The reality is we don't know if they would retry it if we don't know what the issues are. If they have good evidence and present a strong case and the jury is hung, they will interview the jurors see what the problem was and re-try. if their case is not strong and the vote isn't even close, they will have to seriously consider that they do not have the goods and not retry.
What I mean is it is, imo, impossible to answer this question until we see their CIC.

If, by some freak chance, she is not found guilty of murder, she has all the check charges (as other posters have already pointed out) which will ceratinly mean jail time. IMO, though, JUSTICE will be SERVED for Caylee in the form of a murder conviction.
I'm not going to vote right now...think it's too soon, particularly because there are so many questions I have about how this trial is going to go.
I know we have some legal-eagles on here so I'm going to ask those questions here:
Wouldn't it be better to split the charges out and have more than one trial due to the risk of a mistrial on the murder charge? For instance, I think the prosecution has an open/shut case on the financial crimes and I think they have a shoe-in on the lying to LE charges. I really think they should have three separate trials: financial crimes, false statements to LE, murder and child abuse charges.
Do the legal people here think this might happen? I'm crossing my fingers it will because I think the greatest risk of mistrial comes with the trial in which the murder charge will be considered.
I'm counting on the finance trial being a moot point. Life w/o parole for murder. When this happens will they just settle the money charges? LW/OP plus 16 years, why spend the money?
As I remember it
The original charges on which she was held (when Padilla bailed her out & all that revolving door saga) were child neglect charges. After she was indicted, those charges were dismissed, as they presumed a "living Caylee" and she was now picked up & held again on the murder charges.
The lying, agg. abuse, and murder, are all arising out of a series of related incidents and are included in the indictments.
The financial stuff is in a "holding pattern" for use at a later date, depending on how the circumstances of her legal status might change.
