Almost three years after Diana Duve died, the trial of the man accused of strangling her to death still appears to be months away, according to defense attorneys.
Duve's former boyfriend, Michael Jones, 34, of Vero Beach, was in court Friday for a status hearing on his case. He stood silently and expressed no emotion. He's been held in the Indian River County Jail without bail, charged with Duve's June 2014 murder.
Chief Assistant State Attorney Tom Bakkedahl said he is ready to go to trial, but Public Defender Diamond Litty expects the trial will be months away.
Pretrial questioning of witnesses continues. Assistant Public Defender Stanley Glenn said he still has more witnesses to interview, especially for the penalty phase after the trial.
Attorneys said it isnt unusual for a case of this magnitude to take two or more years to complete. Bakkedahl estimates the trial could take four to five weeks, including jury selection.
Assistant State Attorney Brian Workman asked Circuit Judge Cynthia Cox to closely monitor the case's progress, so it moves along.
"Set a timeline," he said.
Prosecutors have announced they will seek the death penalty.
