Defense attorneys for Zach and Dylan Adams say they still haven't seen any of the evidence necessary to build their defense cases. They filed a motion to hopefully force the prosecution to turn the evidence over.

Both Zach and Dylan Adams are expected to be in court on Wednesday.

It appears the hearing was only about the prosecutors .... ie if Stowe recused himself does that mean everyone in his department also is tainted with a conflict of interest

From what I gather , the answer is no , they are not , and the new prosecutor as much as stated that for the record (that she has no conflict).

I just wanted to add that Jennifer Nichols had stated earlier last month, that how can't she do anything until the motions about her were handled.

So NOW they have been handled.

Special prosecutor appointed to Holly Bobo case will stay on job

Judge Creed McGinley, who is handling the high-profile case, denied two defense motions to pull Jennifer Nichols from her role. Nichols took over the position after District Attorney Matt Stowe recused himself saying there was a conflict of interests.

The lawyers also argued that Nichols should be pulled off the case because she had worked with Stowe.

News 2 spoke with a representative for the Bobo’s who said the family is relieved the case can continue to move forward. “There is a certain process in getting justice for Holly and this is one of those steps of the process,” Pastor Don Franks said. “The family is very appreciative of the way things of [went] today certainly very appreciative of all the prayers and support.”

Among the items to be discussed then is a request to toss out the indictment against Autry.

Nichols told News 2 she has not decided if Zach Adams and Jason Autry will face the death penalty.

Defense attorneys Matt Maddox and Jennifer Thompson said they were concerned Nichols may have a conflict in the case. Nichols was initially brought in to work with District Attorney General Matt Stowe's office due to her experience in homicide cases in Shelby County, according to Maddox.

Additional motions will be heard in the case on June 3 at 9 a.m. Fletcher Long, attorney for suspect Jason Autry, said he intends to file motions requesting evidence in the case be turned over to the defense or that Autry's charges be dropped.

Both attorneys for the Adams' were in court today asking that Jennifer Nichols, newly appointed prosecutor, be removed from the case. This is according to ABC news at 5. They were saying Nichols was not qualified to handle this specific case. The root of their argument stems from the fallout of district attorney Matt Stowe when he decided to withdraw himself from the case in December. After nearly an hour of arguments heard from the defense Decatur County Circuit Court Judge Creed McGinley (if I've spelled that correct) ruled Nichols appointment was valid and will remain on the case. The next court appearance for the defendants will be on June 3rd.

I think back to one of the early arraignment type hearings I saw and the judge was very stern and saying how he was not going to put up with anything from either side and he wanted this case to move along.

If that same judge is still the judge, then it seems that it was all a veiled threat because we have had nothing but games being played ever since I watched that day.

Yep, the judge has proven himself to be pretty much a stone cold liar, and one who makes up the rules as he goes along, hasn't he?!? Not saying he's biased to one side or the other, but I don't believe a whit of what he says anymore.

Sure glad I don't live in TN. Pretty state to visit, but the justice system there seems to be a total farce.
