2/7/20 Update: On Thursday, a judge ruled prosecutors can use a straw police obtained in Jerry Burns's trial. Police say they obtained the DNA from a drinking straw that Burns left behind at a Manchester restaurant. Investigators say the DNA links Burns to the crime scene. While the straw is allowed, a judge earlier this week ruled that Burns's internet search history for *advertiser censored* should not be allowed in the trial. The familial genetic material will also be allowed in the trial. Trial begins on Monday, 2/10.
 
CEDAR RAPIDS, Iowa (Iowa's News Now) — The Iowa Supreme Court has denied an appeal filed by defense attorney Leon Spies days before the murder trial of Jerry Burns was set to start.

The supreme court's ruling came over the weekend, two days shy of the beginning of Burns' trial in Scott County.

While Spies tried to have the Iowa Supreme Court look at the ruling to allow DNA evidence, Judge Hoover is limiting how it can be discussed. She rules the prosecution and witnesses cannot say the DNA at the crime scene was a "match" to Burns, unless a DNA expert is explaining the meaning on the stand.

The prosecution cannot, however, instruct witnesses to discuss Burns' unwillingness or refusal to voluntarily provide his DNA or inability to explain its presence at the crime scene.

In a big win for the prosecution, Judge Hoover-Grinde is allowing witnesses to discuss Michelle Martinko's personality. First assistant Linn County Prosecutor Nick Maybanks told the court Friday it would be crucial to providing some motive for the crime, as he says no one in Martinko's life would "have any reason whatsoever" to kill her.

2/10/20 Monday Day 1: Jury selection began with a pool of 100 potential jurors. The first day of Burns murder trial without a seated jury. A packed pool of potential jurors left the courthouse with instructions to be here bright & early Tuesday, 2/11 to hopefully finalize jury selection. Judge will seat 12 and decide on how many alternates.
2/11/20 Tuesday Day 2: Defendant’s response to Motion for Preliminary determination of admissibility filed. Jury has been selected. 9 women & 6 men. Opening statements will begin 9 a.m. Wednesday. The trial is expected to last about two weeks. Trial continues 2/12.
