FL - Mark Schwab facing execution for the '91 murder of Junny Rios-Martinez

TITUSVILLE, Fla. — Death row inmate Mark Dean Schwab is a "scientific mystery" who should be spared execution so he can be further studied to prevent other pedophiles from raping and killing children, his attorney said in a motion for clemency.
Schwab, 38, was sentenced to death for the 1991 kidnapping, rape and murder 11-year-old Junny Rios-Martinez of Cocoa. Schwab, who had recently been released from prison for raping another child, targeted Junny after seeing his picture in a newspaper.
"As long as he's alive he is available for psychological research, examinations and evaluations, which could in the future prevent a person from becoming so fully mis-oriented as to commit a crime that Mr. Schwab stands guilty of today," Titusville attorney Kenneth Studstill wrote in a petition to be reviewed by the Office of Executive Clemency.
Studstill wants Schwab's death sentence commuted to life in prison. Studstill did not immediately return a phone message left at his law office on Sunday.
Junny's family plans to urge Gov. Charlie Crist in September to carry out the death sentence. No death warrants have been signed in Florida since the Dec. 13 execution of Angel Diaz, 55, took twice as long as usual.

I just can't believe the gull - you know, at least say you were mentally incompetent or some other competely false reason to try to get out of it, since that is all you're trying to do (and then let the justice system turn you down). I have NEVER heard such a reason - that attourney is really reaching there, isn't he? I hope this poor family gets justice. What is so sad is that if they hadn't let this guy out, this child wouldn't have ever been victimized!

If the scientific study of pedophiles is deemed useful I'm sure they could pick one in any of the many states that don't have DP. I don't see anything special with this particular bozo that would single him out. It's just a desperate maneuver, attorneys have to earn their money I suppose. If I was this guy's attorney I'd do the same I guess, and hope it would be denied of course. I don't envy public defenders who have to pretend they don't despise some of the scumbags they get stuck with.

Everyone should read his appeal to see how cunning he is. I don't think it's too hard to see that he simply will go to whatever means necessary to groom a child (and their family) so as to gain time alone with them to carry out his sadistic fantasies.

I agree with Karl. There are several pedophiles out there, but this guy also killed the child he raped. He isn't sentenced to death for the rape, but for the killing.

You know, I'm no fan of the death penalty and I do think people who behave as aberrantly as this DPer should be studied in detail, both before and after physical death, but I surely don't see this attorney's argument winning any favor.

But I am grateful for people like this attorney who are willing to uncover every angle before someone is out to death. It is pretty sad when the only legal argument you can make is "he's such a rotten apple with no redeeming social value that the best thing we can do with him is make him a science project."

adults get themselves murdered and assaulted by making decisions to be at said place and time, and don't bother me very much, kids have no choice, they trust the grownups (and i use the term loosely) implicitly to always have their best interest at heart.


if i was the judge, i would order him killed and his brain studied in great detail. chemically, not sitting in a nice air conditioned office playing mental games with a doctor.

Crist signs first death warrant

TALLAHASSEE -- Gov. Charlie Crist on Wednesday signed his first death warrant since taking office in January, ending a temporary halt on lethal injections that was imposed because of a botched execution last year.

Mark Dean Schwab, 38, is scheduled to be executed November 15, Crist said. Schwab was sentenced to death in 1992 after he was convicted of first-degree murder, sexual battery upon a child and kidnapping of a child under 13.

Then-Gov. Jeb Bush suspended all Florida executions in December after a medical examiner said that prison officials botched the insertion of the needles when a convicted killer was put to death. Since then the state has adopted the recommendations of a panel to make the process work better.

Mark Schwab was convicted and sentenced to death for the murder of eight-year-old Junny Rios-Martinez. On 04/18/91, Junny Rios-Martinez was kidnapped, raped, and murdered. His body was discovered on 04/21/91.

Schwab was released from prison in March of 1991 after serving three years for sexual assault. During the same month, a picture of Junny Rios-Martinez, the victim, was published in the newspaper. Schwab saw the picture and called the family on the phone claiming that he was writing an article on the boy. Through this action and the promise of assisting the boy in a acquiring a contract to represent a surfing company, Schwab became friendly with the boy’s family.

On 04/18/91, a schoolmate of Junny’s reported that Junny had gotten into a U-Haul truck with a man. On 04/20/91, Schwab called his aunt in Ohio and told her that someone named “Donald” had made him kidnap and rape Rios-Martinez with threats of killing Schwab’s mother. On 04/21/91, the police were questioning Schwab’s aunt when Schwab called. The police recorded and traced the phone call with her permission. Upon learning Schwab’s location, the police arrested Schwab in a neighboring Ohio town. Schwab told police where to find the body of Junny Rios-Martinez, which was discovered in a rural part of the county inside of a footlocker.

I'm pleased that Gov. Crist has signed the death warrant. Mark Dean Schwab is a waste of skin who deserves to die for what he did.

Does anyone remember a news report that came out just after he was arrested? It might have been after his sentencing. He had contacted the Rios-Martinez family and told them details about their younger son and his schedule. It totally freaked me out, how much more was he planning to do to this family? Does anyone else remember that?

As far as studying him goes, I think a nice cross section of his brain under a microscope is the way to go.
