the problem is the two witnesses who claimed they saw what they did on the tapes - one committed perjury during this trial and the other admitted they did in the 2019 trial which brings their supposed evidence into question tbh. You also have the fact that one at least had different versions apparently from the original statement and the other seemed a hostile witness.Disagree. The MO Diane described, the MO Hazel described & the accounts of what the witnesses saw on tape are all very similar. That’s before we even get in to what CB wrote about & what he apparently said to his ex cell-mate.
One can look at the totality or one can attempt to argue every circumstance in isolation. This is polarising because of the point of view behind it.
The issue is - even though I was at the biscuit tin each of the 10 times, my wife can’t prove it was me. Highly unlikely my presence was 10 isolated coincidences but perhaps not enough for my wife to be able to prove it beyond a reasonable doubt. That doesn’t mean I didn’t eat all the biscuits.

This is only the opinion of a single person who had no contact with CB. It may or may not be valid. I would prefer to see the opinions of a wider group of experts, rather than just one.
I shall not be debating or disputing the judge's decision, whatever it may be.

Interesting differing viewpoints on the role of the defence in this particular trial.
I vehemently disagree that the role of the defence is to systematically dismantle the character of the witness.
By all means tear the evidence to shreds but do please make the progression into the more enlightened techniques now adopted when grilling a survivor of aggravated rape.
The treatment meted out to HB as she presented her case for justice is no part of the process to achieve that. What a shame that was the best presentation they could muster.
My opinion
The defence are free to call an equally eminent rebuttal witness to the stand.

The accused then tied & gagged the woman to a table & raped her again. He then whipped the victim on the back with a whip he had brought with him & finally forcibly performed oral sex with the victim. The accused filmed large parts of the events with a video camera he had brought with him). Braunschweig Regional District Court
Germany/Portugal – *Charged (Oct. 11, 2022) & arrest warrant reinstated 11/18/22 - a 14 year old teenager (unknown victim) (on tape: assaulted/hit the naked girl with a whip. Said to have brutally forced the girl to have oral sex. The accused also videotaped this act). Took place between Dec. 28, 2000 to April 8, 2006 on the Praia da Luz, Algarve coast, Portugal.

*Among other things, he was instructed to examine whether, in the case of the conviction of Christian B. for one or more acts, the prerequisites of paragraphs 66 of the Criminal Code were met.
Security custody: Requirements of § 66 StGB:
The order of custody according to § 66 para. 1 StGB is permissible under the following conditions, all of which must be met: Someone is currently sentenced to a prison sentence of at least two years for a crime specified in § 66 (1) StGB. The perpetrator has already been sentenced to a prison sentence of at least one year twice in the past for such an act. He has already served at least two years in prison because of these old acts or was in the prison deprivation of liberty. Preventive custody always presupposes that the convicted person has a tendency to commit serious crimes & represents a danger to the general public at the time of his conviction.
*With the report of the expert, the procedure turns onto the home straight. Next Wednesday, Oct. 2, 2024 there will be an appointment for decisions about applications. From the Chamber's point of view, however, we all had witnesses, said the judge. If there are no surprises, the taking of evidence is nearing completion. A plea would be possible in the second week of October.
*Proceedings before the 2nd Criminal Division in connection with five offenses against sexual self-determination. Possibly end of the taking of evidence on October 2nd, 2024, followed by the prosecutor's plea.
