Now that former banker Michael Jones has been indicted on a charge of first-degree murder, assistant state attorneys are moving ahead with his prosecution and deciding whether to seek the death penalty.

That decision will be made within 45 days, chief Assistant State Attorney Tom Bakkedahl said Tuesday, moments after a largely female grand jury indicted Jones in the strangulation death of Jones’ former girlfriend, Diana Duve...

Circuit Judge Robert Pegg ordered Jones to remain in jail without bail.

Old post but this is exactly what I thought when I saw the mug shot. The poster guy looks nerdy, this guy looks mean but hot. Hard to believe it's the same person =/

A man charged with murdering his girlfriend in 2014 will spend five years in state prison for violating his probation in an unrelated stalking case from 2012 in Broward County, court records show.

But first, Michael Jones, of Vero Beach, will be transferred to Indian River County to be tried on charges of first-degree murder of his girlfriend, Diana Duve, 26, of Vero Beach. That case is scheduled for a status hearing June 23 before Judge Cynthia Cox, according to court documents.

A trial date hasn't been set.

It has been two full years since former beachside banker Michael David Jones was indicted on first-degree murder charges for the strangulation death of his girlfriend, 26-year-old Moorings resident and Sebastian River Medical Center nurse Diana Duve. But attorneys still aren’t ready to try the case.

Judge Cynthia Cox inherited the case in January when she took over the criminal caseload from Judge Robert Pegg as part of a routine reassignment of duties throughout the 19th Judicial Circuit. Prosecutors and defense attorneys agreed as last week’s docket call approached that they needed more time to prepare for trial.

Police Chief David Currey said he’s confident in the police work of his team of detectives and officers who handled the search for Duve and the eventual murder investigation that led to Jones’ indictment two years ago. Currey has not yet been scheduled for a deposition and he said he does not know whether he will be called to testify.

“Our job is to do everything right from the beginning and to see everything through, to dot the I’s and cross the T’s, knowing that it’s not going to be anytime soon,” Currey said, noting that the island’s last big murder trial, the Brian Simpson case, took a full three years from senseless killing to sentencing.

“I think the families would like to see it come to a close before it does, and so would we, but once our case is prepared, unfortunately it’s a waiting game,” Currey said. “We make sure regardless of when it is going to go to trial that we’re prepared. … That’s the key when your case does come to trial, it’s about thoroughness and preparation.”
 
This is another aspect of the 'criminal justice' that upsets me. The victim sure didn't get YEARS to get to live! The victim got no say in whether they lived or died! And yet the darn perp ALWAYS gets delays, extensions, appeals, etc, both before and after a trial! A trial the VICTIM never got!

Criminal justice....yeah the word fits...the criminal gets a trial for a jury to determine their fate. The victim sure didn't. Where's the VICTIM'S JUSTICE SYSTEM????

Family and friends of Moorings resident Diana Duve will have to wait a while longer to see her accused killer Michael David Jones stand trial for the June 2014 death of the 26-year-old nurse.

A docket call was set for this week, but the case was continued until Feb. 23. The complex capital murder case, which will piece together physical, electronic and videotape evidence, along with eyewitness accounts, will not be ready for trial until the middle of next year, according to defense attorneys.

Almost three years after Diana Duve died, the trial of the man accused of strangling her to death still appears to be months away, according to defense attorneys.

Duve's former boyfriend, Michael Jones, 34, of Vero Beach, was in court Friday for a status hearing on his case. He stood silently and expressed no emotion.He's been held in the Indian River County Jail without bail, charged with Duve's June 2014 murder.

Chief Assistant State Attorney Tom Bakkedahl said he is ready to go to trial, but Public Defender Diamond Litty expects the trial will be months away.

Pretrial questioning of witnesses continues. Assistant Public Defender Stanley Glenn said he still has more witnesses to interview, especially for the penalty phase after the trial.

Attorneys said it isn’t unusual for a case of this magnitude to take two or more years to complete. Bakkedahl estimates the trial could take four to five weeks, including jury selection.

Assistant State Attorney Brian Workman asked Circuit Judge Cynthia Cox to closely monitor the case's progress, so it moves along.

"Set a timeline," he said.

Prosecutors have announced they will seek the death penalty.

More than three years after Sebastian River Medical Center nurse and Moorings resident Diana Duve was found dead in the trunk of her car, defense attorneys for accused killer Michael David Jones, her former boyfriend, are nowhere near ready to go to trial, and Judge Cynthia Cox is getting impatient.

The defense has not released a single document or the names of any potential witnesses to the state.

When asked for good cause, Glenn said he’d only taken over the case in February 2016.

“You can’t just take as long as you want,” she said. After the defense turns over its witness list and other evidence to prosecutors, Cox said, “We’re still looking at about six to eight months for the state to do their part.”

Cox instructed Glenn to pick up the pace and placed the attorneys on a schedule of meeting about once per month to report on the status of the case. It was also agreed that Glenn would file any motions challenging the state’s pursuit of the death penalty by Nov. 30 to give the court a chance to rule on those in advance of a trial.

Judge clears way for 4-year-old death penalty case against Michael Jones to proceed
Prosecutors and defense attorneys sparred in court Wednesday over 10 motions Jones' attorneys — Stanley Glenn and Shane Manship, both with the Public Defender's Office — had filed in an attempt to avoid the death penalty in Jones' first-degree murder case.

In a written order Friday, Circuit Judge Cynthia Cox denied nine of the motions, most of which are filed routinely in capital murder cases to make sure the matter can be raised on appeal, if necessary.

A trial is unlikely to begin until 2019. Both sides are working to finish hiring and interviewing expert witnesses more than four years after Duve's death. The next status hearing was scheduled for Sept. 26.

The penalty phase for Michael Jones, who was convicted for the murder of Diana Duve, began Wednesday morning in the Indian River County courthouse.


A jury found Jones guilty of strangling Duve, 26, putting her body in the trunk of her car and then driving to Melbourne, where he left car with her body inside.

Medical Examiner Roger Mittleman was the state's first witness.
