When was the affidavit released to the public?
There was no delay in releasing CBR's AA on 8/21/18 -- all the local news had it. However, other sealed search warrants were not released until late December 2018.

Newly unsealed search warrants reviewed by The Associated Press reveal that four men were the subject of police interest at times during the five-week search for the missing 20-year-old University of Iowa student. The documents provide new details about how Tibbetts' July 18 disappearance in the town of Brooklyn, Iowa, stumped agents as the mystery became the focus of national media coverage and one of the largest investigations in state history.

Somebody asked in the last thread about the jury possibly hearing what is said in sidebar. The jury I served on, we were only about ten feet from the bench. Whenever the attorneys approached the bench to talk privately to the judge we suddenly were treated to white noise from speakers in our area. It wouldn’t be possible for us to hear anything.

"Felony murder can also be committed in different ways. Although there are technical exceptions, felony murder generally occurs when an individual kills another person while participating in a forcible felony. Forcible felonies are defined under Iowa law and include felonious child endangerment, felonious assault, sexual abuse, kidnapping and certain types of arson and burglary."
Mollie's body was found in Poweshiek County.

Monday, May 24th:
*Trial begins (Day 4) (@ 8:30am CT) – IA – Mollie Cecilia Tibbetts (20) (July 18, 2018, Brooklyn; found Aug. 21, 2018) – *Cristhian Bahena Rivera aka John Budd (24/now 26) arrested (8/21/18), charged (8/22/18) & arraigned (9/19/18) with 1st degree murder. Plead not guilty. $5M cash only bond.
ICE logged an immigration detainer on Rivera. Confessed to killing Mollie.
Trial began on 5/17/21 with jury selection & ended 5/18/21. Trial started on 5/19/21 (thru 5/28/21). Trial moved from Poweshiek County to Scott County in Davenport. 12 jurors & 3 alternates (8 women & 7 men); Jurors: Hispanic/Latino/Spanish-3, White-12, jurors ages range from 19 to 71.

Romero continued. Video of interrogation of Romero with CBR played at 3X speed to show CBR fell asleep per defense. And then video continued at regular speed.

Romero continued. Played more video at 3X speed. Discussion going on with judge... prosecution said that defense opened the door about the interrogation/interview & prosecution wants to put her back on the stand questioning her more about things they weren’t allowed prior.

Judge Yates on ruling. Judge Yates says the prosecution may be able to rebut the defense's argument that CBR falsely confessed later on. He will not allow the evidence for now but says that ruling may change. And re-direct by Brown.

Next witness: Amy Johnson, a DCI Criminalist. Is part of a team that processes the scene with photos, measuring, evidence collection, etc. Was tasked with examining Rivera's black Malibu. And Johnson was requested the next day (Aug. 21) to process scene where Mollie was found. Direct by Brown.

Judge telling jury he banned a news photographer & her news organization from the courthouse for the rest of the trial. She was caught taking pictures of the jury. Judge says he has the memory card, the pics were deleted, and they will not be released.

Recess until Monday, 5/24/21 at 8:30am. Judge is now reminding jury their oath remains over the weekend.
 
On the arrest affidavit, with the charge of 1st degree murder, the incident lower time range was 19:45 and the upper time range was 20:28. The upper range is very specific. Agent Reissen stated they believe she was abducted between 8:20 and 8:30pm. That correlates with the upper range time of 20:28.

Do we think that time is specific because of cell or Fitbit data? If so, will that data be heard in the trial?

Yes- pretty sure stated Fitbit data. Heart rate increased then, iirc. We don’t know when data stopped reporting. We do know phone suddenly started going 50-60 mph around that time. From day 1 or 2 of testimony.

She must have still had phone & Fitbit- or CB had them- when the Malibu started heading to cornfield, to show that mph movement. Curious if those items were tossed on the way or after. If after, there should have been pings at the crime scene- not pig farm. Perhaps he tossed both in water there & never found. Conjecture…
 
I don't believe the prosecution is using and/or relying on the Fitbit data exclusively but a combination of all three sources. I also think there are too many variables affecting Fitbit's accuracy:

Yes. I think her heart rate increased starting around 8:20, and maybe was the highest at around 8:28 pm. Either that or 8:28 was when her phone was travelling down the road at a high speed. Then at some point all activity must have stopped. Imo

I kind of wondered if 8:28 was time of death since it was a murder affidavit, but I'm not sure how those affidavits are filed out. I hope we get some answers today.
