DELPHI, Ind. ― Special Judge Frances Gull has denied Delphi murder suspect Richard Allen's request for an interlocutory appeal at the Indiana Appeals Court.

"Trial remains set October 14, 2024 - November 15, 2024, with jury selection being conducted in Allen County, Indiana, and trial being conducted in Carroll County, Indiana," according to Gull's order published online on Wednesday.

There’s no indication yet when Judge Gull might rule on the motion.

Jury selection is set to begin October 14. The trial is expected to last approximately five weeks.

It's now been 2 months since #WTHR first asked Judge Frances Gull to release publicly-filed exhibits introduced during pre-trial hearings in the #Delphi murders case. The judge said she won't release the exhibits for months. Last night we filed a legal motion to change that. 1/

Court exhibits can be introduced in 2 ways: with a request to seal the exhibits to protect sensitive info or not under seal, which means they become public records available to the public & media. The state and defense introduced DOZENS of exhibits--nearly all NOT under seal. 2/

On Aug 2 (one day after the hearings in Delphi), WTHR requested access to all of the publicly-filed exhibits under Indiana's Access to Public Records Act. A few weeks later, the court told me Gull would release the info only AFTER the trial. We believe this violates APRA. 3/

So we tried another route: refiling the request in late August under Indiana's Access to Court Records rules, which also say publicly-filed exhibits & other court docs should be open to public inspection. We reiterated we want to inspect only the exhibits NOT filed under seal. 4/

WTHR also offered to travel to Allen County to inspect the records in the judge's courtroom. We received a formal reply from Judge Gull, again stating she would not make the records available until after the trial, delaying release even further if Richard Allen is convicted. 5/

Judge Gull is responsible for ensuring a fair trial for Richard Allen & the victim's families. We do not believe violating the right of the public and press to access public records is necessary to ensure a fair trial. That is why we chose to file this motion. 6/

We are grateful for the partnership of other media & media organizations (local, state and national) to join WTHR in a group effort to ensure the public gets to track the #Delphi proceedings & not have to wait months to access info that should be public now under state law. 7/

Here is the full motion filed by WTHR and the coalition of other media organizations. We are hopeful the judge will permit timely access to both the pre-trial and trial exhibits as required under APRA and ACR rules. 8/
 
BREAKING: 13 Investigates has learned Carroll County is requesting an additional $2.2 million from county taxpayers to pay for the #Delphi murders trial. That doubles the county’s original $2.1 million estimate for trial costs requested last year. 1/


I spoke with Carroll Courty’s EMA director this afternoon who said the new $4.3 million total request is based on increased costs due to three main factors:
1. Two weeks added to the trial schedule which means 2 wks of extra meals, hotels, transportation for the jury. 2/


2. Added security for the trial (and providing that added security for an additional two weeks)3. Higher than expected attorney fees and expert witness costs for both the defense and prosecutor. 3/


So far the county has spent approximately $1.4 of the original $2.1 million allocated for the trial, with Opening Statements in the trial itself still two weeks away. EMA Director Mike Fincher says the new budget request has been delivered to the county council. 4/


The request comes from a 3-member Delphi Trial Committee made up of the EMA Director, county auditor and a board member. The council will consider the request at its Oct 17 budget meeting. 5/


The new $4.3M estimate would make the #Delphi murders trial one of the most $$$ in state history. In a county of roughly 20K residents, it represents $200 for every man, woman & child in Carroll Co. Some of the $ could be reimbursed by the IN public defender commish. #wthr 6/
 
CARROLL COUNTY, Ind. — It’s estimated the prosecution and upcoming trial of Richard Allen, accused of killing Abby Williams and Libby German near the Monon High Bridge outside of Delphi in 2017, will cost Carroll County taxpayers more than $4 million.

Jury selection in the oft times delayed trial begins in Allen County next week before the case moves to Delphi.

INDIANAPOLIS (WISH) – An expected key defense witness in the Delphi Murders trial has been arrested on charges of forgery.

Delphi Defense filed motions to transport James Haas, Kegan Kline, James Chadwell and Ricci Davis Jr. so they can testify for the defense.



Haas told me and others he shared a cell with Ron Logan after the murders and that Logan called out one of the victim’s names while performing a sex act.

Kegan Kline told me he created the catfish account Anthony Shots, and that he believed ISP wanted him to say a relative killed the girls.

Chadwell pleaded guilty 3 years ago to child molesting and attempted murder for an attack on a neighbor child he lured into his home by asking if she wanted to see his dogs. He resembles first sketch.

 
TODAY: day one of jury selection in Allen County in the case against accused Delphi killer, Richard Allen.In total, 300 potential jurors will be questioned, with the goal of filling the 12-person jury box, plus 4 alternates.The trial is expected to begin Thurs. in Delphi.



With limited seating for both the media and the public inside the courtroom, people are camped out in front of the Allen County Courthouse here at 4 a.m.

#UPDATE: Here’s what’s new from the first day of jury selection in the #Delphi double murder trial.

- Special Judge Fran Gull first asked potential jurors if they’ve heard about the case, at least 65% of the people in the room raised their hand to say yes.

- Richard Allen was in the courtroom. His hands were not bound to his chest. He was wearing a button down shirt with faint red stripes. He took notes and nodded at potential jurors.

- As of 3:15 p.m., 11 of the 12 jurors have been picked. One more needs to be picked and an additional four alternates.

- 7 of the jurors are women, 4 are men. - At least two of the jurors have a family member in law enforcement.

- The defense plans to call 120 witnesses. Prosecution will call 50.

- Abby Williams’ grandparents were present and taking notes.
