CARROLL COUNTY, Ind. – Special Judge Fran Gull will not disqualify herself from the case surrounding Delphi murders suspect Richard Allen.

Allen, charged with four counts of murder in the February 2017 deaths of Abby Williams and Libby German near the Monon High Bridge in Delphi, is set to go on trial in October.

Indiana State Police announced Allen’s arrest in October 2022, more than five years after the teens were killed. Since his arrest, the case has been bogged down in legal maneuvering.

#Delphi trial now extended. Online record reflects 10/14/24-11/15/24 for the trial, after defense said they weren't allotted enough time to put on their defense. No docs support this change, but clerk says the new dates are correct. Previously trial was set for 3 weeks (more)

including jury selection. Trial is now scheduled to last 5 weeks. Judge is also considering a motion from defense to stay all hearings until she rules on their motion for her to step down. Defense alleges she is biased against them and their client.

Another big issue is the State's Motion in Limine which asks the judge to ban words like Odinism, Ritual Killing, Names of Alleged Odinists, Kegan Kline, and Ron Logan from being spoken at trial.
 
Delphi murders suspect Richard Allen is trying one more time to divorce the case from Special Judge Frances Gull, whom he and his defense team have repeatedly accused of being bias against them.

In a filing Thursday, Andrew Baldwin, one of Allen's attorneys, argued that Gull has violated Indiana trial rules by failing to make a decision on two of the defense's motions within the 30-day time frame the rules required. Baldwin is asking the Indiana Supreme Court's chief administrative officer, Justin Forkner, to review the case and determine whether rulings have, indeed, been delayed.





Several other pending motions on critical issues, including what evidence can and cannot be presented to the jury, are set for hearings from July 30 to Aug. 1 in Carroll County.

Allen's trial is set to begin in October and is expected to last more than a month.

According to Dr. W. she did get a phone for RA to call his wife and dialed the number and left the room. RA spoke for a minute and when Dr. W came back in he asked her to call his wife back and to stay and listen to the conversation, which she did.

His family did not want RA to confess, kept discouraging him from confessing, including hanging up on him when he talked about it and finding God, and wanted him to fight the charges. They kept saying he had been brain washed, etc.

Motions to Suppress

Wednesday's hearing in Carroll County centered on a motion to suppress from Richard Allen's defense team.


The defense is looking to suppress multiple statements of guilt made by Allen in the Westville correctional facility.

Testimony was head from former Westville warden John Galipeau and an internal investigator at the facility.

The hearing brought forth the notion that Allen had admitted guilt to the crime of murder as many as 61 times during his months at Westville Correctional Facility.

In a day expected to be filled with testimony from six people, the court spent hours hearing from Ritualistic Killings expect Dawn Perlmutter.

The hearing just wrapped up in Delphi today and there were a number of things that happened, many testimony that was heard. But here is the latest—


Judge Gull has granted the defense’s motion to vacate the safekeeping order in full. Accused murder suspect Richard Allen is now in custody of the Carroll County Sheriff. It is their authority to keep him safe. Sheriff Liggett says he will not reveal where he will house Allen.


In court today we also heard from a blood spatter expert, who described in detail how the blood was at the crime scene. These details made family of both Abbie Williams and Libby German visually upset.


The blood spatter expert described how Libby’s neck was cut in a way that her carotid and jugular were compromised.These details, as you can imagine, were hard for the family to hear. Clearly shaken and upset by the details.


We heard from nine total witnesses in the nearly 12 hours of testimony today.

On Thursday, Gull granted a request from Allen’s attorneys to vacate a safekeeping order. That means Allen will be moving out of the Indiana Department of Correction (IDOC) and into the custody of the county sheriff.

It’s unclear at this time where exactly Allen will be housed or when he will be moved to a new jail.

Richard Allen just arrived at the courthouse for Day 3 of his hearing. He has been staying at Cass Co jail, and a sheriff’s department van brought him. Allen in orange.



His wife and mother have been there each day. I believe I've seen them at each court date held since his arrest. For the couple days I was not present, I seem to recall they were there.

*IF* Allen moves to Cass Co, he'd be ~200 miles closer to family. Cass Co jail (Logansport) is just minutes from the offices of one of his attorneys. Would be much easier for them to communicate and prep for trial. Carroll Co Sheriff did not say where Allen would go or when. ###

A Kegan Kline connection: Kegan Kline, a Peru man who was behind the fake “anthony_shots” profile that had been in contact with Libby German, came up in Thursday’s hearing. McLeland is trying to keep his name out of the trial, too.

Kline was sentenced in 2023 to 43 years after pleading guilty to 25 counts, including child exploitation, child solicitation, possession of child *advertiser censored*, synthetic identity deception and obstruction of justice.

ISP Detective David Vido testified that Kline had told investigators that he and his father, Tony, had been at a cemetery near the crime scene in Delphi on the day of the murders. Kline told investigators that his father had gone into the woods for an hour and came back with blood on his clothes. On the way home, Kline told investigators, they had stopped so his father could toss a cellphone and a knife into the Wabash River.

Vido said ISP spent time in August 2022 systematically searching the river. Vido said police found other cellphones, knives and firearms, but not what Kline told them would be there.

Vido said the investigation later found that Kline lied and hadn’t been at the cemetery near Delphi the way he said.

Gull took the motion under advisement, as she’d done with others this week.

Here’s an afternoon wrap from Delphi, in the first of three days of pretrial hearings on murder charges against Richard Allen, charged in 2017 murders of Delphi teens Libby German and Abby Williams 1/


Allens attorneys argued to dismiss the case, building off what they called intentional efforts ignore a trail that led to involvement, they say, by a local man who was involved in ritualistic killings in name of Odin. 2/


Atty Andrew Baldwin called it ‘an extreme remedy, but that Allen was saddled with charges that should have aimed to someone else who police didn’t adequately investigate before clearing. Prosecutor: no evidence to back those claims, warrant dismissal. 2/



Judge Fran Gull took matter under advisement. Hearings continue in murder case Wednesday. Richard Allen, dressed in prison orange, didn’t speak during today’s hearings. He mouthed, ‘I love you,’ to his wife and mother in the gallery on the way out. 3/

The day is devoted to a motion to suppress statements and confessions Richard Allen made to inmates, prison staff and his family while in custody, since being charged in Oct 2022 in the 2017 murders of Abby Williams and Libby German. 2/


Defense case revolves around Allen’s conditions at Westville Correctional Facility, a prison where he was sent for safekeeping shortly after his arrest. Attys are lining up an argument that the move kept Allen from due process, right to counsel, 5th amendment rights. 2/


During two hours on the stand, former warden at Westville testified that Allen confessed to him, saying he’d murdered the girls, calling them by name. Prosecution suggests that the situation involves 61 incriminating statements over two months offered by Allen. 3/
