the globe article states that it was a psychologist that changed her treatment plan, after 3 days, and when she was on the neurology floor. its possible that this happened after forming a team, consulting other departments, and a review of her medical records.

i suppose it is also possible that this was done on the advice of an ER doctor that formed his opinion within hours of her arrival...

in my opinion, it is highly unlikely that a hospital that has a program for mitochondrial disease and talks about it openly in public record as something that exists and that they do research on and treat patients for, it is highly unlikely that doctors in this hospital tell some patients that this disease does not exist.

but as someone else pointed out it is a big hospital. who knows - there may be some ER doctor telling patients and their families that cancer does not exist and sending them off to Bader 5 for psychiatric treatment. i cant prove this does not happen.

The parents say that a doctor at the hospital said he/she didn't believe that mito exists. I can see an individual making a statement like that but not representing other doctors at the hospital. Maybe just his/her opinion. I can see parents so concerned for their daughter's life and health misconstruing it. None of that explains why a teen is denied medical treatment (alledgedly taken off meds to treat medical condition and given psychotropic drugs instead), education, and religious support.

can you cite me one of the larger insurance companies who have this as their policy? i just looked at 4 of the biggest and this is not the case for any of them.

im specifically referring to you saying that "out of network" usually means that the insurance company will not cover any of the expense.[/QUOTI

I said "or very little of it". Is that not correct? Did you find that out of network means the insurance does cover it? With the cost of medical care these days, people can barely afford their usually copay. I am sure that the hospital would rather have a child there whose total costs are covered.

PPOs will usually cover out of network at 70% of the usual & customary amount.

HMOs usually do not cover out of network, but many companies will agree to cover at least at a reduced rate in special circumstances.

Admin staff will usually help with the insurance process prior to and during intake, especially at larger and specialty hospitals.

Also, as far as state custody and full coverage, yes Justina would have coverage, however, the reimbursement rate that is paid to practitioners for Masshealth (state Medicaid) patients is far lower than rates paid by insurance companies or out of pocket by patients. In fact, many providers sadly don't take Masshealth patients at all due to this. So I'm not really sure that the hospital would stand much to gain if all this is some sort of conspiracy to get money.

As with everything else in this case, without having all the info (this time regarding what kind of insurance Justina has) we can't know the situation for sure.

Update, seems like good news for the family. Maybe the public pressure is working.

Mass. agency says it is actively working to return Justina Pelletier to Connecticut
By Patricia Wen / Globe Staff

Massachusetts child protection officials are actively working to return 15-year-old Justina Pelletier, the teenager involved in a year-long custody fight that’s drawn national attention, to her home state of Connecticut, a spokesman for the state Department of Children and Families said Friday in the agency’s first public comment on the case.

The spokesman also told the Globe that Tufts Medical Center, the parents’ first-choice hospital to care for the girl, will be overseeing her medical care.

“Our primary goal has always been the health and well-being of Justina. We want the parents to be able to work with the providers and courts to ultimately move Justina back to her home state of Connecticut. That is the objective, and is consistent with our previous efforts to find an appropriate placement near her home,” said agency spokesman Alec Loftus.

Another interesting post on the Red Mass Group blog that's been covering this story. The reporter mentioned, Beau Berman is with WTIC FOX CT.

Report says DPH to investigate Children's Hospital
by: Rob "EaBo Clipper" Eno
Fri Feb 28, 2014 at 08:00:58 AM EST

A report from earlier in February says that the Department of Public Health, of which Jim Lyons is on the Committee for, has agreed to investigate Children's Hospital in the Justina Pelletier case. The report also lays out the whole case in pretty comprehensive detail.

The Massachusetts Department of Public Health is set to investigate a complaint filed by a Boston Attorney against Boston Children's Hospital and its "Bader 5″ Psychiatric Unit.
According to a January 31 posting by reporter Beau Berman - who broke the story leading to the complaint - the Department of Public Health has confirmed that it is assigning an investigator to review the complaint

For the benefit of those unfamiliar with the case, in February 2013, 15-year-old Justina Pelletier was checked into Boston Children's Hospital with flu-like symptoms by her parents. Prior to her admission, Justina had been undergoing treatments for Mitochondrial Disorder at Tufts Medical Center in Boston.

So the gag order's lifted?

Also the official quote from MA DCF, on Beau Berman's FB page.
MASS. DCF STATEMENT ON JUSTINA PELLETIER:

“Our primary goal has always been the health and well-being of Justina. We want the parents to be able to work with the providers and courts to ultimately move Justina back to her home state of Connecticut. That is the objective, and is consistent with our previous efforts to find an appropriate placement near her home. A medical team has been identified at Tufts, the family’s provider of choice, with the clinical expertise to care for Justina."

And support builds for MA Rep Lyons' resolution to return Justina

Thank God, so many people have gotten involved. I haven't been this incensed since KC Anthony and her lying parents!
If the government and hospitals can take away a child because of medical mismanagement or even if they view it as "doctor shopping" we are in trouble, as this will only get worse. Unlike criminal court cases, the veil of secrecy-privacy-prevents anyone from seeing what is being done. Violent criminals have more rights than this young girl and her family.
Regardless of her physical or psychological state, being with her family and being loved is far more important. Again, murderers like Arias gets more visitation with her family than this girl does!
I'm so thankful I got second and third opinions with my son and his so called ADD. I stopped giving him Concerta since he was getting headaches and leg cramps so severe, he couldn't walk- not to mention the depression and headaches when it wore off. He ended up just having anxiety and we addressed that. Some states could have taken him away from me.

Now bad news. ;(

Disgraceful! DCF just canceled the regularly scheduled weekly meeting between the Pelletiers and Justina! #freejustina

Just heard from the Pelletier family. DCF Is not allowing them to see Justina for the regularly scheduled appearance! Pray! #FreeJustina

If MA DCF is moving towards reunification- why stop the scheduled meeting?

"If officials seek a new residential treatment program for Justina in Connecticut, that may not be easy either.

Late last summer, another facility in Connecticut, Webster House in New Britain, Conn., which considered accepting Pelletier after discussions with the Department of Children and Families, backed out after her father threatened to sue if the facility took his daughter. Later, Pelletier’s parents softened their view of the Webster House after visiting the place, but in early September, the facility’s administrator e-mailed the father: “We have determined, unfortunately, that we are unable to take on the risk of becoming involved in a protracted legal battle that could be very costly.”"

I found the entire snippet from today's Globe article posted above to be of great interest. It seems the family has not been entirely forthcoming in telling their story to the 'media'. I think these people have burned some bridges. But, who knows?

Right wing or left wing. I say kudos to anyone who helps get this poor kid home to her parents. I can't imagine the trauma a 15 year old girl would go through being in a locked psychiatric ward for a year, away from her parents and sisters.

Comments on the story about the cancelled visit on Beau Berman's FB page claim the visit was cancelled because of the media. Not exactly sure how DCF plan on proceeding. With the gag order lifted, it's not like the media's going anywhere. Unless their plans for reunification are just PR spin, DCF should be moving towards more visits- not blocking the family from seeing her at all.

Perhaps they just want to dump this on CT DCF and distance themselves from the bad publicity. This cases is bringing up a lot of other bad press for MA DCF, like all the hundreds of kids missing in the MA child welfare system and one third of their social workers are unlicensed. Gotta think that MA DCF would like to get as far away from this bad publicity as possible.

Press releases from Rev Mahoney on behalf of the family.

Boston, MA – 2/28/14 –
The Pelletiers’ regularly scheduled visitation with Justina was denied today by the Department of Children and Families (DCF).

DCF informed the Pelletiers that contact with their daughter had been cut off because members of the press had independently appeared at the visitation site. Neither the Pelletiers, nor the Free Justina coalition invited the media, yet the Pelletiers were prevented from seeing their daughter.

In the past, parental visits to Justina are heavily supervised, with several DCF officials and state troopers present.

In response, family spokespersons from the Free Justina coalition have announced a press conference at DCF offices where the family was supposed to have met with Justina.

The press conference will be held at 30 Dimock Street Roxbury, MA at 4:00pm today.

I can't. Believe a family would have to have monitored visitation when their daughter is so sick. And add to the state troopers?
Nancy Grace had a little girl on last night who was given back to an abusive family and was killed. Yet they won't give this loving family their daughter back. Oh, and they get less than half an hour a week. Wow:(
I would do anything to get my kids back....I mean anything. Even rapists escape and cut off thier ankle monitor , but this poor family can't break thier daughter out of what is solitary confinement where she gets no education or activities . What prisoner would put up with that. The lawyers would be lining up if a criminal was denied their rights like that.

What you're saying isn't true at all though. Children in the unit are given educational as well as therapeutic opportunities.

Not to mention that the facility she was supposed to head to next (before outside groups began agitating and threatening) is also an educational facility. But that opportunity went down the drain.

I wonder how many of the critics of these parents are parents themselves. Most of us can't see ourselves in their position, because things like that don't happen in America we tell ourselves. But if any of the critics were to take their child to the hospital because that child was very ill and they were terribly worried, but the doctors told them that it was all in the child's head and even if other specialists had told them it might be a rare disorder and their treatment was helping the child, they, the parents are at fault for taking the child to said doctors and allowing the child to get the prescribed treatment. The "child protection team" which conducted no tests to diagnose a medical problem or disprove the initial medical diagnosis, declared their authority of said child, and filed for physical custody of the child, the critics might find themselves reacting much like the Pellitiers. The Pellitiers waited many months to take their traumatic situation to the public. They have had no choice because they are truly worried their daughter could die because of the lack of medical care and the psychotropic drugs administered to their child which have notable side effects. Even if the "child protection team" were right about the parents, why keep the child in a locked environment, away from loved ones, friends and the community. Even foster kids have somewhat of a life. She has been treated worse than a convicted criminal.

Well, I actually heard it from her father in an interview. I hope your are right:)
Thought that sounded odd, and illegal .
Thanks

That's what concerned me too:(

I think many people reading this story are saying to themselves, "this CAN'T be happening as reported. There MUST be more to this story, and we just don't have any idea what that "more" is".

I am so glad the media is shining the spotlight on this story and bringing it to the light. If there is more to the story, say it.

They cannot say it by law. It would be a violation of Justina's rights under HIPAA.
