The unfounded theory had far-reaching consequences, from the January 2021 riot at the US Capitol to ongoing threats against state election officials.

Apart from Fox’s fortunes, the trial could help set the record straight on the 2020 vote and affect “elections and election administration going into 2024”, said Lawrence Norden, director of the election reform program at the Brennan Centre for Justice of New York University’s law school.

“There are a lot of people who don’t necessarily pay close attention to these issues, who may have heard things about voting machines and fraud, and they don’t really know what to believe,” Norden said. If Fox is found liable, it is “likely to break through to those people”, he said.

Fox News has formally apologized to the judge overseeing Dominion's $1.6 billion defamation lawsuit after a late-stage admission revealing Rupert Murdoch's role as an officer at Fox News was addressed in court this week.

In a letter submitted to the court on Friday, Fox attorney Blake Rohrbacher described the situation as a "misunderstanding" and said they "understand the Court's concerns, apologize, and are committed to clear and full communication with the Court moving forward."

Judge Davis said he would "most likely" appoint a special master to investigate whether representations by Fox made to the court as part of the case were "untrue or negligent." He also ordered Fox attorneys to preserve all communications related to the issue.

"I'm very uncomfortable right now," Davis said. "I'm going to let you know -- I'm very uncomfortable."

“The trial on the high profile Dominion voting systems lawsuit against Fox begins tomorrow in Delaware and let’s face it, much of the mainstream media is rather openly rooting for Fox to lose,” Kurtz said.

“I can assure you that I will provide fair and down the middle coverage of this $1.6 billion suit about coverage of false election fraud claims in 2020, despite the fact that I work here and with that, it’s been a very rough week for Fox,” he said.

Considering all the lies Fox has propagated, as well as making an apology to the judge for their "omission" of information, I seriously doubt that coverage by Fox of the Fox lawsuit will be "fair and down the middle".

Call me skeptical. As in, I don't believe Kurtz (or Fox) at all.

And even if, in a very unlikely situation, that Kurtz provides truthful, unbiased reporting on the case, we would have no way to know. They have simply told too many lies and they have always been biased. (Hence they are in court.)
 
Yeah, it's probably not good form to be seen as hiding the truth even before the trial starts.

Kurtz said on his show in February that Fox was not letting him cover the lawsuit “at least for now,” but has since commented on the ongoing legal battle, saying in March that the lawsuit was a “major test of the First Amendment.”

“Some of you have been asking why I’m not covering the Dominion voting machines case against Fox involving the unproven claims of election fraud in 2020,” Kurtz said in February. “It’s absolutely a fair question. I believe I should be covering it, it’s a major media story, given my role here at Fox.”
