Andersen's case in Dewey death moves forward

The prosecution wants statements made by Andersen to his wife, as well as texts she later made to family members, to be permissible because of the fact they were lies and don’t promote marital harmony or the basis of the immunity.

Andersen’s lawyers, Drew Parker and his son, Robert Parker, of Peoria, said it’s a privileged communication and should be barred since it was between husband and wife.

The next court date is scheduled at 1 p.m. on March 15, and the trial is expected to begin on May 8. Andersen remains jailed on a $150,000 cash bond.

Elward questioned Diane Andersen about statements she made to other family members via text after Cliff Andersen claimed he had been out looking for her missing sister on horseback.

One such message sent to another sister, Linda Leslie, read, “What is it with these husbands? Did I tell you Skip (Cliff’s nickname) went out looking for Deb on horseback? He hasn’t been on a horse in 40-plus years plus the heat and humidity. He looked like hell when he came home.”

When called to the stand by Elward, Diane Andersen said she had no memory of sending the text. In addition, she said Cliff was hot and sweaty when he returned to their home that day (the temps that day were in the 90s), but denied he had any odor. When presented with a copy of the text, Diane said it was possible, but still she had no memory of it.

“I don’t recall saying any of those things,” she said.
 
Murder trial for Clifford Andersen set back to July

Judge Stephen Kouri ruled Thursday in favor of the state’s motion to continue the trial in part, he said, because the court hadn’t blocked off two consecutive weeks for the scheduled May trial and he anticipated needing that much time for trial.

Kouri set aside an entire day May 7 and a half day May 8 for final pre-trial motions. The trial is scheduled to begin July 9. As a safeguard, Kouri introduced the idea of having an alternate jury available in Peoria so the trial could commence even if a Putnam County jury could not be seated.
 
Cliff Andersen to stand trial for murder July 9
At a status hearing Thursday afternoon, prosecuting attorney Bill Elward of the Illinois Attorney General’s Office notified Judge Stephen Kouri of the State’s intention to try to introduce jailhouse phone calls made between Andersen and various individuals between the dates of September 2016 and March 2018.

The defense doesn’t support that request because one of several CD’s containing recordings of those calls has been misplaced and defense attorneys haven’t had the opportunity to properly review it.

"HENNEPIN – A fight over autopsy photos is shaping up on the eve of the upcoming trial of a Putnam County man accused of beating a sister-in-law to death and burying her in a shallow grave nearly two years ago....

The most contentious issue appears likely to stem from prosecutors’ efforts to introduce more than 60 photos and 14 x-rays from the autopsy performed by Dr. Scott Denton, a forensic pathologist in the McLean County Coroner’s Regional Autopsy Facility in Bloomington. The visual evidence will help prove the cause of death as blunt trauma to the head and “the nature and extent of the injuries” sustained by Dewey, prosecutors contend...."

"HENNEPIN — Putnam County murder defendant Clifford Andersen Jr. has demonstrated his guilt in incriminating telephone conversations recorded while in jail for nearly two years awaiting the trial scheduled to start Monday, prosecutors allege in recent court filings.

Calls that the Standard man has made on jailhouse systems show him admitting key facts and struggling to explain evidence against him in the case in which he stands accused of beating a sister-in-law to death in August 2016 and burying her in a shallow grave, prosecutors claim in documents filed in support of a motion to be heard at a pretrial hearing on Thursday.

Among other things, the recordings reveal the defendant admitting that he was in victim Deborah Dewey’s car the day after her death; that he brought a carpet cleaner later found to have her blood on it to the vacant home where he allegedly killed her; and that he bought 12 40-pound bags of manure of a type in which she was later found buried, according to partial transcripts included in court documents...."

"HENNEPIN — Jurors in the Clifford Andersen Jr. murder case in Putnam County will be allowed to hear at least most of the recorded jailhouse telephone calls prosecutors want to use against him in the trial set to begin Monday.

Circuit Judge Stephen Kouri delayed ruling Thursday on three specific recordings to which defense attorneys objected until he could listen to their complete contents.

Kouri also deferred a decision on the separate and highly contentious issue of showing autopsy photos of a victim who had been dead for three weeks and buried for about five days.

But jurors are expected to hear about 10 allegedly incriminating recordings as prosecutors attempt to prove that the Standard man beat sister-in-law Deborah Dewey to death in August 2016 and buried her in a shallow grave...."

Last minute motions

During a final pretrial motion last Thursday, the prosecution, led by Bill Elward of the Illinois Attorney General’s Office, sought to introduce a series of jailhouse phone calls between the defendant and several potential witnesses. He also requested the judge allow autopsy photos and X-rays, described by the defense as extraordinarily gruesome and inflammatory, into trial.

Kouri deferred ruling until Monday afternoon and in the end, the defense mostly came out on top.

Kouri decided a call between Andersen and a Veterans Affairs social worker would not be admitted. ..."

Opening arguments set to begin today

"HENNEPIN — A jury of nine men and three women has been seated in the Cliff Andersen murder trial.

Opening arguments were scheduled to begin at 9 a.m. today for the 68-year-old Andersen who is accused of killing sister-in-law Deborah Dewey of Ladd and then burying her body in a shallow grave in a Standard yard in August 2016....

Kouri, prosecuting attorneys Bill Elward, Mary Claire Nicholson, Christina (Judd) Mennie and defense attorneys Drew and Robert Parker also discussed whether to initially inform alternates of their position. Kouri cited a case where an alternate was called in and wasn’t prepared to deliberate. In the end, the alternates were informed of their status during the jury announcement."
