Sad update from CCPD this morning. My condolences to his family. The good news is they seem to have “a mountain of evidence”.

His sister, Emily Scaletta, flew down to Cape Coral shortly after Barry's disappearance. With the help of community members, she went around to businesses and popular areas to put up signs, looking for any leads.

"He’s awesome, he’s the best big brother in the world. He’s got a heart of gold and he’s so stinking smart with everything," Scaletta told Fox 4 in August. "We absolutely love him and just want to find him."

As for the criminal charge, unless Davis fights extradition, he will be brought to Lee County to face his murder charge
 
Davis was booked into the Lee County Jail at around 1:45 a.m. on Thursday, facing around 18 charges, including murder, tampering with evidence, and fraud.

The Cape Coral Police Department claims that they have collected an enormous amount of physical evidence linking Davis to the murder of Schmalbach, stating that his involvement in the case stems back to January 2024.

“Detectives and forensics personnel have been investigating, collecting a massive amount of physical evidence, obtaining witness statements, collecting and examining digital forensic evidence, and working with the prosecutors from the State Attorney’s Office all along the way,” said Cape Coral Police Chief Anthony Sizemore.
 
Christopher Davis pleaded not guilty to 20 charges, including second degree murder and tampering with evidence.
It makes me sad to hear about his last possible moments in detail. Barry is one of my ex's from about 20 years ago. Not to sound cray-cray but I think he's been visiting me. Does that sound crazy?

This case is so sad. The description of Barry by his sister was heartbreaking. He sounded like a lovely bright man. Got involved with the wrong person and couldn’t get out. The same sad domestic violence story, regardless of gender.

I'm thinking more that this guy had been casing Barry and his money for awhile. Barry was very generous and could had been seen as an easy target. I think his sister told me that this isn't the first missing person case with this guy....but, don't quote me though. I, myself think that Barry probably found out about access to his accounts and confronted this guy and probably said he was gonna call the cops....that would be my guess.

Barry's case is heartbreaking & I hope LE can locate him. I hope there is justice for Barry. I am glad CD has been arrested & that there seems to be a mountain of evidence.
I totally agree...he definitely deserves justice. I also heard that CD may have stolen from some MS13 people...So, I hope we can find justice before this a-hole gets snuffed out in jail first.

That bartender told investigators that one night, Davis became aggressive with him and actually held him down.

“I really wish he would’ve said something,” said Sherry. “Even the neighbors that I spoke with when I went to Barry’s condo were saying stuff, you know, ‘we tried to tell him he’s no good.'”

Documents lead us to the condo next since after the couple left the bar that night, they ended up at their condo on Beach Parkway.

One neighbor who lived under the couple says she heard noises as if someone was being thrown around upstairs, as well as someone yelling no. She says that yelling eventually turned into whimpering.

“They should have called the police or somehow, ‘Oh, hey, we can hear you down here.’ You know, maybe it would have stopped him, you know?” said Sherry.

That neighbor said the noises she heard gave her chills.

I'm sorry but I think that if I was to hear everything these neighbors heard and saw I would have at least had the police done a Wellness check....maybe I'm just too much of concerning person?

As for Sherry, when Barry and I lived together for five years, Barry and his mother would talk about the other siblings and didn't have nice things to say about them.

I personally never met her and I stayed out of all that family drama with them. But I do remember one time Barry coming home from work saying that his sister, Sherry showed up at his work causing a scene and had to be escorted out of the building. I don't remember much else about it.

As much as I know Barry and his mother ...were not close with Sherry and his brother. I can't tell you if they got along afterwards or not. I have no clue.... so I can't say. But some people I know are saying that certain people are sniffing around for money. That's all I'm hearing.
