Accusation of prior stabbing won't be part of Valpo man's double-murder trial, judge rules

July 15, 2020

Porter Superior Court Judge Roger Bradford denied a request by prosecutors to introduce the evidence, saying there are not enough similarities with the underlying murder case to justify the move.

The judge went on to say that evidence of marijuana dealing by Kerner will be allowed at trial and that a question of allowing jurors to know that Kerner is locked up at the jail will be dealt with at trial if needed. The latter question arose as a result of prosecutors saying they may introduce, as evidence, telephone calls Kerner made while at the jail.

Valpo man's double-murder trial postponed; defense seeking to toss evidence

August 4, 2020

The trial was to get underway Sept. 15, but it now has a starting date of Oct. 6, according to the office of Porter Superior Court Judge Roger Bradford.

The trial is slated for Tuesday through Friday for three consecutive weeks.

An Aug. 20 hearing is scheduled on a motion by the defense to toss out a voice recording prosecutors say was obtained from the phone of John Silva II, who also is charged in the Feb. 25, 2019, killings of 18-year-old Thomas Grill Jr., of Cedar Lake, and 19-year-old Molley Lanham, of St. John.

@Tippy Lynn - I see a name in the article - John Silva II - says he is also charged in the killing of Thomas & Molley. I have nothing on him - ?? Can you find him in the court site? I guess I should add his name to my notes. And I see that an extra hearing - Aug. 20 - has been put in there.
TIA! :)

On May 22, police arrested John Silva II, 19, of Hamlet, on charges of two felony counts of murder in the perpetration of a robbery in the case. Silva, being held in Porter County Jail without bond, has pleaded not guilty.

7/30/20 Update: Motion for trial continuance-granted. 8/20/20 Update: On Thursday Porter Superior Court Judge Roger Bradford ruled to deny the motion to suppress the recordings as evidence. At the last hearing, the defense asked the judge to not present the recordings to jurors when the case goes to trial Oct. 6. A former FBI agent testified the cellphone recordings are not the originals & have been altered in some unknown ways. Porter County Chief Deputy Prosecutor Armando Salinas Jr. argued to keep the evidence, saying, in part, that the records were obtained from the iPhone of Silva, who will testify to their authenticity. Next status hearing on 8/31/20.

Accomplice:
