While the City Defendants have been dismissed pursuant to a settlement agreement between the City of Elkhart, the City Defendants, and Plaintiff, the factual allegations are still relevant to Plaintiff’s remaining claims against Defendants Becker, Chapman, and Elkhart County Sheriff’s Department. As a result, former City Defendants are referred to as “Dismissed City Defendants” throughout the Complaint. The claims involving Dismissed City Defendants have been adjusted to include just claims against remaining parties to the litigation.
