BENEFIELD DOES NOT TESTIFY AT STAND YOUR GROUND HEARING​

Ashley Benefield's defense team did not call any witnesses during the two-day hearing for the former ballerina.

On Friday, proceedings began with the defense telling the judge they would not be calling any witnesses. Following closing arguments from both sides, the judge said he would take the matter under advisement and issue a ruling after reviewing court transcripts. Court is expected to reconvene in September to continue the “Stand Your Ground” hearing.
 
At one point during the hearing, Doug Benefield's daughter had to leave because of the emotional and graphic testimony.

INSIDE THE CASES OF 3 FLORIDA WOMEN ACCUSED OF KILLING PARTNERS, EXES​

Shanna Gardner Fernandez, Courtney Clenney and Ashley Benefield are each accused in the killings of current or former romantic partners. (8/24/23)

On Monday, Circuit Court Judge Stephen M. Whyte issued his ruling denying Ashley’s Motion to Dismiss. Judge Whyte wrote, “The competent and substantial evidence presented by the State proves clearly and convincingly that the defendant is not entitled to court-ordered immunity from criminal prosecution, as she was not justified in using deadly force against the victim on September 27, 2020.”

At a docket sounding Tuesday, Ashley’s trial was stayed until Nov. 29.
