Marion Police searching for missing woman

Marion, Illinois -
Marion Police are asking for help finding a missing woman.

Carla Burns, 49, was reported missing Thursday by her friends and family.

She was last seen around 7:45 a.m. Tuesday in Marion.

From what I understand, her body has been found. There will be a presser today at 10 CDT.

Brian Burns, 56, did not enter into a plea during the appearance, and told the judge that he plans to hire his own attorney, according to the Saline County Circuit Clerk’s office.

Burns is scheduled to appear back in court at 1 p.m. April 7 for a preliminary hearing. His bond was set at $10 million, the clerk’s office reported.

Judge Walden E. Morris denied the motion, citing a flight risk and the violent nature of the alleged crime among other considerations...

A state police investigator testified Thursday as part of the bond reduction motion hearing that Burns told her that had he killed Carla Burns, that he had the financial means to leave the country and not be found. He also told her, the investigator testified, that he knew where he could go to not face extradition.

New charges were filed and signed by Saline County State’s Attorney Michael Henshaw Wednesday afternoon. A warrant was made for Burns' arrest on charges of solicitation, attempted aggravated kidnapping and conspiracy of aggravated kidnapping. Henshaw says the investigation has been going on for months, but he says Burns tried to pay an undercover detective $1,000 from jail to kidnap the state's attorney. That threat from behind bars is something Henshaw says he’s never dealt with before.

A week after being convicted on kidnapping charges, Brian Burns appeared again before Judge Walden Morris on Friday. Burns’ latest court date was a pretrial hearing where his attorney, Jason Drew, and Saline County State’s Attorney Jayson Clark agreed on a Jan. 17, 2018, jury setting.

In July, Burns said he was in the process of trying to hire Duane Verity of Marion to oversee his case, however, in court Tuesday he said he was not able to secure counsel because of insufficient funds — he said his assets have been frozen. When asked by Morris if he wished to be represented by an attorney during sentencing, Burns said he did. Morris then asked Burns to fill out an asset affidavit form to determine his eligibility for a public defender.

Morris set a status hearing for 1 p.m. Sept. 5 for both Burns’ sentencing hearing as well as his murder trial — Burns was charged in 2016 with murder in the death of his wife, Carla Burns. During the hearing, Morris said he hoped to sort out who would be representing Brian Burns in both matters.

Sorting through the legal system, Brian Burns still awaits a sentence for the May conviction of attempted kidnapping. However, he is now represented by a state-appointed defense attorney.

Burns is scheduled for status hearings at 1 p.m. Sept. 12 regarding his murder case, and 1 p.m. Oct. 3 for his sentencing hearing.

In his first public appearance representing Brian Burns, Duane Verity said he anticipates having no problems being ready for trial this January, in which Burns stands accused of murdering his wife, Carla Burns.

Verity said beyond some procedural motions that could need a hearing, he sees no reason to need to appear in court before the Jan. 5 final pretrial hearing in the case.

Saline County State’s Attorney Jayson Olson also said he was ready for the Jan. 17 trial date.

The sentencing for a doctor found guilty on attempted kidnapping charges and who stands accused of murdering his wife has been moved to Jan. 23.

Dr. Brian Burns of Harrisburg originally was to be sentenced today, and a trial date on the murder charges was to be set following sentencing.

Now, the sentencing will be 10 a.m. on Jan. 23. Once sentenced, the murder case will be assigned a trial date.

More than eight months after he was convicted of trying to kidnap a former prosecutor while jailed in his estranged wife’s murder, Brian Burns, a former Saline County physician, was sentenced Tuesday to 20 years in prison.

Burns will return to court to stand trial for allegedly murdering his estranged wife, Carla Burns. That initial charge is what put Burns in prison and led to his attempted kidnapping of Henshaw.
