Troconis has maintained she is innocent of the charges and intends to appeal “in the next couple of weeks,” her lawyer said Friday evening, citing an “insufficiency of evidence.”

“I’ll just start by saying something that I’ve been biting my tongue and not saying up until now, I don’t think there was anything fair about this entire process. I don’t think this case should have been heard here in Stamford from the get-go,” Jon Schoenhorn lamented.

“There are many issues that I believe were decided in error, but that’s not for me to decide. That’s going to be either for the Connecticut appellate court, or the Connecticut Supreme Court.”

Troconis’ sister, Claudia, agreed that there were “indeed various legal flaws” and “insufficient evidence to convict Michelle.”

“The only thing we know for sure is that Fortis Dulos killed Jennifer, and Michelle Troconis had absolutely nothing to do with it before, during or after Fortis murdered Jennifer,” she said.

“Michelle would never be capable of harming anyone … Both women were misled by Fortis Dulos, who deceived them for his own gain. We will continue to seek justice, and we’re committed to fighting for her rights. The children and families deserve to know the truth.
 
TROCONIS SENTENCING: We begin. Judge Kevin Randolph will go through the PSI report first, then hear the victims' impact statements, then hear from the defendant's loved ones before proceeding with his ruling.


Randolph previously said he'd delay ruling on the defense's motion to vacate the conspiracy to commit evidence tampering charges. He says now he'll hear brief arguements again on that before issuing his decision.


At a previous hearing, Schoenhorn argued that there was only one conspiracy here so multiple counts of conspiracy to commit evidence tampering amounts to double jeopardy.

The state argues there were two separate events that took place on different days in different towns.

Randolph rules there can only be a conviction on ONE count of conspiracy to commit evidence tampering. So he vacates the second count of conspiracy to commit evidence tampering.

That means Troconis' maximum sentence if she's sentenced consecutively will now be 45 years, not 50 years. The maximum if the sentences run concurrently is still 20 years.

Now we move on to the pre-sentencing report. There's a mistake on it pertaining to conspiracy to commit murder. This is a class B felony (not A as it said) with a maximum of 20 years.

The defense asks for corrections in the PSI on the facts of the case since they come from the warrants, not the evidence that was presented at trial.

**The main courtoom appears to be completely full as members of the public are now coming into the media room to watch the hearing.**

Randolph says the summary and recommendations of the PSI "mitigate" some of Schoenhorn's concerns. He reads from it: "The extent of her role in the offense is not fully clear." This seems the sugges the Office of Adult Probation recommended a lighter sentence.

Worth noting, the Office of the Adult Probation did NOT attend the trial. Its summary comes from the warrants.

The state begins victim impact statements. Supervisory Assistant State's Attorney Michelle Manning says there are 12 people who will speak during the victim impacts statement portion of the hearing.

Manning says the court will hear from the people who are most devastated by the defendant's cruel actions. Her mother, sister, five children and friends.

Jennifer Dulos' mother, Gloria Farber is first.

Gloria Farber: When Jennifer didn't answer calls, texts and didn't go to a scheduled appointment on May 24, 2019, I knew something terrible had happened. When I learned how she died, my thoughts turned to her, who only wanted to get and give love and be a loving mother.

Farber: My daughter lived in fear of her husband.


Farber says her purpose since then has been to help her five grandchildren cope.

Farber says in November 2019, the family had a ceremony to remember Jennifer Dulos and celebrate her life.

Melissa Farber: On Christmas Day of 2018, my mother and I visited Jennifer and her kids. On that day, Jennifer mentioned Michelle Troconis and Fotis Dulos were engaging in some kind of fraud that she was very concerned about.


Farber: On the morning of May 24, 2019, I awoke with an awful feeling. I sent her a text and never heard back. BY the end of the day, my sister was a missing person.


Farber: I miss Jennifer's intelligence, her soft sweet voice and the sound of her laughter. There are really no words to adequately express what losing my sister Jennifer has meant to me.

Next is Petros Dulos. He was only 13 the day his mother disappeared.


Petros: The defendant's actions to murder my mother have caused irreperable damage. They've left a hole in me that wil never be filled.


Petros says his mother meant everything to me. "I am upset that I will never know the man I would've beome if my mother was here to guide me. She was my hero.”


Petros: I understand that sitting over there is a mother of a child. We once had that. That woman has asked for sympathy under the guise of being a mother. My mom said to leave everything better than you found it. "You did the opposite and should be punished.”

Next is Theodore Dulos. He was also 13 when his mother disappeared.


Theodore: "My mother was the best mom we could ask for." Calls her a shining light who tried to stand tall against the evil trying to take her down." Theodore's voice cracks with emotions as he recalls what his mother will never see.


Theodore: "Michelle, I will speak to you in English because that is the language we've always used.”


Theodore then tells her to put herself in their shoes. "You caused this damage. You've shown no remorse.”


Theodore: You will have many years in a small cell to contemplate what you've done. Do the right thing and admit what happened that day. I will never forgive you for what you've done. "An appropriate sentence would be 50 years, ten for each child who lost their mom.”

Next is Laurel Watts, a friend from Jennifer Dulos' childhood. "Jenny Farber was my friend for 46 years, from when we were 4 to when we were 50. You have to be pretty extraordinay to inspire friendship that evergreen. She was.”


Watts: I am lonely for Jennifer every day. My conversation with her lasted 46 years and ended on May 24, 2019, silenced forever. I have her last voicemail saved.


Watts says Jennifer was truly content five years ago. "The week before Jenny was killed, she killed me. She was feeling hopeful about the light at the end of the divorce tunnel.”

Watts says she's spent every day numb with grief and raging with anger.

Watts: I take solace in Jennifer's children because they are part of her and they are now part of me. But every act of mothering them, is bittersweet. All joy is mediated because every moment that's good and bad, Jennifer desperately wanted. It should be her.

Watts: talks about the fear she and Jennifer Dulos' family had of Fotis Dulos after Jennifer's disappearance for nine months. Says the kids went everywhere with armed guards.

Watts: In my opinion, Michelle Troconis deserves the maximum sentence. "You are cruel.”

Watts: How could you, as a mother, knowing that bond, choose to kill the mother of these children you claim to love? You must have known what the outcome would be, the devastation. Yet you did it anyway.

Watts: You claimed you didn't know Jennifer but you coveted her life and you took it. First her husband, then her house, then tried to get custody.

Watts: You cold-bloodedly planned and carried out the murder. Your honor, I believe all sentences should be served consecutively. There are no mitigating circumstances. She has shown no remorse or compassion. She's had opportunities to help, and she hasn’t.

Watts: Over the past years, Troconis has raised her daughter to young adulthood in Connecticut, Colorado and Florida. Jennifer won't parent her kids past May 24, 2019. Jennifer's sentence is forever.

Next is Christiane, Jennifer daughter who was 10 on the day her mom disappeared.


Christiane: Says she met Michelle Troconis as her dad's friend and didn't think twice of her. Then later learned her father was cheating with Troconis.


Christiane: Michelle's presence in our lives even before May 24 was overwhelming and invasive.


Christiane: Michelle Troconis is the reason I've blacked out my children, the reason I've had to sit on the floor with my little sister and try to comfort her, the reason people look at me with pity, the reason words mom and dad are nothing more than a hazy memory.


Christiane: I read my mom's writings. I'm now coming to understand the full person she was. I'm learning about her without her. I should be doing it with her beside me.

Next is Lauren Almeida, the children's nanny and Jennifer's good friend. She testified at trial.


Almeida: It should be Jennifer sitting at the table helping with homework. It should be Jennifer doing college tours. It should be Jennifer consoling them. And you, Michelle, you have helped take away all of this. You took their mother, and you took my friend.


Almeida: Since May 24, 2019, I've lived in fear for myself and the five children. We had armed body guards escort us everywhere. Since that day, I made a promise not to leave the kids' sides until Jennifer was found. 5 yrs later, "these kids have become my whole world."


Almeida: While the kids are surrounded by love, there sense of security and safety is gone. You, Michelle, show no remorse and no accountability. Michelle Troconis deserves the maximum because of all she did. She altered the course of so many people's lives.


Almeida: We don't even have the comfort of knowing where Jennifer is. Where is she, Michelle?

Next is Constantine Dulos. He was 10 at the time he lost his mother.


Constantine says his father developed a new "poisonous" personality when Troconis was around. She put pressure on my dad to do something.


Constantine: I can't go home to my mom and talk to her about my school day. I can't learn things from her. She was my favorite person in the world, my role model. She is still someplace in my heart. However, I will never be the same person I was in Connecticut.

Next is Caroline Buckley, a long-time friend of Jennifer and a caregiver to the kids, as well.


Buckley: Jennifer was my friend for 12 years. I miss her every day. In 2017, when Jennifer foudn out about Michelle Troconis, such was her fear about Fotis Dulos, that she planned her escape.


Buckley: Jennifer was horrified by Michelle's behavior and apparent attitude that rules didn't apply to her (this is regarding Michelle being around the kids when she wasn't allowed to have contact with them).


Buckley: While I'm grateful for the family we've created, this murder shakes me to the core every day. The brutality of Jennifer's death haunts me, leaving me with wounds that will never heal. Our life will never be the same.


Buckley: Michelle, know that we see you. We saw you then and we see you now. We know what you are. There's no doubt in my mind you deserve to spend the rest of your life in prison.

Next is Noelle, the youngest Dulos child. She was 8 at the time. "I'm growing up without my mother, something no child should ever do." Noelle is crying as she reads. "We will never have closure.”


Noelle: Since that day, I am constantly worried that something will happen to people I love the most. I also feel betrayed my Michelle. I trusted her. Now, I'm scared to trust people.

Carrie Luft speaks next, she's the Farber family's spokeperson. She's the final person to give a statement.


Luft: She begins reading lines from a play that Jennifer wrote in 1996. Luft says she was her friend for almost 30 years. "She was my emergency contact.”

Luft: The pieces of evidence, everything I witnessed at the defendant's trial, swim in my mind every day.


Luft: Since May 24, a group of us have overhauled our lives to support Gloria Farber and create a safe space for her children.


Luft: Jennifer was a deeply private person. The extensive coverage and proliferation of her pictures online would horrify her.


Apologies for the absence--wifi went down.


Luft has been going through all of Michelle Troconis' actions before Jennifer's death to flaunt the rules and her actions during the trial that did so. "She wanted to erase Jennifer Dulos. She beleives the rules don't apply to her.”


Luft: In a play Jennifer wrote more than 30 years, a character says to herself, "I have this dream that keeps me going and there she is in a bassinet. I reach in and pick her. She opens her eyes. They're brown like mine." Like hers.

STAMFORD, Conn. (WTNH) — Michelle Troconis’ attorney is urging a judge to release her on bail while her team fights to overturn her conviction and sentence.

Soon after her sentencing, Troconis’ attorney, Jon Schoenhorn, vowed to planned to appeal the sentence, challenging the decision to not move the trial out of Stamford, allowing what he called “junk science” into the trial and other “irregularities.” He is also attempting to appeal her trial.

Monday, Schoenhorn filed for a petition to review of Troconis’ denial of bond, requesting for oral arguments to be made in the case.

He said there are “substantial preserved appellate issues in this case, including insufficiency of evidence for the most serious crimes of conviction, raising substantial questions of law and fact that may result in reversal, a new trial, or a reduced sentence.”

“As you know my defense was obstructed by the exclusion of crucial evidence and sealing of exculpatory information; this report contains extremely important info that Fotis, Mike Rose (Fotis atty.), Mike Meehan (GAL), Dr. Stephen Humphry (Fotis psychologist) had told me regarding Jennifer’s mental health & I believed them all,” Troconis wrote.

Troconis reiterates that during her interrogations she told investigators that the attorneys and mental health professionals told her Jennifer had disappeared in the past and that Troconis didn’t find it awkward that she had done it again.

According to an arrest warrant application, Troconis knowingly violated court order during her trial by unlawfully possessing the custody study report that she knew was sealed from herself and the public, uploading it to her computer and displaying it in open court in the direct line of sight of media personnel live streaming the proceedings.

A hearing on the contempt case against Troconis is scheduled for Wednesday in Stamford Superior Court.

NBC Connecticut reached out to the attorneys and mental health professionals mentioned by Troconis for a comment on her statements. We either didn’t hear back from them or they declined commenting given the sensitivity of the case.

Troconis says she is already working on her appeal and reviewing records and exhibits.
