They could have testified by zoom, not necessarily physically travelling there. It seems a lot of the witnesses zoomed in.

In the absence of knowing what they said in their testimony, if the above is the sum total of it, I can't see how it could help much here. CB visiting an apartment in the block where HaB also happened to have an apartment a few months before HaB was assaulted and raped is not really smoking gun material.

Unless of course CB himself said he'd never been at that apartment block? That would be the only potential use their testimony has, that he lied.

Otherwise, it's about as much use as the accounts of those other 2 holidaying females who stayed at CB's house for one night, felt there was something 'dangerous and scary' about him, left the next morning to stay elsewhere... and then met up with him for a drink. As you do.

It doesn't matter what the witnesses had to say in their statements, the fact they were called proves it was considered to be of relevance to the case.
The learned judge will decide the value of their witness statements when considering them and all the others brought before the court.

Just as CB's familiarity with the environs of DM's villa in Luz was proven, his familiarity with the environs of HB's domicile inside the hotel is proven by the Finnish witness statements.

Praia da Rocha is in very close proximity to Praia da Luz (about thirty minutes away) and just as CB's presence in the one suggests he might have cased and planned the location of another serious crime a short distance away.
CB was familiar with Praia da Rocha.
CB was familiar with Praia da Luz. He committed heinous crimes in both locations being fully prepared for both events carrying a rape kit containing instruments of torture, restraints and video cameras.

I think evidence which places CB in an area where a serious crime was committed proving his familiarity with it is of great value in a prosecution.

*The legal team defending Brueckner is attempting to have a key piece of evidence thrown out of court, arguing that investigators broke international law in obtaining it. German police were handed Brueckner's hard-drive by an unnamed female witness in Portugal containing sickening cartoons allegedly penned by Brueckner. Now his defense team is demanding that the Regional Court of Braunschweig does not officially admit the hard-drive as evidence.

Defence attorney Philipp Marqort said there are no grounds to justify the current arrest warrant keeping Brueckner behind bars. 'The prerequisite for an arrest warrant under Section 112 of the German Code of Criminal Procedure is an urgent suspicion of an offence.' 'The urgent suspicion of an offence requires two elements to be examined by the competent detention court: on the one hand, an objectively substantiated assessment of the probability of the accused committing the offence and, on the other hand, a prognosis of the probability of conviction. But here both criteria are not met.' Now that all of the main witnesses have been heard, as the case begins winding down, the defence says what has been presented so far has been weak, claiming there is no evidence demonstrating the necessary 'probability' that Brueckner committed the offence. The court must now decide whether the arrest warrant will be cancelled. "If this is the case, the defendant will be acquitted unless the public prosecutor pulls another rabbit out of the hat," says lawyer Fülscher. The aggravated rape of DM was premeditated.

CB went prepared ". . . it shows CB was very familiar with the twisting roads around Praia da Luz having often prowled the area looking for places to break into and steal."
On at least one occasion rape, not theft was his intention. As weighted down by his rape kit he knew his way around and how to gain access to the walled villa and probably knew the layout of security between him and his target.

The beach is a two-minute stroll from the heavy wooden doors at one of the entrances that can only be accessed by entering a code on a electronic pad.

The main entrance has an entry phone system with a camera to show people calling. No one answered and many of the metal shutters were closed on the building.

Security cameras could be seen along the exterior of the home which is not visible from the road due to six foot high white washed wall.

Every police investigation is a jigsaw made up of many pieces of which the testimony of the two Finnish women is one part which fits into the overall picture.

The judge will have seen the body scans of CB, taken by German police well before these cases reached trial, showing the presence of a scar in the upper thigh even if it has since been removed. Depending on the scale of the body scan, the presence of multiple marks would add weight to witness JE's identification in the Salema beach attack. Have the rabbit teeth been discussed yet?

There were 2 unknown victims (witnesses) featured on the rape tapes and 2 known witnesses to the content of those tapes. The court appear to have established that tapes which CB didn't want seen by the PJ did exist. Watching child *advertiser censored* was not illegal in Portugal before Sept 2007 so it's unlikely imo that material of that nature was the reason for CB wanted the videos hidden. I can, however, believe that he wanted videos of women being raped, some in his home, to be kept out of police hands.
All imo.

It is interesting that if CB actually did go to the extent of altering his appearance, both the identifying marks on his body and his "rabbit teeth" being recorded in police files after serious sexual offences had been committed. Both of which feature in charges against him in this trial.
And which may be another part of the jigsaw warranting future Preventive Detention; certainly another thought about the implications for CB and why the judge appears to be bending over backwards ensuring his defence has nothing to complain about at an appeal.

For the next trial date on Friday (5th. July) an ophthalmologist is expected as a witness. The defense had requested an appropriate opinion to clarify whether a perpetrator could only be recognized by the eyes. In the case of an Irish woman who was raped in Portugal in 2004, the person concerned had reported as a witness of „ piercing blue eyes “. „ His eyes, I think this man is the attacker “, she told the court. The defense simply considers recognition based on the blue eye color to be impossible.

Would that not then mean that the testimony about seeing the tapes was of no value ?

Obviously not since the court accepted the existence of the evidence and allowed it's admittance into evidence to be presented at this trial.

The same evidence being used as the burden of proof in three different offences. The difficulty could have been that two of the women assaulted were unidentified. But evidence is still evidence.

Interesting to see how the ophthalmologist will recreate exactly the same lighting conditions in existence at the exact time and place as described by the person being assaulted.

There must have been some ambient lighting coming from somewhere. If not the bruised, battered, traumatised and severely injured rape survivor would have been unable to see a thing.

A blindfold was used by CB in the aggravated rape of DM which occurred the following year in 2005 meaning she was unable to see around her.
