Yeah I know having them is illegal. I won't speculate what he knows and I will not assume he took them until LE says so. Of course they can determine the difference but WE don't have that information. Sleuthing should be based on critical thinking...meaning only facts are used to come to a conclusion. Not assuming it is his hand, or he took the pic....true facts known personally or shared by LE. So far we have zilch. I am making a guess as to where the photos came from. I am not providing inaccurate information like it was him who took them or it was his hand like others are assuming.

We have a man in possession of child *advertiser censored*. To say we have zilch is shocking.

I am proposing a theory based on data. As I said others are saying they know he took them because LE said he did and his hand was in the pic.....find the data for that? Any one can make a theory, don't use untruth to support. That is speculation.

As someone else stated, LE should easily be able to tell if the pictures were taken with his phone. I know that on my phone, I can click "details" on my photos and it gives the date/time taken and all kinds of info. I'm pretty sure they can see if the photo was taken ON that phone. And he was the only owner of the phone.

I agree that the criminal complaint went into great detail, confirmed by JG after he was Mirandized, that this is his phone number, this is his cell phone, that he was in sole possession of the phone, etc. (page 5 #11). As many have noted, he was in possession of CP dated December 2015 as he is charged, so there is no excuse for it to have been in the phone for so long since he actively took selfies/used the phone as a camera. It is understandable that he would not contact LE if it was merely sent to him due to his immigration status, but any decent person would have deleted it.

I have a Samsung phone and checked the details on photos in my gallery. Each one indicates a "path" that indicates how the image was stored on my phone. For example, a photo that my son sent to me via text has one type of path (incl. my cellular provider's name). Photos I've taken with my phone are saved a path called "dcim" (camera storage). Photos I've downloaded from other sites have a different path. They're all saved on my device's photo gallery and I'd never know how they were stored unless I looked at the "details" option.

I agree with you, AmyPond, that LE will be able to determine whether photos were taken by the phone's camera, downloaded from the Internet, or received via text or email.

not necessarily. they have no victim or dna or any other evidence other than the pic. it would be investigated and if evidence existed, charges would be forthcoming.

I have gone back and reread several pages in this thread where it was being discussed the timeframe of Diana's leaving and the stove burners being turned on high for so many hours without catching fire.

Two statements given to us that make no sense. Diana walked a friend home at 2:00 AM and did not return. How did the mom see her in bed at 2:00 if she was walking a friend home? Why did this friend stay so late at 9 years old? Did mom and step-dad go to bed, leaving the girls up? This is suspicious to me! Why was this story told so quickly?

The second thing I found in rereading is step-dad gives the reason Jorge left as being Jorge told step-dad he didn't have any more work in the area. WHAT??!! It's summertime, he is working construction, supposedly, and there is no work? Come on, I doubt this!

On the other hand, we know from mom that she asked/told Jorge to move out as she didn't like his relationship with her daughter. Not exact words. Now. I ask you, did step-father know mom asked Jorge to move out and why? Or, did Jorge CHA in telling Step-dad there was no work knowing that his a77 would be grass if step-dad knew he was messing with Diana? After Diana came up missing, mom had to tell step-dad the truth on why Jorge moved out. OR could it be the parents just did not want to release their suspicions to the world at first?

There is a missing piece in the beginning of this story IMO.

There was only one news source that reported Diana was seen walking someone home around 2. That info was just sort of tossed out there with no source provided. That was that news source's one and only article about this case. Every single other reporting outlet and LE have stated she was seen at home in her bed, at 2am.

Mom turning them on and forgetting doesn't work for me either. If it was one, perhaps. But all of them? No.

My grandson is 7, tall for his age. No way could he reach controls on the back of a stove without climbing.

JMO! I believe the family told police everything, and police asked them not to release everything to media. When the family felt not enough was being done to find Diana, they went against police advice and started releasing info. Obviously police have always known more than us, They were tracking down Jorge before we knew he existed.

I have been dredging up old articles over the past few days & posting them here. I was especially concerned about the discrepancies about why & when JGT left.

but, I believe RH said she & JGT worked in the fields together, (also this was used as backing for LE searching large area of fields, he would know the area).

this was treated as a runaway situation at first; I think the original story may have been that there were previously roommates living in the home, but they left due to not having work. I think that is why RH can say she brought up the roommate day1.

I think the story changed (I'm not saying either is true or false), which is why there was no AA right away. maybe as time went by they divulged more info to get themselves & DA to be taken more seriously.

on another note I am looking forward to the update tomorrow from the lawyer & family. I have been waiting for this.

my prayers are long & loud for this little girl & her family.
