Two hours after the hearing, Court TV obtained a memorandum submitted to the court on James Baldwin’s behalf. Baldwin was one of the attorneys representing Allen prior to the hearing. The memo, written in response to the leaked photos, says “Attorney Baldwin did nothing wrong. He was snookered and abused.”

“The issue before the court is a horrible tragedy created by persons not related to the defense of Mr. Allen. There were three disseminators, one of which committed suicide after the law enforcement investigation began.”

According to the memo, Baldwin was “betrayed” by a friend whom he trusted to respect his office space and accessed the photos. “Since that transgression, Mr. Baldwin has kept all Delphi-related items locked in a room or a locked fireproof file cabinet. Furthermore, defense counsel has put together a plan for curative action in which no items will be left unattended for even a second in any unlocked room.”

The memo specifically argued against Baldwin being removed as Allen’s counsel as a sanction for the leaked photos.

Do I think BK should be treated like RA- No, not unless he is convicted.

RA should be treated like BK pre-conviction. And now, no attorneys. RA's attorneys should have been severely sanctioned for the photo leak, but not forced to withdraw in my view, based on what we know, because of the impact it has on RA's defense and what that means when it comes to achieving justice for Abby and Libby.

ALLEN COUNTY, Ind. — Two attorneys have been appointed to defend Richard Allen on two counts of murder in the killings of Abby Williams and Libby German outside of Delphi in 2017.

On Friday, the Carroll County court system appointed Attorney Robert Scremin and Attorney William S. Lebrato as contract public defenders in Allen’s case.

Both Scremin and Lebrato are defense attorneys based in the Fort Wayne/Allen County area, the same county the trial jury will be selected from and where a previous hearing in the case was held.

While Gull has still not made a decision on all future court proceedings, the court on Friday did deny all requests from media to film at the next scheduled hearing on Oct. 31. This, the court said, was due to “unauthorized filming and broadcasting of pre-hearing activities” last week.

Some main takeaways from the decorum guidelines include:

Two new attorneys were assigned to represent suspect Richard Allen in the Delphi case this week.

Attorneys Robert Scremin and William Lebrato will represent Allen, who is charged with two counts of murder in the deaths of Delphi teens Libby German and Abby Williams.

It appears the case will move forward with defense attorneys Scremin and Lebrato.

Scremin is a former deputy prosecutor with the Indianapolis Drugs, Guns & Gangs Unit and a former deputy prosecutor with the Allen County Domestic Violence Unit.

Lebrato is the chief public defender of Allen County.

The next hearing is set for 9 a.m. Tuesday in Carroll Circuit Court.

Previous tweets highlighted the concerning the recent selection of counsel to represent #RichardAllen in the #Delphi case.

For months, I have harped on the disparaging treatment of RA due to his confinement in a Maximum Security Prison pre- conviction but now to see #JudgeGull has been overturned before due to her "Abusing her discretion" when it came to the treatment of a defendant in the past, is concerning.

We all just want a fair trial so #Abby and #Libby's families can have justice.

The track of this case hasn't been headed in the right direction from the beginning in terms of fair and impartial investigation and it doesn't look like anything is improving as the case snail crawls through the judicial process and now, No Cameras...

CARROLL COUNTY, Ind. – An evidence leak, legal filings and the removal of the original court-appointed defense team spelled another delay in the Delphi murder case.

Attorneys for Richard Allen filed a motion for a continuance to delay the proceedings. The trial had been scheduled for January 2024.

Allen’s new attorneys indicated it would be “impossible” to meet the January trial date, given the amount of discovery material they have to review.

The state had no objection to the motion, according to the filing. Special Judge Fran Gull, who’d earlier expressed skepticism at meeting the January date, pushed Allen’s trial back a year, setting a new date of October 2024. The trial is set to take place between Oct. 15 and Nov. 1, 2024.

A new defense team will get discovery materials and evidence to start preparing Allen’s defense later this week. The January 2024 trial date for Richard Allen has now been pushed back to Oct 15-31, 2024.
