I do wonder this morning as BM heads to court again what his innermost thoughts are. Does he believe he will be acquitted? Trial is getting close. You can count the people who believe him on one hand.

Even with all the discussion and back and forth that goes on here, most of us agree he is guilty. He knows he is. Yet I wonder what he is thinking deep inside.


As you seem to have, @love..., I have likewise been unsuccessful in resisting the temptation to wander around the tortuous and tortured mind of Barry Morphew. I've done it with my every visit here.

I also am unable to shake the notion that, should he have not pre-arranged and have in place some sort of deus ex machina extrication from his Fate, a germ of madness will at some point again trigger a blinding, uncontrollable rage. This rage will produce an outburst; if during trial, an immediate recess; and the recess, perhaps an indeterminate continuance should professional advice as to Barry's fitness to participate in further proceedings be considered prudent.
That said, w/any repeat outburst, well, he's off to an N-P facility for who knows how long.

My speculations, opinions and proffered state(s) of mind for all parties/events concerned are owned fictions. Except for my finishing expletive which is, imo, compelling and logical.
 

Interesting breakdown...especially the part about what witnesses will and will not be allowed to testify to at trial.

In his view the trial will be way different than the AA and even the prelim.
I didn't find this episode very helpful. SR seems unprepared. He seems to be reading the documents for the first time, and he rambles. But you're right - he does have an interesting take on how the trial will go, and he remains very critical of the prosecution. Nonetheless, he doesn't think the judge will dismiss the case.

If anyone wants to understand better the position of the parties, I recommend the KKTV site article, Prosecution Responds to Defense Motion to throw out Barry Morphew Case. It has the motion and response embedded in the article, and they make interesting reading. I have the impression that there's a lot more drama than substance in the defense's tactics, and that the essential evidence will get to the jury.

IIRC, the prosecution stated last time that they intend to file a motion to exclude from the evidence at trial any reference to the foreign DNA found in SM's car. Judge L issued a ruling without hearing any evidence or argument, stating that the evidence would be allowed. However, he left the door open for the prosecution to show him why it should be rejected, and I hope they take the time to educate him (and us) about this topic by filing a motion.
 
I don’t think you can take the “never would have biked there” as gospel. How would BH know? Was he with SM on her every ride? Did SM tell him about every ride? Imagine him being cross examined by IE.
Maybe not Gospel, but I think MH can speak with some authority on how SM viewed her skill level.
SM had only had her bike for about a month. She posted her rides on Instagram and I’m assuming she was excited to talk about them , especially with someone who shared the sport of mountain biking.

Fine, but then explain why she didn't bring things she would normally bring, and why her phone powered down just as Barry was leaving, and she never bothered to turn it on that morning.

Yet took it with her.

Why any random abductor would take the time to throw her bike down a ravine, and dump her helmet while making his getaway.

And how he would manage to do these things.

A low risk victim taking a bike ride in a low crime area and she's abducted?

Ok, then Barry's alibi should be pristine.

Didn’t she just get her bike back from being worked on? So maybe taking it for a spin near the house to check everything was working correctly before driving to the trail? Why would she put on her camelback for that?

If I was the defense that is the tact I would take on the bike. The rest would be much harder to explain away.

It's also the name of a family that has long held a farm outside Delphi, Indiana near the Gerard Nature Preserve and Monon High Bridge.

BM is from Indiana. I wonder if he was acquainted or at least familiar with the family or any of its members and just mistakenly thought that the way they spell their name (Mears) is how "mere" is always spelled.

That's the issue. They can pick at certain pieces of evidence, but much of it is backed up by other pieces.

Like Barry's cell phone showing a a frantic event. The defense can claim the data is unreliable, but the prosecution just needs to point to Barry's hilarious chipmunk alibi.

Mears, Michigan is where Suzanne's father's tree farm was.

SM got new tires on May 7.
We don’t know if she did a test run after that, but I wouldn’t think that the curvey part of HWY 50 would be a good spot to do it. JMO

Exhibit 93, 94: Pictures of #SuzanneMorphew bike found off of CR225. Scott Banks was interviewed and is a bike mechanic. He had put new tires on Suzanne's bike on May 7, 2020.

I checked the weather forecast on 5/10/20 (Salida). Between 8-9 am the temperature was in the 40s...It didn't reach 50 degrees until about 10am. The most comfortable period of the day was 12pm till 6 pm with 3pm being the ideal time with temperature in the high 60s tipping at 70 degrees max. Kind of explains why Suzanne was biking in the mid afternoon in May consistently. Was she biking in the morning with temperatures in the 40s...knowing full well that the temperature would rise another 25 degrees that afternoon? I tried to paste a graph....not very good at it.

That's what I felt - he didn't seem across the detail, or prepared to discuss the case other than in general terms.

e.g. hearsay evidence. Well we know what that is, but to claim it isn't admissible - well that just isn't true and the evidence about the abuse wasn't excluded because of hearsay. As far as I know, SMs texts are being admitted otherwise.

Also the stuff about Cahill's opinion on the arrest - that is just nonsense. A judge signed off on the arrest. A judge found the accused should stand trial. Cahill's opinion was incorrect. How is it exculpatory? It doesn't raise any evidential foundation that points to BMs innocence.

Then his discussion of the DNA was just factually incorrect.

I actually wondered if he was a bit drunk because normally he is much better.
 
Barry's insistence that there's no evidence in the home is a thing of beauty!

In attempting to prevent the obvious evidence of a crime (like blood spatter), he succeeded in leaving a full mountain of evidence!

Well that's a big nothing :-( man I hate that we can't get anything out of the courtrooms!

Commander says the temperature on the morning of May 10th was around 38 degrees at 8am.
On May 14th #SuzanneMorphew bike helmet was found .84 miles from the bicycle. Commander says no significant damage to the helmet. #BarryMorphew @KKTV11News
