The plastic cover was located by evidence search teams in the dryer, inside of the sheets belonging to REDACTED bed."

May 20, 2020 – Spy Pen found.
"The pen was located in a cloth bin amongst women’s bras. The cloth bin and pen were inside the walk-in closet in the master bedroom, located on the ground level of the residence. Detective Hysjulien located, with the pen, the controller and headphones for playback and a USB cable."

Within a month of Suzanne’s disappearance, Barry began to liquidate their assets.

"Morphew was arrested around 9:15 a.m. on Wednesday, May 5 near his home in Poncha Springs. FOX31 News has obtained video of the arrest, which shows his truck stopped on the side of the road near several police vehicles. He can be seen standing just off the road with an officer."

One point which stands out is that Suzanne reached out to JL 5 months after the family relocated to Colorado. That is a very short time frame when you consider the time it takes just to adjust to a new environment, neighbors, community, doctors etc....The state of that marriage must have been reaching critical mass even before the move started. We focus on the condition of this marriage toward the end...but the condition of things shortly after the move must have been deteriorating at breakneck speed...given the course of events.

The trigger and the motive aren't necessarily the same thing. The motive was money. Based on his movements and actions, Barry had been aware of Suzanne's paramour for at least six months (IMO, he knew pretty much immediately when you consider that they connected around the holidays 2018 and in January 2019 Barry takes her phone in Mexico.).

The trigger was Suzanne's determination to leave.

Supposing the girls camping trip was just a fluke.

Supposing Suzanne builds up a good head of steam on the drive home from Gunnison. And when they both get home for the day, she drops the hammer. Probably a pretty nasty blow out based on Suzanne's surviving message to him in the morning:

”I’m done. I could care less what you’re up to and have been for years. We just need to figure this out civilly.”

I've looked at this text and looked at it. "I'm done," has a lot of implications. Done fighting, done with the marriage, done with his crap. Which seems to be reinforced by her next sentence. "I could care less what you’re up to and have been for years." I don't think this is about his cheating. I think it's about the money.

Later in the day he sends her:

So Barry makes his decision and he's got to get it done before the girls get home. I think if we knew more of Barry's movements on the 6th & 7th we'd have a better idea where Suzanne is now.

I don't disagree one bit with your theory. I don't think texts like the ones they had back and forth prove he murdered Suzanne however. I think they need something more...maybe the actions AFTER the 9th will be enough, but I've not seen anything prior factual that would sway me. They aren't going to be able to have behavaioralists talk about emotional abuse and at the time of the AA (and we don't know much after) they had not found evidence of Barry cheating and they hadn't found accounts other than Monex which Suzanne knew about in his name only. Defense will make sure the jury hears and remember that he claimed to love her and was trying to make her happy again and not divorce him. They have data from him saying he'd pay her back her inheritance money. So in my mind the crux of the prosecution's case is the 9th and after for proving he murdered Suzanne through his actions after the 9th. But we don't have long before we find out just how prosecution makes their case.

I don't think there's anything unusual about not finding Case #D82021CR85 on the Chaffee County Docket at this time.

By Court Order [D-34] DEFENDANT’S MOTION TO CHANGE VENUE filed January 31, 2021, we know the last hearing held in Chaffee County for Case #2021CR78 was Tuesday, Feb 1, 2022. (now as case #D222022CR47 Fremont County Division 1).

Given that BM's forgery/voter fraud hearings were typically held on the same date as the murder hearings (for the convenience of the attorneys and the court), I think it's safe to assume any Chaffee County hearings on the forgery/voter fraud scheduled after Feb 1, 2022, have been continued. Also, take note that any action by the state to drop the charges won't happen in a vacuum but will be done by Motion, Answer, and Court Order --that will eventually be made available to the public. :)

Interesting breakdown...especially the part about what witnesses will and will not be allowed to testify to at trial.

In his view the trial will be way different than the AA and even the prelim.

In this case I suspect he is right. Reading the affidavit was an eye opener to me for how much content could easily be suppressed by motion and law. I can't speculate on the final witness list but prosecution has to be thinking through potential cross as they prepare their case. I do think prosecution had to have sharpened their proverbial pens on their preliminary as they now know the weak spots. LE was extremely tight lipped about this case which was good, but the affidavit where we finally learned their line of thinking made me think they might have been premature in the arrest. Defense moving the case along at a steady clip without asking for continuances was a huge clue also until we got facts.
 
One point which stands out is that Suzanne reached out to JL 5 months after the family relocated to Colorado. That is a very short time frame when you consider the time it takes just to adjust to a new environment, neighbors, community, doctors etc....The state of that marriage must have been approaching critical mass even before the move started. We focus on the condition of this marriage toward the end...but the condition of things shortly after the move must have been deteriorating at breakneck speed...given the course of events.
According to SM’s sister, MB things were pretty bad before the move.

Also, SM’s cancer had returned right before the move.
JL said he doesn’t think she was looking for a romantic relationship when she reached out to him with the “ Howdy, Stranger” message, but was more needing someone she could talk to.
When she learned he worked for Pharmaceutical company, she sent him some of her lab results and asked for advice.
I think it didn’t take long for SM to realize that moving to Colorado hadn’t changed anything in her marriage.
I can see her wondering how her life would be if she had married someone else.

Totally agree! Been saying that for over a year now. If the prosecutors can't convince the jury that the whole bike ride was staged, I do not believe that BM will be convicted. There will be at least one juror holdout who thinks something happened on the bike ride. JMO
 
What would speak against it, if BM had promised his daughter MM1 money, so that she and her sister MM2 could go on a nice trip far away, take MM1's girlfriend with them (BM paying for the costs) and the three of them could celebrate MM1's graduation. In return, MM1 shouldn't reveal anything about her father's suggestion. Would have been a quite normal arrangement, at least perhaps in the M-household, IMO.
Except she now knows her mother died in the process.
 
I have always wondered why MM2 would think that her parents having a fight would keep her mom from responding to her texts or calls. I’m sure Suzanne had always put on a brave face for her daughters and tried to minimize their worry.
In her heart, I think she knew one of them might not be alive. Suzanne would be dead or she would have defended herself causing him harm. She suggested a restraining order. There’s no hiding Barry’s hot temper. Spoiled brats always have temper tantrums. She saw it lots. I hope she is brave enough to speak up. But I doubt it.

Do you not believe in circumstantial evidence at all? Do you have to be there in person to see it or view it on video? They have proof. Even if it’s circumstantial.
 
I must admit, this has me confused. She indicated she was afraid to be alone with him, YET, there was texting about biking and hiking? The last thing I would do is go hiking in CO with someone I was scared to be alone with. Although, she also said he wouldn’t cross that line, “he’s learned,” or something to that effect. Perhaps, she was just trying to keep things civil and truly believed he was incapable of doing her mortal harm? If only she had understood he was VERY capable :(.
True! Yet when he asked to go hiking, she said "where"...

I still say she had concerns....

The trigger and the motive aren't necessarily the same thing. The motive was money. Based on his movements and actions, Barry had been aware of Suzanne's paramour for at least six months (IMO, he knew pretty much immediately when you consider that they connected around the holidays 2018 and in January 2019 Barry takes her phone in Mexico.).

The trigger was Suzanne's determination to leave.

Supposing the girls camping trip was just a fluke.

Supposing Suzanne builds up a good head of steam on the drive home from Gunnison. And when they both get home for the day, she drops the hammer. Probably a pretty nasty blow out based on Suzanne's surviving message to him in the morning:

”I’m done. I could care less what you’re up to and have been for years. We just need to figure this out civilly.”

I've looked at this text and looked at it. "I'm done," has a lot of implications. Done fighting, done with the marriage, done with his crap. Which seems to be reinforced by her next sentence. "I could care less what you’re up to and have been for years." I don't think this is about his cheating. I think it's about the money.

Later in the day he sends her:

I’m sorry if things went the way they did. I have a problem dealing with the way you accused me of hiding checks. If you think I’m as terrible of a person to hide our accounts and have ones you don’t know about you don’t know me. All I do is for you and the girls. All. I agree with this - all the abusive signs are there in that text.

When that approach didn't work - he made his final decision.

You don't need physical evidence to reach a conclusion. The Schelling case had no body or physical evidence, and it resulted in a conviction. Cell phone evidence and lies go a very long way. We're way past "CSI."
