Here is a gotcha moment for the defense!!

The pdf says that if Jason killed Michelle leaving CY behind, he would not want anyone else finding CY risking having her say she saw him..........Page 48

Brillant and this is why they got paid the big bucks. Never thought of this.

I've said this all along. Yet the only testimony that had CY saying "Daddy" was in any way tied to the crime came from MF and the daycare worker.

Jason was railroaded from the beginning.

I'd like to make a suggestion.....I would like to discuss the case, the trial(s) without being snippy and defensive. Yes, I'll admit I've done my share.

Then how do you feel about his actions as a husband and father? Ya know, all the stuff about him being a terrible husband that's been spoken about and written about. His lies, his womanizing etc. Do his actions speak louder than his verbal admissions on the witness stand. You know, when he choked up when she called him bootiful?

Considering half of all marriages end in divorce these days, just because someone is a bad spouse does not equate to being a bad parent.

The State attacked his character because that's all they could attack due to having no actual evidence he murdered his wife.

I wonder how they feel now that he's getting a new trial. Have they publicly commented?

The state was making a joke, right?

This is just outrageous. I can't believe the taxpayers pay money for this crap.

That area has collected quite a reputation: corrupt crime lab, prosecutor in the Duke LaCrosse case, unsolved murders of young women, conviction reversals and new trials needed. Taxpayers have good reason to be outraged.

I don't think so. I doubt that they would be happy to learn that there were problems with the trial, as it means that they have to re-live it all again.

I'm sure that's a huge issue. If there has been no contact, and if there is a not-guilty verdict, that might not go over too well.

I seem to recall that children under a certain age cannot visit prisoners, but there could still be letters and photos from the child to her father.
 
The prosecution certainly did not try to state that MY routinely kept her purse in the path of the kitchen floor/doorway because it simply isn't believable. There are bags right next to it that had one of CY's shoes below it and one shoe on top. Plus, CY's doll is on top of the kitchen counter right next to the doorway into the kitchen from the garage. All of it gives weight to the cop's theory that CY was taken out of the house.

I hadn't noticed the shoes before ... also tweaked the exposure to reveal the front door at the end of the hallway.

 
I'm tempted to line up the child's shoes with the prints on the bathroom floor to see how well the size matches.

Note the canvas bag with the shoes both underneath and on top is also on top of a portion of the purse, meaning the purse hit the floor before the bag and shoe did. I doubt the stuff was there when Shelly was there because it is clearly in the way.

I wonder if that was the normal place for the Halloween candy basket or if the purse etc...was sitting there before they fell off and then the basket got put there afterwards.

The basket is partially off the counter and within reach of a 2.5 year old child. The purse and the other bags and shoes are in the way. Shelly brought dinner and they all are in the way of traffic moving through the kitchen either from the front door or garage. This is not a place one would "store" their purse or basket of candy. No way.

That's a good point. People could trip over the purse straps. On the other hand, that hallway might have been used primarily for the small bathroom. I think the travel route would be kitchen, family room, dining room, front door, but if someone came in the front door, it looks like a place to drop things.

More likely it was dropped, pushed, or fell, in that spot. Did Meredith testify about it? When she mentions the purse during the 911 phone call, is that because she came in through the garage, entered the kitchen and discovered the purse in the wrong place, but kept heading to the bedroom (down the hallway next to the small bathroom), and up the stairs to the master bedroom? Was that a reference to the purse not looking right?

If the purse was moved at the time of the burglary and murder, what evidence was found on the purse? Did I read that it wasn't tested?

 
you're exactly right it is..........and it was discussed at length at trial.

Yes, but the first time that Jason's character was attacked with that information was in the affidavit for custody. That information was repeated during the trial in an attempt to convict Jason of murder. I suppose the theory is that if he did really weird things when he was drunk, had no discretion, and appeared uncommited to his marriage partner, he could be a murderer.

It was reported that Jason and Michelle had loud, public arguments. That was not something that Jason did, it was something that Jason and Michelle did.

Michelle had decided to consult a pyschologist, and Jason was consulting with Michelle's sister, Michelle's friends (Michelle Money), and his friends (former girlfriend, girl from camp) to the extent that he committed adultery with two women in the last few months of marriage. They were both having problems in the marriage. Michelle wanted her mother to move into the family home. Jason wanted to keep his family as a small family unit with the upcoming birth of his son. They were concerned about finances after the birth of the second child, so Michelle made arrangements to work 30 hours per week, with more "work from home" time.

They were having a party on November 4 and Jason wasn't sure if he would attend if Michelle's father was not attending.
 
I always believed that Scott Peterson tried to arrange for Laci to see, or speak to, family prior to her murder. He took her with him for his hair cut (after hours) at the salon where her sister worked. She phoned her mom shortly after she arrived home (where her mom was on the phone with a friend and would call back the following day), most likely shortly before she was murdered . I have long believed that Scott did this for her and her family, knowing that they would never see each other again ... kind of a twisted "last rites" in his head ... or perhaps he was making sure that they wouldn't be phoning or trying to contact Laci before the next day. Did Jason invite Michelle's father to the party so he could see her one last time before she was murdered? When Michelle's father cancelled, did Jason perceive that as the green light to go ahead with his to drive through the night to commit murder? When was the last time that Meredith saw Michelle prior to the murder? Was Meredith attending the party on Nov 4?
