He crossed state lines to commit the crime. The burglary is already a felony charge, per MSM. If he had NOT committed a federal crime, Moscow LE would be transporting him back to Moscow. He will come via US Marshall escort.

Crimes Crossing Borders​

Even if the crime you commit is not a federal law violation, per se, you still may face federal charges depending on where the crime occurred. Any crime that occurs when crossing state lines can warrant federal charges. For example, traveling with drugs from Texas to New Mexico, or kidnapping a child and driving out of the state.

Additionally, even if the defendant doesn’t physically cross state borders, any crime that does can still be a federal offense. You may be wondering, how is that possible? One example of this would be a wire fraud crime that targets people around the country through the use of the internet. While the offender did not leave their home state, the crime was technically committed in other states around the country.
But he didn't cross state lines during the crime. Doesn't that make a difference? I'll just wait to see. :)
 
Yes murder is a felony, but that does not mean it will be prosecuted in federal court. Most murders are prosecuted by the state. Being a felony has nothing to do with what court it is prosecuted.

Felony cases are tried in Federal District Courts.

The felony burglary will be tried in a federal district court. a general charge per MSM, unless the charge is downgraded.

First degree murder is usually a state crime, mitigating factors upgrade to felony.

MOO..the murder will be federal, as well.
 
Manufactured homes can look like regular homes. I have no idea of course and it doesn't matter, but people were talking about them living above their means—this could be one way for people to be able to purchase homes even after hardship like bankruptcy.

Here are some Bi-level (what the house is listed as on the property tax page) homes that are also modular/manufactured.
Here the home is listed as a manufactured home again. (Other websites don't say that though!)
I believe the correct terms these days are modular home and manufactured home. Modular homes are largely built offsite, then the pieces put together on a permanent foundation at the final location. Manufactured homes, which are commonly known as trailers, are not on a permanent foundation. Both have been around for decades.

 
I am not okay with 23andMe and Ancestry. I guess things have changed now, but I absolutely remember reading about a case where LE submitted a sample from a crime scene, not as LE but presenting themselves as a private citizen looking for genealogical relatives etc. They found matches and knew they had the right suspect, then built their case using legal means and legally obtained DNA from the suspect. I assume now that would not be permitted.

Are all of the samples that were obtained before the opt-in off limits to LE?
I don't know the answer to your question, but will offer that people who know about GedMatch have submitted their DNA numbers there, and one may choose there to share with LE. That may be where LE obtained the match. We won't know for sure until the trial.
 
Don't they have a female unit there? When I was a student nurse, every jail I went to train in had a completely separate area for women inmates and different times they could see the nurse and social workers.
According to the Daily Mail she was in there 6-8 hours, she probably didn’t make it past a holding cell. They don’t go to the trouble to check you in to the actual jail if they know you’re not staying.
 
For those interested in the process once BCK is delivered to Latah County, Idaho, former Attorney General David Leroy gives a brief explanation.

“David Leroy, former Idaho attorney general, said Kohberger will appear before a judge in Latah County 24 to 48 hours after he's back in Idaho.
"[This gives] the court the opportunity to present to him the arrest warrant, which explains the probable cause upon which he was arrested," Leroy said.

He said the probable cause affidavit shows a crime was committed, and more likely than not, "this individual committed the crime." A possible motive and what led police to Kohberger will remain unknown to the public until a judge unseals the affidavit.

A judge could unseal the affidavit immediately after Kohberger's initial court appearance. If that doesn't happen, Leroy said the public should know the basic facts of the case within the next week to 10 days.”

Thank you for this. I just want to add that while some PCA's contain a good amount of information, most will not. They usually contain just enough info to justify charges to a Judge. A good Prosecutor does not like to reveal his hand to the defense too early.

I just want to remind everyone of this in case the PCA is released with little detail. It doesn't mean the Prosecutor has a weak case. The Prosecutor has much much more evidence we won't hear about for awhile. Maybe not until pre trial hearings. IMO.

He did cross state line, from his home in WA into ID and back.

I live on a state line. Many crimes are commited crossing the line. Smaller crimes are prosecuted locally, but anything with murder, large $$ theft, etc, our county lets the feds have. Less cost to the county, they go to a federal prison and we don't bear the cost, at the county or state level. Our Commonweath Attorney is always involved, as is local LE.

Not all crimes qualify/meet federal requirements.

These are all state offenses. The charges, burglary and 4x murder, have been filed by Moscow PD in Idaho. The Latah County district court in Idaho has venue. Felony charges are heard by every state level court in all 50 states, it is not Fed exclusive like you think. The extradition process is being handled between Idaho and Penn. There is nothing Federal about this other than the Feds assisting in a complex investigation which is common.

That is quite the timeline isn't it !!! Good job WS: Schooling. Love when facts are spelled out. Makes the sleuth all the wiser!

Here are some thoughts newby WS: Sandy007, chances are the killer wore a mask / face protection (multiple reasons) Possibly was not prepared to find 2 (Kailee & Madisen) victims in the upstairs bedroom!! If that caused noise or a stir, could be why there may have been such fighting / defensive wounds. Mr. Goncalves said his daughter was a fighter. Strong young woman. Brave. Being stalked. Was the killer planning on killing one and ending up with 4 murders, by situational chance? IMO. Things to think about.

It is important to always be kind to the victim's families. They are suffering thru unimaginable grief, sorrow and many lives changed forever. The most important thing about crime: how were people acting PRIOR to the killings, not after.
I have a feeling his intent was to kill five. The five beautiful women there. But he decided to cut his spree short.
 
wow, they jumped right to it.

Once they found his extended family, I am sure they jumped on it when they saw there was a 28 yr old male criminologist living in Pullman at the time.

Then they saw he had a white Elantra and they got the warrant.
Based on that, I would expect the DNA came from the zone closest to the victims. Otherwise, given the number of people in and our of that house, they could be tracing down DNA samples from hundreds of people. MOO
 
Good questions.... My opinion, he was only targeting one of them. He only lived about 15 minutes away, and it sounds like Moscow was a popular place for students to hang out. The house is very well-known in the area. I think he may have seen one of the girls and perhaps became obsessed with her or perhaps encountered her at a restaurant or bar, or maybe saw her social media. I believe he acted alone. He's a narcissist, he kept the car and didn't ditch it, so I think he maybe also kept the knife. JMO
I'm not getting the narcissist label though I notice lots of people are using it.
Was he really?
I have a personal aversion to the adjective or noun.
Had he delusions of grandeur?
We simply know nothing about his psyche yet.
We don't know how he carried out the murders, only that he used a large fixed blade knife.
We don't know why.
What was the gain for him?
Where had he planned on going next had he not been caught?
he almost immediately just resumed his life as it was if reports can be believed, very few of them can so I don't know..?
That makes him sound more heedless than narcissistic, does it not?
 
Kohberger also faces a felony burglary charge for entering their King Road home just off the Moscow campus on Nov. 13 with the intent to commit murder, Thompson said at a news conference last Friday.


LaBar told NBC News that he anticipates Kohberger to be taken to Idaho either Tuesday night or Wednesday after that waiver is submitted.

The Moscow Police Department gave a less definite answer as to when Kohberger would be in the state. Law enforcement agencies are legally allowed up to 10 days to complete an extradition.
 
I think they just made an assumption based on the crime scene that it was a personal vendetta and not a random attack.

Their statements have made it clear that they were no on to Kohberger until about four days before his arrest.
If they didn't know it was him immediately, then LE's statements were misleading IMO.
 
You know, it is slightly unusual. Gedmatch doesn't accept samples. And 23@me or any other private company have regulated procedures of collection, so a sample from the crime scene won't work for them. I remember with GSK case, the biggest problem was to present the samples they had in the format acceptable for Gedmatch. It took several months, because LE were doing it for the first time. So i can imagine FBI lab being able to process DNA, get the code, run it through CODIS, transfer into Gedmatch format and upload into Gedmatch to compare with opted-in samples. These are all computer programs based on initial labwork. What I can't understand is how an average LEO would do it all. And - it won't fly in court. In court, if they found a second cousin via Gedmatch, it has to be among opted-in matches, etc.
And IIRC, many of these cases submitted have to be old and cold, with all investigative avenues exhausted, before they are accepted for matching. That's why we hear of matches being made on 20, 30, 40 year old cases. So I am very curious about how matching was done in this case.

Also, I don't think LE has officially stated that there was matching done or how it came about. MSM reporting has been awful in this case, so I am skeptical for now. Imo.

Another reason I think he acted alone, he knows that once you involve another person you have a better chance of getting caught cause now somebody else knows you did it. He is not that dumb. He did it alone IMO

True, but they always mislead the public into thinking there's no danger, IMO. I've seen the same thing more times than I can count. You always find out later that they actually had no idea whether or not there was any danger to the public.
