The county records indicate this is preservation land belonging to the HOA. I sure hope they deny the Nightmare Team access to it, since it IS privately owned.

Doesn't it hurt the prosecutor's case if the defense isn't allowed to see the crime scene?

No, the state and ME have an obligation to preserve and maintain evidence for the defense team. Most defendants, the vast majority, do not have access to the crime scenes. Generally it is quite some time between discovery of a crime scene and an arrest.

If it can be shown that the state did not share evidence in a timely manner, didn't follow appropriate handling, that would hurt the prosecution.

The Casey Anthony Defense Team has made numerous attempts to preserve
the evidence in and around the location where the human remains of what
appear to be a small child were found.

Law enforcement has been repeatedly asked to allow reasonable access by
medical and scientific experts for the defense, including requests for
photographs, and assistance with maintaining a secure examination scene
prior to any media or general public access.

Every effort by The Baez Law Firm to establish a level of basic
cooperation and professional courtesy have all been rejected by the
government. This lack of cooperation has complicated how to proceed.

Now that the scene more resembles that of an excavation site as opposed
to an examinable crime scene - attorney Jose Baez has been advised that
without properly detailed photographs and all related material and
documentation, the various experts on the Casey Anthony Defense Team
will simply not be able to thoroughly examine the site.

Unfortunately this matter has already become a Media Circus and
something The Baez Law Firm will not contribute to, by just making a
show of going to the excavation site without good reason.

The Casey Anthony Defense Team is being prevented from examining the
site unless and until all photographs, schematic sketches and related
material and documentation are released to the defense through the
discovery process.

This man just doesn't get it. A positive ID has not yet been made, it is still a crime scene and he has no business being part of this investigation. What doesn't he understand???

I see where the defense is going since they are running out of options with Zanny the Nanny did it theory. I can't wait for the evidence on that duct tape and garbage bag. Once it's proven that KC and ONLY KC is responsible, he should plead her guily and ask for leniency. He needs to spare the grandparents from the graphic details of Caylee's last terrifying moments in the trunk of her mothers vehicle.

I just wish on one of these interviews someone would ask him WHERE IS ZFG??? If she exsists and they have all this personel---prove it or shut it.....

why isn't he working on his case instead of whinning....I personally had to leave...also can't stand the other atty ..... it is so hard to listen inbetween the ummmmmms....
 
My lovely Brahmin mother who usually does not follow these cases told me that she was 100% sure that a network was paying for the defense. When she makes statements like this I listen closely because she is usually 100% correct....so, how do we follow the money when everyone is claiming "pro bono?"

I have a feeling this is being investigated and the public will find out if anything is fishy. I agree with your lovely Brahmin mother.
 
Fox is SO pushing the "it was dry at the time - did someone put the body there while Casey was in jail?" bent. I didn't think I could hate Fox more than I already did.
 
Just a bit of info on the dogs.

I'm not sure if LE dogs did check this area when under water, and I doubt if the psychic's dogs are water trained. They air scent from above the water, or from the edge. They alert to the presence and, when appropriate, divers go in to investigate. Searchers wading through, if dogs alerted, would not have been relevant in this instance, according to Tim Miller.

Water Search Dog
A dog trained to locate dead bodies under water. This can be done from a boat or as a shoreline search.

Human Remains Detection Dog
This Detection Dog is a specialist and has never been trained to look for live humans. They specialize in crime scenes, old cases, small scent sources and residual scent. These dogs have been trained to exclude fresh human scent along with all other animal scents.
 
Baez will play the "blame game" all the way to trial!!! Even to say it was the judges fault. :waitasec:

I think the blame game will backfire. Baez has forgotten there is another side to this, the prosecution will cover everything to show how lame these antics are.

Not to mention that until the remains are positively identified as Caylee's, the defense has NO RIGHT to any sort of access to evidence or the crime scene... unless, of course, JB is admitting they are Caylee's remains...

You are correct, and the Judge has told him so in no uncertain terms! On the other hand, if he were allowed there during the search this would make him a witness in a murder case, where he could not defend the perp. (Usually.) And as I stated yesterday, this is not a unique case. There are many cases where the perp was in jail on murder charges before the victim and crime site were found.
