Louis Chavez, mexican born - came to us 1981 - citizen in 1996 - works at Tornado bus company as Assistant Mgr in San Antonio - his wife is his manager. He worked there 18 yrs. His grandson works there too - started 4 yrs ago - David Lopez he was 18 yrs @ time. On 12/27/09, EJ came in and purchased bus ticket - Louis was not there @ that moment - David sold her the ticket. Another co-worker Gondino Gonzales - refuses to sell anglo people tickets - doesn't speak English and doesn't know how to answer questions so asked David to sell the ticket. Tornado bus company founded in 1980's by Louis' wife family with one van . . . sold tickets to (?) mexico. They had 14 vans, then regulations changed so they purchased used buses . . .they are located 1719 Hwy 35. Mostly Hispanic people serviced . . . Gonzales refused to sell to Anglo (white) people. They do care what color people are. At some point FBI or LE came to Tornado Bus Co., came over next day - Spec. Agent Flores came with Hector (Morales) not sure of last name. They showed colored pamphlet - saw photo of female he recognized her immediately. Easy to remember someone who not Hispanic - an Anglo - they remember. Louis saw her when he came to the office . . . special agents asked him to look up ticket and roster. They keep a record for everyday for 5 years . . . they always keep these records as part of their business. Exhibit #132 - copy of ticket sold to Elizabeth Jones (Jones is name she gave). The record they keep for the passengers in handwriting. . . ticket sold to Elizabeth Jones. Exhibits #132 & 133 admitted - permit to publish. Showing ticket #266022 to jury . . . first line name . . .computer printing . . . nombre means name of passenger . . . Elizabeth Jones - destination- San Antonio to Ft Lauderdale FL, date - ticket # . date ticket was sold. 12/27/09, another word is supposed to be who sold ticket but it just shows date. Corrida means route number (like on planes they are called flight) route #938. 12:00 noon - connection @ 187B - another route that starts in Houston, Tx, @ 7:00 pm. Next line - price $180.00. . . . seat #21, San Antonio bus - connection bus 187B Houston connection she had same seat. List of passengers on list . . . ticket # and name - destination and price. #266022 ticket is Elizabeth Jones to Ft. Lauderdale, FL for $180. The bus was delayed 1 hr that day . . . bus actually left around 1:00 THAT DATE. He identified EJ in pink blouse. No further questions. . . .Defense Atty asks - what times did he arrive @ Tornado Bus Station around 11:00 . . . he doesn't have a regular time to get to work . . he is Asst. Mgr and his wife is Mgr - they get there when they can as they have other things to do. Later on they asked people who sold ticket said EJ arrived around 10:00 - David (his Grandson) who speaks English. She arrived @ Tornado bus station around 10:00 on 12/27. Defense Atty reiterates time and date, and bus leaving 1 hr late . . . .something he noticed "the beauty" - she was attractive, and he noticed she was so calm. . . she was sitting alone, no baby . . . if there had been baby Louis would have noticed her. She was sitting on couch by herself . . .not reading . . . she was just calm and speaking with no one. Louis saw her board the bus around 1:00 (he was watching thru windows from inside) . . . observed her from 11:00 - 1:00 when she left. She never left the bus station at any time during those two hours - never had a baby with her - never got on the bus with a baby.
Re-direct - Did the passengers know the bus would be late? We always tell them if bus going to be late as best as we can. . . we didn't have GPS @ the time like we do now?
A question coming from the Jury . . .counsel approaches
Judge asks question . . . how was the ticket paid for cash, check, credit card, or some other way? He said cash - they didn't accept any other payment.
Witness excused. . . .
