosecution) didn’t prove it.”

Jurors commented on several aspects of the trial, including what evidence they found compelling — like phone records — or not credible — like testimony from self-confessed former drug users.

The past six weeks brought days of grueling testimony, hours of evidence, and numerous witnesses called to the stand. It all may have to be redone in the next few months.

“The defense can waive that and give us a longer period of time in which to try and get the trial started,” said Mesa County Chief Deputy District Attorney David Waite.

This means the timeline surrounding a new trial could range anywhere from the next few months to after the holidays.

On Friday, both the defense and prosecution will meet to determine the next steps in the possible retrial.

In order to accommodate scheduling, all parties agreed to lengthen the amount of hours spent presenting in the courtroom throughout the course of the trial, allowing for the trial to last roughly 5 weeks not including jury selection or deliberation.

In the end all parties agreed to retry the case beginning on November 21st, with a pretrial conference set for November 16th.

Lester Jones appeared in court again on Wednesday as the prosecution and defense, gather for the pre-trial conference.

On Monday, Nov. 21, the retrial of Lester Jones begins with jury selection.

After more than a month of testimony, the Lester Jones murder trial ended with a hung jury this past September.

"That poses some difficulties in getting a jury, anytime you tell a jury you need their service for five weeks, it poses some challenges in getting a jury selected,” said DA Dan Rubinstein.

It’s especially challenging when those five weeks fall during the holiday season. DA Dan Rubinstein also said the extensive media coverage of the initial trial could present a challenge in finding an unbiased jury in Mesa County.

They're starting with a pool of about 600 jurors, and moving to a back-up pool if needed. The DA says that neither the defense nor prosecution has filed for a change in venue yet.

Despite the national notoriety of Grand Junction call girl Paige Birgfeld’s disappearance nine years ago, a widely publicized murder trial this summer that ended in a hung jury, and a do-over scheduled in the heart of the holiday season, attorneys on Friday managed to seat a jury to hear the second trial of the man accused in her death.

Jury selection began Monday. Although the parties took Thursday off for Thanksgiving, a jury of 15 people – 12 jurors and three alternates — was seated late Friday morning, said Chief Deputy District Attorney Dave Waite. The court broke for lunch and planned to resume in the afternoon for opening arguments from both sides.

Jones, who is represented by public defenders Steve Colvin and Kara Smith, will return to court at 9 a.m. Monday.
