Expert testifies in federal trial that the Chicken Pox was ‘not seaworthy’ after Nathan Carman drilled holes in hull before ill-fated fishing trip

"Aug. 15--An expert witness for the insurance companies suing Nathan Carman offered more evidence Wednesday that the Chicken Pox was "not seaworthy" before it sank into the Atlantic and his mother disappeared.

Carman "put four holes in the boat an inch or two from the water line," Bernard J. Feeney, a marine surveyor, testified during the federal civil trial taking place in Providence. "The boat was taking on water the whole time it was on the ocean and he never checked the bilge pump."

Under questioning by Judge John J. McConnell, Feeney said the boat was "seaworthy" when Carman bought it, but "not seaworthy after ... what he did to this boat."...

Nathan Carman is also entangled in a long-running family controversy that began after his grandfather was murdered in 2013. His mother's three sisters allege that Nathan Carman is responsible for the deaths of both his mother and grandfather.

Feeney said water was likely coming in to the boat because Carman removed "trim tabs" from the hull after he bought it. The tabs are a key part of the case because Carman removed them and left holes that insurers say he didn't properly fill. Trim tabs assist in stability and control of the boat.

During cross examination, David Anderson, Carman's lawyer, questioned Feeney about the history of the boat and the wear and tear on it....

Feeney was the second witness on the second day of the federal trial in U. S. District Court in Providence involving Nathan Carman and the insurance companies that have refused to pay his claim for the loss of the Chicken Pox. ...

David Farrell, a lawyer for one of the insurance companies, the Boat Owners Association of the United States, plans to call three witnesses who are expected to cast doubt on Carman's version of how and where the Chicken Pox sank.

The witness list includes a tide expert who will challenge where Carman says his boat sank; a lobsterman who sails out of the same marina as Carman who was fishing in Block Canyon the day the Chicken Pox sank and never saw it or the raft; and a physician who is a hypothermia expert who will testify that there's little chance Carman was adrift at sea in a raft for eight days.

Police in Connecticut still consider Carman a person of interest in the murder of his grandfather, John Chakalos, in December of 2013 in his Windsor home. The investigation is now being led by the cold case squad at the Chief State's Attorney's office...."

"...Day three of the trial continued on Thursday.

Boat U.S. Vice President Michael Pellerin testified that Carman never told the company of the changes that affect the boat's value.

"It's up to our insureds to let us know what material changes they make on vessels," Pellerin said on Thursday.

He added that Carman did notify Boat U.S. of a life raft that upped the value by roughly $20,000, but he never disclosed removing a bulkhead or trim tabs.

Carman's attorney, David Anderson, accused Boat U.S. of being misleading.

He said the company markets itself as a membership association, like AAA for boaters.

Instead, the company is owned by a for-profit insurance company.

Anderson has also claimed Carman never received the policy.

Boat U.S. argues the boat was in good condition when they issued the policy.

Video shown in court shows the boat operating at full speed with no problems after the sale.

However, Anderson maintains the 40-year-old boat was deteriorating despite repairs. He said the boat was destined to sink even before Carman's work.

Carman bought the boat in December of 2015.

Two witnesses on Thursday testified to Carman's maintenance of the boat...."

Marine surveyor explains how Nathan Carman filled the holes left by removal trim tabs - he stuffed pieces of paper towel into the hole and then filled in with an epoxy to seal it up. The holes were just a few inches above the water line.

He answered questions on how difficult it would have been for Carman to make alterations to the boat.

Klopman said based on Carman's deposition, the boat most likely sunk from the stern. However, Carman initially claimed it sank from the bow.

Carman's lawyers argue Klopman gathered his facts inaccurately because pictures he used in his research were taken at angles that could distort proper measurements....

Nathan Carman trial: Lobster boat captain says he saw no sign of Carman’s boat or life raft

"Aug. 17--For 10 hours on Sept. 18, 2016, Alex Aucoin testified Friday, his lobster boat trawled back and forth through Block Canyon off the coast of Long Island and not once did he see the familiar silver captain's perch of Nathan Carman's boat, or any life rafts.

"I knew his boat personally because I thought it was an attractive boat," Aucoin said. "I would have remembered a life raft because I would have gone to assist it."

Aucoin took the stand on the fourth day of Carman's federal civil trial where two insurance companies are fighting his effort to recoup $85,000 for the sinking of the boat....

Aucoin, the fisherman who testified at the trial Friday, said he trawled for lobster throughout Block Canyon from 5 a.m. to about 3 p.m. on Sept. 18, 2016, going back and forth about nine times. At one point Judge John J. McConnell asked Aucoin to draw three- and six-mile circles on a nautical chart showing where he believes he fished that day.

Aucoin told the judge he would have recognized Carman's boat because they sailed out of the same marina and he was sure he didn't see it that day....

The first witness Friday was Jon Klopman, a marine surveyor, who testified that repairs Carman made to his boat were both risky and not needed....

The insurance companies' other expert witness, naval architect Eric Greene, recreated how Carman removed the trim tabs to see how it would work. Greene said on almost every test he did the epoxy sealant either fell out completely or failed to provide a watertight seal.

"It was a woefully inadequate way of filling those holes," Greene said.

Greene also cast doubt on Carman's story that the Chicken Pox sank so fast he barely had a chance to grab emergency gear let alone find his mother....

Greene will return to the witness stand Wednesday when the trial resumes. Carman is also expected to be called as a witness Wednesday...."

"PROVIDENCE -- A boat insurance adjuster at Boat US testified Wednesday that Nathan Carman placed a claim just weeks after his boat sank in September 2016 with his mother possibly on board during a tuna fishing expedition.

Martha Charlesworth, a lawyer assigned to handle Carman’s claim, said she maintained hope at the time that the 31-foot Chicken Pox would be recovered.

“Mr. Carman did say it was not likely to be recovered because it was so far offshore,” Charlesworth recalled. The paperwork noted that no distress call was placed with the U.S. Coast Guard and that she delayed calling the then 22-year-old Carman to give him time to grieve as is 54-year-old mother, Linda Carman, was presumed dead. Carman was found in a life raft a week after he said the boat went down...."

"PROVIDENCE, R.I. (WPRI) — A Vermont man at the center of a civil trial is expected to take the stand Thursday in federal court after time constraints kept him from doing so on Wednesday....

On Wednesday, an insurance employee who handled Carman’s claim took the stand. In the insurance claim, Carman detailed what happened that day.

Carman wrote that his boat began to fill with water and sank suddenly, leaving him in the ocean holding onto a bag of supplies.

He said called out for his mother but couldn’t find her.

“I continued to try and locate my mom, looking for her and calling out and listening for a reply until dark, then I made myself rest,” Carman wrote....

Carman is listed as a witness for both sides. He was expected to testify on Wednesday but the judge decided to postpone it until 9:30 a.m. Thursday.

When Carman takes the stand, his testimony will focus solely on the insurance aspect of the case. The judge has barred any questions and comments regarding his mother’s disappearance.

Carman’s aunts — Linda’s sisters — believe Nathan killed both his mother and his grandfather John Chakalos in hopes of inheriting a portion of Chakalos’ $44 million estate."
