Strickland reveals that he had never heard of defense attorney Jose Baez. Eaton says his impression was and still remains that Baez was “an inexperienced lawyer who was in over his head.”

Strickland complains that people do not understand reasonable doubt and that there needs to be better jury instruction about it. To explain the verdict, Strickland quotes a juror who said, “If I don’t know how she died, how can I convict her of anything?”

It was pretty clear from two Ashton interviews over the weekend that he’s ready to move beyond the Anthony case. Ashton will be sworn in as Orange-Osceola state attorney at 12:01 a.m. Tuesday.

When asked where Anthony is, Ashton said he has a standard response. “I don’t know and I don’t care,”

Tuesday's arguments will be heard by a three-judge panel of the Fifth District Court of Appeal in Daytona Beach. The hearing, set for 1:30 p.m., will be short: The court only allows each side 15 minutes to argue. The panel is not expected to make a ruling Tuesday.

Anthony is represented in the appeal by attorneys Cheney Mason and Lisabeth Fryer.

Was Casey Anthony under arrest when she lied to police?

"You can't be un-arrested," Fryer said. Even after Anthony was freed from handcuffs and allowed to go back inside her home, the presence of law enforcement created a "coercive environment," Fryer argued.

The judges seemed skeptical of aspects of that argument, noting that Anthony was handcuffed because her mother had alleged she had committed a theft — not in connection with Caylee's disappearance.

Trial in the civil suit has been delayed indefinitely while her criminal appeal is resolved. Anthony, who remains in hiding, has been subpoenaed to appear at trial in that lawsuit.

Anthony was acquitted in the death of her daughter Caylee, but was charged with lying to law enforcement in the search for the two-year-old. The outcome of the appeal could affect Anthony’s defamation suit from Zenaida Gonzalez, who is being represented by Morgan & Morgan. Gonzalez is suing Anthony, claiming that she incurred damages when Anthony claimed that a fictional nanny bearing the same name had taken her daughter. "

"The pending criminal charge permits Anthony to exercise her 5th amendment right–protection against forced self-incrimination-in her criminal case. If the appeal is granted, and the state does not appeal to the Supreme Court, Anthony could be forced to answer questions regarding her daughter’s disappearance in the civil trial."
