Omg!! I'm still out and just checked my phone!! Thank you jury!! They had me worried today. Glad that they used their common sense.

What? He's asking for the DP?

That's what I was reading on the Lawnewz livestream chat. It was really hard to hear but the judge did tell him that he might be asking because he was emotional right now. That he needed to talk to his attorneys.

Pretty sure we can rewatch the stream but I figured if I couldn’t hear him the first time around...

A couple people asked Frank what Toledo said but he hasn’t answered. Other media tweeting aren’t saying either.

On first degree he could get DP or LWOP, on second degree he could get (for someone with a clean record) 10 years minimum with a maximum of life.

I don't care if he gets the DP as long as he is never free. I think the reason he never wanted to admit killing the children is because he'd be regarded as the lowest order of scum in prison. He's a coward, scared of what other men would do do him because he's a baby killer.

I don't care if he gets the DP as long as he is never free.

He really doesn't want to go to prison as a child killing former LK gang member it seems. Give him life in general population and let him suffer.

Interesting read regarding one case of waiving DP mitigation : http://www.americancriminallawreview.com/files/1014/0943/6017/Dulberg.pdf

To view Case pdf’s, go here and choose Case Inquiry, then accept. Input name, next page choose case you want. Top of case page will be Docket. Click on that and available pdf’s will be on the right side of the page. Hope I explained that well. :)

If a pdf is red, it isn’t available to view. Most in this case can be viewed.

Excerpt— More on site:

[h=1]Guilty of murder: Luis Toledo won’t argue against death[/h]ST. AUGUSTINE — A jury returned guilty verdicts on all counts, finding that Luis Toledo killed his wife and her two children, and tampered with evidence by disposing of their bodies.
Toledo then said he wanted to waive his right to argue why he should not be sentenced to death.
The deliberations began at about 9:25 a.m. Friday in the case against the Deltona man. Toledo, 35, is charged with second-degree murder in the killing of Yessenia Suarez, 28, and two counts of first-degree murder in the deaths of her children Thalia Otto, 9, and Michael Elijah Otto, 8.
It took the jury about eight hours to reach a verdict.

IMO, no innocent man is going to plead to be put to death when the real killer of his step children is walking free.

The jury definitely made the right call.

I've been so busy I've not been able to check in until now. I knew the right verdict would be in at Friday wine time!! I hope he doesn't get the dp, life in general population would be perfect for him.
