Trial is over whether Carman can collect on $85,000 insurance policy. Insurance company claims Carman performed shoddy work on boat, resulting in the boat sinking.

Mike Savino ‏ @Reporter_Savino 7h7 hours ago
Carman's mother, Linda Carman, was also on the boat, but hasn't been seen since.

Mike Savino ‏ @Reporter_Savino 7h7 hours ago
First 2 days focused on the quality of the boat at the time Carman purchased it in 2015. Brian Woods, who rebuilt the boat (Chicken Pox), testified that he restored the boat to safe and working condition

Mike Savino ‏ @Reporter_Savino 7h7 hours ago
Surveyor Bernard Feeney, who inspected the boat after sale, said it was servicebale (or seaworthy) at time of sale. Plaintiffs claim Carman's work compromised boat and caused it so sink. That would cancel insurance policy

Mike Savino ‏ @Reporter_Savino 7h7 hours ago
Carman's lawyer, David Anderson, says boat was in poor shape when he bought it, despite findings in spection.

Mike Savino ‏ @Reporter_Savino 7h7 hours ago
Boat US claims Carman voided the policy because he never informed them of certain work (removing trim tabs and bulkead) that would have lowered value. Plaintiffs claim that same work also caused boat to sink

Mike Savino ‏ @Reporter_Savino 7h7 hours ago
Anderson said in opening arguments that Boat US not forthcoming with Carman, never produced firm terms of policy. Says that violated maritime lay requirement for duty to operate in good faith.

Dave Altimari‏ @davealtimari 6h6 hours ago
BoatUS executive on stand in day 3 of Nathan Carman trial to lay out his insurance for the Chicken Pox. Carman originally had $66k insurance but less than a month later sought increase to $85k because he bought new life raft and other equipment.

Dave Altimari‏ @davealtimari 6h6 hours ago
That insurance increase was approved. Two months after the boat sank With his mother on board Carman sent email to insurance company asking for policy handbook as well as possible payment methods for his boat loss claim.

Dave Altimari‏ @davealtimari 5h5 hours ago
Weird moment in Carman trial as boat insurance exec testifies a pretty big piece of plaster fell from the ceiling right onto Judge John McConnell’s desk barely missing him drawing gasps from crowd. The judge brushed it aside and remarked that court is due for some renovations.

Mike Savino ‏ @Reporter_Savino 5h5 hours ago
Pellerin said Carman did tell Boat U.S. when he added a life raft, increasing the value. Plaintiffs says he did not do the same when changes lowered the value.

Mike Savino ‏ @Reporter_Savino 5h5 hours ago
In cross examination, Anderson now saying Boat US misrepresented itself. He says company markets itself as membership association, but is actually corporation owned by Berkshire Hathaway.

Mike Savino ‏ @Reporter_Savino 5h5 hours ago
Anderson trying to hammer Pellerin with questions about whether Boat US discloses its ownership to customers. Judge halts line of questioning as irrelevant

Mike Savino ‏ @Reporter_Savino 2h2 hours ago
Plaintiffs now questioning Bud Smedberg, who did engine repairs, other work for Carman

Mike Savino ‏ @Reporter_Savino 2h2 hours ago
Smedberg says Carman brought boat into shop in April 2016 after engine overheated. Says he replaced the engine at that time.

Mike Savino ‏ @Reporter_Savino 2h2 hours ago
Smedberg also says he had to replace blown fuse on bilge pump at least 3 times. Told Carman about problem. Carman said he'd fix. Bilge pump removes water from the boat.

Mike Savino ‏ @Reporter_Savino 1h1 hour ago
Plaintiffs now call Michael Iozzi, who saw Nathan Carman working on his boat in September 2016

Mike Savino ‏ @Reporter_Savino 1h1 hour ago
Saw Nathan drilling holes in the transom (part of the rear of the boat).

Mike Savino ‏ @Reporter_Savino 1h1 hour ago
Iozzi: says Carman stated he was working on trim tabs with drill. "I just didn't understand how he was doing that kn the water. That would be something that would be done out of the water."

Mike Savino ‏ @Reporter_Savino 1h1 hour ago
Iozzi says he also say Carman patch the holes with putty. Plaintiffs have presented scenario where holes could leak, flooding boat. Carman also removed bulkhead, which could have minimized impact of flooding.

Mike Savino ‏ @Reporter_Savino 35m35 minutes ago
Anderson challenging Iozzi's account, saying he didn't actually see Carman drilling into boat. Only assumed that based on seeing Carman with the drill and hear Carman use tools.

Mike Savino ‏ @Reporter_Savino 35m35 minutes ago
Even still, Iozzi maintains he saw Carman drill two holes

This is a story I did a month after Carman was rescued, some of these people will be testifying today. It raised many of questions attorneys are trying to get In at the trial.

Drinking Water Key To Carman's Survival On Raft, Experts Say

evOWVk3N

Expert testifies in federal trial that the Chicken Pox was ‘not seaworthy’ after Nathan Carman drilled holes in hull before ill-fated fishing trip

"Aug. 15--An expert witness for the insurance companies suing Nathan Carman offered more evidence Wednesday that the Chicken Pox was "not seaworthy" before it sank into the Atlantic and his mother disappeared.

Carman "put four holes in the boat an inch or two from the water line," Bernard J. Feeney, a marine surveyor, testified during the federal civil trial taking place in Providence. "The boat was taking on water the whole time it was on the ocean and he never checked the bilge pump."

Under questioning by Judge John J. McConnell, Feeney said the boat was "seaworthy" when Carman bought it, but "not seaworthy after ... what he did to this boat."...

Nathan Carman is also entangled in a long-running family controversy that began after his grandfather was murdered in 2013. His mother's three sisters allege that Nathan Carman is responsible for the deaths of both his mother and grandfather.

Feeney said water was likely coming in to the boat because Carman removed "trim tabs" from the hull after he bought it. The tabs are a key part of the case because Carman removed them and left holes that insurers say he didn't properly fill. Trim tabs assist in stability and control of the boat.

During cross examination, David Anderson, Carman's lawyer, questioned Feeney about the history of the boat and the wear and tear on it....

Feeney was the second witness on the second day of the federal trial in U. S. District Court in Providence involving Nathan Carman and the insurance companies that have refused to pay his claim for the loss of the Chicken Pox. ...

David Farrell, a lawyer for one of the insurance companies, the Boat Owners Association of the United States, plans to call three witnesses who are expected to cast doubt on Carman's version of how and where the Chicken Pox sank.

The witness list includes a tide expert who will challenge where Carman says his boat sank; a lobsterman who sails out of the same marina as Carman who was fishing in Block Canyon the day the Chicken Pox sank and never saw it or the raft; and a physician who is a hypothermia expert who will testify that there's little chance Carman was adrift at sea in a raft for eight days.

Police in Connecticut still consider Carman a person of interest in the murder of his grandfather, John Chakalos, in December of 2013 in his Windsor home. The investigation is now being led by the cold case squad at the Chief State's Attorney's office...."

Civil trial over mystery at sea insurance payout continues (with clip)

August 15, 2019

"...Day three of the trial continued on Thursday.

Boat U.S. Vice President Michael Pellerin testified that Carman never told the company of the changes that affect the boat's value.

"It's up to our insureds to let us know what material changes they make on vessels," Pellerin said on Thursday.

He added that Carman did notify Boat U.S. of a life raft that upped the value by roughly $20,000, but he never disclosed removing a bulkhead or trim tabs.

Carman's attorney, David Anderson, accused Boat U.S. of being misleading.

He said the company markets itself as a membership association, like AAA for boaters.

Instead, the company is owned by a for-profit insurance company.

Anderson has also claimed Carman never received the policy.

Boat U.S. argues the boat was in good condition when they issued the policy.

Video shown in court shows the boat operating at full speed with no problems after the sale.

However, Anderson maintains the 40-year-old boat was deteriorating despite repairs. He said the boat was destined to sink even before Carman's work.

Carman bought the boat in December of 2015.

Two witnesses on Thursday testified to Carman's maintenance of the boat...."

Nathan Carman & his Attorney arriving for day 4 of the civil trial. Carman is being sued by the insurance company over the $85k insurance claim for his boat “Chicken Pox” which sunk in September 2016 as he & his mother were fishing at sea. She is presumed dead #wcvb

Dave Altimari‏ @davealtimari 4h4 hours ago
Judge starts day 4 of Nathan Carman with update on amount of time each attorney has used up so far. Insurance attorney’s 370 minutes and Carman’s attorney has used 385 minutes. He has limited them to 15 hours or 900 minutes each.

Dave Altimari‏ @davealtimari 3h3 hours ago
It appears that we are going to have a marine surveyor take apart a trim tab the way Nathan Carman did on the Chicken Pox right here in federal court.

Dave Altimari‏ @davealtimari 2h2 hours ago
Marine surveyor explains how Nathan Carman filled the holes left by removal trim tabs - he stuffed pieces of paper towel into the hole and then filled in with an epoxy to seal it up. The holes were just a few inches above the water line.

Dave Altimari‏ @davealtimari 2h2 hours ago
Jon Klopmann the surveyor testified that making repair that way “makes no sense.” He said if he saw someone making that repair he’d tell them to take the boat out of water and get it repaired correctly.

Dave Altimari‏ @davealtimari 2h2 hours ago
Lobsterman Alex Aucoin is allowed to testify about fishing in Block Canyon on Sept. 16, 2016 says he trawled for lobster for several hours and never saw any boats or life rafts. Nathan Carman told Coast Guard that’s where he was fishing when his boat sank.

Dave Altimari‏ @davealtimari 2h2 hours ago
Aucoin says he was familiar with the Chicken Pox because he also sailed out of Ram Point Marina and had seen the boat. “I knew his (Carman) boat personally thought it was an attractive boat.”

Dave Altimari‏ @davealtimari 2h2 hours ago
Aucoin said visibility was good that day and that he can see five or six miles from his captains perch and never saw another boat that day.

Dave Altimari‏ @davealtimari 2h2 hours ago
Aucoin is now drawing on a chart the area he was fishing with the judge standing right next to him and about five attorneys huddled together watching him mark his fishing path with a highlighter.

Dave Altimari‏ @davealtimari 2h2 hours ago
Judge is now asking Aucoin to draw two circles on the map one for three mile radius where he said he would have definitely been able to identify Carman’s boat and one for six mile radius where he would have been able to identify any boat.

DAY FOUR WRAPS OF NATHAN CARMAN CIVIL TRIAL OVER 'SUSPICIOUS' BOAT SINKING (with clip)

August 16th 2019

"...Friday was day four of the trial in the civil case. Jonathan Klopman, an expert marine surveyor was brought in to testify.

He answered questions on how difficult it would have been for Carman to make alterations to the boat.

Klopman said based on Carman's deposition, the boat most likely sunk from the stern. However, Carman initially claimed it sank from the bow.

Carman's lawyers argue Klopman gathered his facts inaccurately because pictures he used in his research were taken at angles that could distort proper measurements....

Testimony will continue next week."

Nathan Carman trial: Lobster boat captain says he saw no sign of Carman’s boat or life raft

"Aug. 17--For 10 hours on Sept. 18, 2016, Alex Aucoin testified Friday, his lobster boat trawled back and forth through Block Canyon off the coast of Long Island and not once did he see the familiar silver captain's perch of Nathan Carman's boat, or any life rafts.

"I knew his boat personally because I thought it was an attractive boat," Aucoin said. "I would have remembered a life raft because I would have gone to assist it."

Aucoin took the stand on the fourth day of Carman's federal civil trial where two insurance companies are fighting his effort to recoup $85,000 for the sinking of the boat....

Aucoin, the fisherman who testified at the trial Friday, said he trawled for lobster throughout Block Canyon from 5 a.m. to about 3 p.m. on Sept. 18, 2016, going back and forth about nine times. At one point Judge John J. McConnell asked Aucoin to draw three- and six-mile circles on a nautical chart showing where he believes he fished that day.

Aucoin told the judge he would have recognized Carman's boat because they sailed out of the same marina and he was sure he didn't see it that day....

The first witness Friday was Jon Klopman, a marine surveyor, who testified that repairs Carman made to his boat were both risky and not needed....

The insurance companies' other expert witness, naval architect Eric Greene, recreated how Carman removed the trim tabs to see how it would work. Greene said on almost every test he did the epoxy sealant either fell out completely or failed to provide a watertight seal.

"It was a woefully inadequate way of filling those holes," Greene said.

Greene also cast doubt on Carman's story that the Chicken Pox sank so fast he barely had a chance to grab emergency gear let alone find his mother....

Greene will return to the witness stand Wednesday when the trial resumes. Carman is also expected to be called as a witness Wednesday...."

Carmen was rescued 100 miles off Massachussets shore, but he’s said he was at sea for 7 days. His mother, Linda Carman, was also on that boat but hasn’t been seen since

Mike Savino ‏ @Reporter_Savino 20h20 hours ago
Insurance company Boat US claims Carman's alterations to the boat caused it to sink. They also claim he never told the company about the changes, which made the unseaworthy, voiding his policy.

Mike Savino ‏ @Reporter_Savino 20h20 hours ago
Carman's attorney has maintained that the boat was deteriorating long before Carman bought it, and that it sank simply because it was in poor shape.

Mike Savino ‏ @Reporter_Savino 20h20 hours ago
There was a break in the trial Monday and Tuesday, so today is Day 5 (typo in the first tweet).

Mike Savino ‏ @Reporter_Savino 20h20 hours ago

Mike Savino ‏ @Reporter_Savino 20h20 hours ago
Before we resume testimony of Naval Architect Eric Greene, judge takes up motion by Carman's lawyer, David Anderson, to limit what Greene can say in testimony as expert witness

Mike Savino ‏ @Reporter_Savino 19h19 hours ago
Defense wants to limit Greene from saying specifically that Carman's changes caused the boat to sink. Plaintiffs say that Greene's testimony only that Carman's work would make the boat unseaworthy, thus more likely to sink.

Mike Savino ‏ @Reporter_Savino 19h19 hours ago
Carman drilled holes in the boat to remove trim tabs and filled them with epoxy. Greene says those likely would have failed in salt water. He also says that fuel tanks Carman added would have lowered boat, meaning those holes would have been at or near water level.

Mike Savino ‏ @Reporter_Savino 19h19 hours ago
Plaintiffs only had 1 question for Greene today. Anderson now cross examining.

Mike Savino ‏ @Reporter_Savino 19h19 hours ago
Anderson questioning Greene on his knowledge of the boat, timeline of changes.

Mike Savino ‏ @Reporter_Savino 19h19 hours ago
Greene relied on evidence, statements, testimony, depositions of witnesses, including the man who rebuilt the boat and sold it to Carman. Greene never saw the boat before it sank.

Mike Savino ‏ @Reporter_Savino 19h19 hours ago
Anderson questioning Greene'd ability to form opinion without seeing boat, doing own calculations.

Mike Savino ‏ @Reporter_Savino 19h19 hours ago
Anderson says if tanks are further forward in the boat, weight would push the rear (where Carman drilled and patched the holes in question) higher relative to water surface.

Mike Savino ‏ @Reporter_Savino 19h19 hours ago
Anderson arguing Greene doesn't have the information he needs to make his opinion. Greene says one would place fuel tanks closer to the rear, not front.

Mike Savino ‏ @Reporter_Savino 19h19 hours ago
Anderson lowing out more scenarios where differences to the boat could have altered Greene's opinion.

Mike Savino ‏ @Reporter_Savino 18h18 hours ago
*laying out

Mike Savino ‏ @Reporter_Savino 18h18 hours ago
Greene acknowledges, per judge's question, that he didn't know how much fuel Carman had on his boat

Lawyers reiterate that they then plan to call Carman to the stand. Remaining 3 witnesses for plaintiffs could be called as rebuttals after defendants call their witnesses

Mike Savino ‏ @Reporter_Savino 18h18 hours ago
Charlesworth said Boat US opened claim when saw news report, as typical. This was done before Carman contacted to file claim

Amanda Pitts‏ @APittsABC6 18h18 hours ago
Charlesworth, when assigned to the claim, said she didn’t know much about the case, only what she heard in news reports. She issued a verbal reservation of rights, wanted to make it clear there was a potential issue with the claim. @ABC6

Insurer: Carman filed claim weeks after boat went down with his mother believed aboard

Aug 21, 2019

"PROVIDENCE -- A boat insurance adjuster at Boat US testified Wednesday that Nathan Carman placed a claim just weeks after his boat sank in September 2016 with his mother possibly on board during a tuna fishing expedition.

Martha Charlesworth, a lawyer assigned to handle Carman’s claim, said she maintained hope at the time that the 31-foot Chicken Pox would be recovered.

“Mr. Carman did say it was not likely to be recovered because it was so far offshore,” Charlesworth recalled. The paperwork noted that no distress call was placed with the U.S. Coast Guard and that she delayed calling the then 22-year-old Carman to give him time to grieve as is 54-year-old mother, Linda Carman, was presumed dead. Carman was found in a life raft a week after he said the boat went down...."

Time constraints postpone Nathan Carman’s testimony in insurance trial (with clip)

Aug 21, 2019

"PROVIDENCE, R.I. (WPRI) — A Vermont man at the center of a civil trial is expected to take the stand Thursday in federal court after time constraints kept him from doing so on Wednesday....

On Wednesday, an insurance employee who handled Carman’s claim took the stand. In the insurance claim, Carman detailed what happened that day.

Carman wrote that his boat began to fill with water and sank suddenly, leaving him in the ocean holding onto a bag of supplies.

Here’s the description of the sinking that Carman gave to the insurance company as part of his claim. Says “the boat sank suddenly” and “I did not see my mom after the boat sank” @wpri12 pic.twitter.com/Qbrvn6krms

— Julianne Lima (@JulianneLimaTV) August 21, 2019
He said called out for his mother but couldn’t find her.

“I continued to try and locate my mom, looking for her and calling out and listening for a reply until dark, then I made myself rest,” Carman wrote....

Carman is listed as a witness for both sides. He was expected to testify on Wednesday but the judge decided to postpone it until 9:30 a.m. Thursday.

When Carman takes the stand, his testimony will focus solely on the insurance aspect of the case. The judge has barred any questions and comments regarding his mother’s disappearance.

Carman’s aunts — Linda’s sisters — believe Nathan killed both his mother and his grandfather John Chakalos in hopes of inheriting a portion of Chakalos’ $44 million estate."
