Records show accused kidnapper Sidney Moorer does not face new criminal charge

MYRTLE BEACH, SC (WBTW) – Court documents reveal the man charged in the 2013 disappearance of Heather Elvis is not facing a second obstruction of justice charge, as some media outlets have reported. A new indictment was filed against Sidney Moorer last month, but it appears to amend the charge, not create a new one.

"You know, I think the strongest people are the people who reach rock bottom and then find the strength to crawl out of that depth," Morgan Elvis said, explaining that she was already reeling from losing a friend to suicide. She described Heather's disappearance as her "breaking point."

One year after hung jury, both sides await new trial date for Sidney Moorer

CONWAY, SC (WMBF) – Saturday will be exactly one year since a Horry County jury was unable to decide if Sidney Moorer was guilty or innocent in the 2013 disappearance of Heather Elvis.

Since June 24, 2016, Judge Markley Dennis has granted a change of venue because of what he called “social media saturation.” Moorer’s retrial will happen in Georgetown County.

The one thing missing is a trial date.

“It’s been a lot longer that we had hoped for, it’s been a lot longer than the judge suggested it would be,” said Terry Elvis, Heather Elvis’ father. “I’m very disappointed in the delay, but I’m hopeful that it’s in God’s plan to take this long so more answers will come, instead of questions. “So, we’re putting our energy in faith.”

Tammy Moorer posted information about Heather Elvis case to Facebook, court documents allege

CONWAY, SC (WMBF) – Prosecutors are alleging that Tammy Moorer, the woman charged with kidnapping missing woman Heather Elvis, posted information about the case to her personal Facebook page.

That information comes from a motion filed Monday, which states Moorer is in violation of a court-ordered gag order in this case.

The gag order was issued in March 2014.

According to the motion, comments were posted on Moorer’s Facebook page regarding “the facts of the case, witness’s credibility and comments about the victim’s family” between June and July of this year.

Terry Elvis said he was in the courtroom Monday morning expecting to hear a case against Tammy Moorer for contempt of court.

But like others sitting there, he was shocked when the proceedings involved her husband Sidney and not her.

Tammy and Sidney Moorer have been accused of the 2013 kidnapping of Heather Elvis, Terry’s daughter. Sidney’s earlier kidnapping trial ended in a mistrial while Tammy hasn’t been brought to trial yet.

Following the couple’s arrest in early 2014, circuit judge Steven John issued a gag order on all the direct principals of the case.

The circuit solicitor’s office late last week announced that Tammy would be in court Monday on a contempt of court charge for violating the gag order.

“This just adds to that disappointment and frustration,” he said. “Even during Sidney’s hearing Monday, the judge could have ruled on the matter of the two interviews. Instead, he said he would decide later about the Miranda issue.”

CONWAY, SC (WMBF) – The obstruction of justice trial for Sidney Moorer, the man accused of kidnapping missing woman Heather Elvis and obstructing the investigation into her disappearance, is scheduled to begin on Monday.

Moorer is charged with obstruction of justice for allegedly lying to investigators about making a call to Elvis from a pay phone on the night of her disappearance in December 2013. This was revealed during his first trial last year, which was for a kidnapping charge.

Sidney Moorer and his wife Tammy were arrested in February of 2014 for the murder and kidnapping of Heather Elvis who went missing on Dec. 18, 2013. He was also indicted for obstruction of justice in the investigation.

The murder charges were later dropped and Sidney was tried last year for the kidnapping of the 20-year old Socastee woman. That trial ended in a mistrial and will be rescheduled to take place in Georgetown.

This week, the state is trying Sidney on the obstruction of justice charge in Conway.

Lead investigator testifies about conversations with Sidney Moorer during day two of his obstruction of justice trial

"If somebody spits in my coffee, I'm not going to try to drink around it” Cauble testified. “I'm going to assume that all of the coffee is contaminated. So I'm going to throw that cup of coffee away and get a new cup of coffee. In this case, if someone lies to us in an investigation, we are assuming that everything is a lie as well until we figure out if it's the truth or not."

Prosecution loses possible key testimony in Sidney Moorer trial

Conway, SC (WBTW) – The Obstruction of Hustice Trial will continue Wednesday Morning for Sidney Moorer, the man accused of kidnapping Heather Elvis.

The trial began on Monday, Moorer also appeared in court Tuesday for day two of the trial.

Police say Moorer lied about his communication with Elvis the night she disappeared, and during Tuesday’s court happenings, the prosecutors lost what may be an important piece of testimony.

Elvis’ best friend, Bri Warrelmann, says she spoke with Elvis the night she disappeared. Warrelmann claims in that conversation Elvis told her that Moorer called her.

Warrelmann recalls Elvis was upset, but when the prosecutors asked Warrelmann to describe what Elvis did after speaking with Moorer, the judge put an end to the testimony.

The judge said Warrelmann’s testimony would be hearsay, not permissible in court.

“The worst thing that can happen, I think, is to have this case have to be retried because we went too far in allowing evidence that really wasn’t critical to your case,” the judge said to the prosecutors.

Warrellmann has testified before, she took the stand last year during Moorer’s kidnapping trial, which ended in a mistrial.

"He misled them from the beginning,” she said, claiming he didn’t tell them about a payphone call he made to Elvis until police told him they had video evidence.

She also claimed he deleted text messages from his phone, two of which she said were from Moorer asking Elvis to call him, before showing it to police who came to his home during the early hours of Dec. 20, 2013. She showed the jury phone records and said they told part of the story of his deceit."

Moorer found guilty in obstruction of justice trial, judge sentences him to 10 years

CONWAY, SC (WBTW) – Following three days of testimony, the jury in Sidney Moorer’s obstruction of justice trial delivered a verdict in about 50 minutes.

The jury, made of 11 men and one woman, found Moorer guilty of obstruction of justice. Just after the verdict Wednesday evening, the judge sentenced Moorer to the maximum 10 years in prison, with credit for one year he already served.

The man accused of kidnapping Heather Elvis has maintained his innocence for nearly four years, saying he had nothing to do with the then 20-year-old’s disappearance or presumed death. Wednesday afternoon, however, 12 jurors decided there was enough evidence to show Moorer intentionally lied to police about his communication with Elvis.

Horry County prosecutors say Moorer lied to deter police from investigating him further in the first 48 hours of Elvis’ disappearance.

Pre-trial hearing held for Tammy Moorer for violation of gag order

CONWAY, SC (WMBF) – Tammy Moorer, the wife of Sidney Moorer who is also accused of kidnapping missing woman Heather Elvis, appeared in court Tuesday morning for a pre-trial hearing.

Tammy Moorer is accused of violating the gag order in the case for posting information about the Heather Elvis case to her Facebook page, according to court documents.

Judge Markley Dennis said a pre-trial hearing was held Tuesday before Sidney Moorer headed into day two of his obstruction of justice trial, and it was determined that the matter needed to be investigated further. The case has been continued until her next court appearance can be scheduled by the administrative judge.

One of the lawyers representing Moorer appears to be Bill Nettles, a former U.S. Attorney for South Carolina, according to Anchor Kaitlin Stansell, who was in the courtroom.
 
Man sentenced to 10 years for obstructing police in Heather Elvis case set for 2019 parole

Conway, S.C. (WPDE) — In August, Sidney Moorer was found guilty of obstructing justice during the December 2013 investigation into the disappearance of Heather Elvis case and given the maximum sentence of 10 years.

On Aug. 31, 2017, Judge R. Markley Dennis, Jr. handed down the sentence of 10 years, with credit for one year of time Moorer had already served in jail.
But, jail records now indicate that Moorer could get out well before 2027.

South Carolina Department of Corrections paperwork lists the projected parole eligibility date for Moorer as March 20, 2019 and his release date as Oct. 8, 2022.

Moorer's lawyer says family accused him of conspiring with State, requests to be relieved as counsel

CONWAY, SC (WMBF) – Attorney Kirk Truslow has filed a motion requesting that he be relieved as Sidney Moorer’s pro bono defense counsel, stating that his relationship with Moorer has deteriorated, and Moorer’s family has accused him of conspiring with the State after Moorer was found guilty of obstruction of justice earlier this year.

A motion filed on November 30 by Truslow requests the court to relieve him as counsel for Moorer, which he has been conducting on a pro bono basis.

Truslow began representing Moorer in January 2014, when Sidney and Tammy Moorer were both arrested and charged with the murder and kidnapping of Heather Elvis, the then-20-year-old Socastee woman who went missing in December 2013. The murder charges were later dropped.

CONWAY, SC (WBTW) – Four years ago this week, Horry County police seemed to have a break in the case of a missing woman. They announced in February 2014 the arrests of Sidney and Tammy Moorer. Prosecutors charged them with murdering and kidnapping Heather Elvis.

Four years later, neither of the Moorers has been convicted. Prosecutors dropped the murder charges in 2016. Only Sidney has gone on trial for his kidnapping charge. The judge declared a mistrial because the jurors couldn’t agree on a verdict.
