A judge in Volusia County on Friday agreed to postpone the upcoming trial of Luis Toledo, a gang member accused of killing his wife and her two children, in light of this week's high court's ruling about Florida's death penalty....

A new date has not been set, court spokeswoman Ludmilla Lelis said.

In his decision filed Friday morning, Circuit Court Judge Raul A. Zambrano wrote that there is a "high danger" the rules surrounding Florida's death penalty rules might change in the middle of the trial if it were to go on as scheduled.
 
A "Santeria" shrine assembled by a jailed Deltona man accused of killing his wife and her two children, which included pictures of the missing family with apparent drops of blood on them, was confiscated from his cell.

The shrine Volusia County jail reports and depositions state was found in suspect Luis Toledo's cell, also included a newspaper clipping photo with a red mark through the name of Circuit Judge Raul Zambrano, who is presiding over the murder case.

Toledo’s shrine also had a paper cup filled with water, an orange and dried bread. Toledo had apparently fashioned a cross from a ripped white T-shirt. A nose and eyes appeared to have been smeared on a cast Toledo had taken from his left hand.

The cast was stuffed with gauze and another newspaper clipping, a report said. This clipping had a photo of Yessenia Suarez, 28, and her two children, Thalia, 9, and Michael, 8. On each was a red dot, apparently made with blood, a correction's officer said in a deposition. The items were arranged in a ritualistic way, "possibly 'Santeria,' " according to a jail report dated March 27 when the items were found. Another picture showed Toledo with a red dot on him.

The murder trial of Central Florida man accused of killing his wife and her two children is on hold until the fall. This October will mark three years since Luis Toledo's wife and her two children disappeared from Detlona.

Last week, a Miami-Dade circuit judge declared that the state's new law is unconstitutional, saying it should require a unanimous decision from the jury to impose the death penalty. Florida's Supreme Court will take up the matter of 10-2 juries next month.

There will be another status hearing in the Toledo case on August 19.

State seeks clarification on death penalty as victims' family waits
But Toledo’s trial has been delayed as first the U.S. Supreme Court struck down Florida’s death penalty sentencing scheme. The Legislature passed a new law this year requiring a 10-2 vote. But then the Florida Supreme Court struck that down, saying a jury’s recommendation for death must be unanimous for a judge to be able to impose death.

The Florida Attorney General’s Office has now asked the state Supreme Court to clarify its decision, according to a motion. The Attorney General’s Office wants to know whether the current law can be used as long as the jury is required to be unanimous in its death recommendation.

Death penalty to remain on the table in Luis Toledo case

DeLAND, Fla. - The death penalty will remain on the table for a 35-year-old Volusia County man who is accused of killing his wife and her two children, a judge ruled Friday morning during a hearing.

Volusia County Circuit Judge Raul Zambrano ruled on two motions made by defense attorneys aimed at preventing the prosecutors from pursuing the death penalty against Luis Toledo.

Judge rejects Toledo’s defense claims that death penalty is unconstitutional

DELAND — A judge rejected claims that Florida’s death penalty was being retroactively applied to Luis Toledo, the Deltona man accused of killing his wife and her two children.

Circuit Judge Raul Zambrano also denied a defense motion that argued that Florida’s death penalty was so broad it could be applied to virtually any first-degree murder case in the state.

Inmate claims Luis Toledo confessed to killing Deltona family
Michael Lamothe told investigators Toledo told him and another inmate that he “beat the crap” out of his wife, Yessenia Suarez, in their Deltona home, then choked and broke the necks of her children Thalia Otto, 9, and Michael Otto, 8.

The bodies of the mother and children have never been found, and Toledo did not reveal where he hid them, but Lamothe said the murder suspect told him that he used the chemical lye to help dispose of them.
 
Don't think this guy is very credible. Pretty risky doing all this jailhouse "ratting" on "former" high ranking gang members.

I saw a curious site today near the I-4 exit that is about two miles west of the home where they were last seen. There were some cars parked and people milling around. I wondered if it might be a group searching. But maybe it was unrelated. I've thought of going to look for them many times.
 
Luis Toledo’s attorneys ask to sequester jury in death penalty trial
The hearing on the defense motion to sequester the jury, which means removing them from public contact during the trial, is scheduled for 9 a.m. Friday before Circuit Judge Raul Zambrano at the Volusia County Courthouse in DeLand.

Jury selection is scheduled to begin on Oct. 2 in St. Augustine for the long-delayed trial which is expected to last several weeks.
