I don't think Fairfax County televises trials. Can't believe he pled not guilty. Well, on second thought, won't most prisoners say they are innocent? Geez....

Doesn't surprise me a bit. If you can't avoid the unavoidable, delay it as long as possible. Especially if you can get a court-appointed public defender and it won't cost you and your family a fortune to do it.

sorry if this is repeated, but I just realized that the night ride he took to Fairfax was exactly 2 months from the night Hannah Graham was taken.

I don't know much about law and defense, etc. I'm trying to think what the defense's strategy will be. DNA doesn't lie. I would assume it's skin and blood that was under her nails and the victim is going to testify. Yet, he's pleading not guilty and they're not asking for a psych evaluation. Anyone want to weigh in or speculate?

LOL. Because most women walking home with groceries at 10pm are up for consensual sex in the woods with a stranger they just met on the sidewalk.

Yes, it does sound like a joke and to US, it is! Just keep in mind that jurors can and DO surprise us. Need I list some cases?

No, I get it. I just think if that's the best his defense can come up with, this *should* be a slam dunk for the prosecution. I mean the victim was almost strangled to death (and was already unconscious when he fled) . . . Good luck convincing a jury that was consensual sex gone wrong.

I'm having a hard time coming up with the defense now as well. I've got nothin'. Ideas?

And the victim will most likely testify against him this time. What could his defense be?
The trial date is March 2015.

Oh, I agree! I just can't imagine what defense he could possibly think he has?! I don't know how a defense of "not guilty by reason of insanity" works and wonder if such a plea can be entered at some future time? Other than that I haven't a clue how they will defend his case. I also have to ask if a defendant charged with a capital crime can actually plead guilty without a plea agreement in place? Laws are so strange so I just wondered about that?

I snipped this from a link FindHG posted above. I personally don't see how JM or his attorneys hope to convince a jury the he's not guilty. DNA and eyewitnesses.

"Analysts say he may be tried first in Fairfax County, because authorities there have had more time to build their case, and they have potential eyewitnesses in addition to the DNA evidence."

Well, a basic start with an accusation of rape, usually, is having a female lawyer who appears all touchy feely with the accused, in order to humanize him and give the appearance of credibility to the "this guy? he wouldn't rape anyone. look how well we get along. i love the guy." It's a tactic that often works but kind of a dud in this case, I would think. But if you're a female lawyer defending a rapist, it's part of your job, as anything less would be read otherwise. Imagine the same situation with Camblos of that 'Graham girl' defending him.

I have some ideas, but I won't post them because I prefer the defense come up with their own strategy. ;)

That being said, they really don't have to do anything. They can sit back and make the prosecution prove their case, which I think here shouldn't be hard. All the defense has to do is raise a bit of doubt regarding any of the qualifiers in the charges. Personally, I don't think they are going to defend the rape charge. I think they will focus on the attempted capital murder. Prosecution has to prove intent. .and that can be a slightly more slippery slope.

I don't have the defense answers but people plead not guilty to rape all the time where there is likely DNA evidence so I agree they will likely try to poke holes in the case the prosecution presents and discredit their witnesses.
Anyone read Into why it seemed he wants to go back to c-ville with urgency? Because camblos wants ultimate control?

The way she kept touching him over and over to me was way too obvious. But I suppose it may work for some jurors.

Lol...only kidding. I doubt he gets botox, but he may retain fluid or something that causes swelling of the facial features?

If hes eating a diet thats high in salty, processed and/or fried foods that could account for the bloating pre-jail.

He'll be eating healthier albeit smaller portions while incarcerated. Also if hes in solitary he'll have no opportunity to bully or trade someone else for their leftovers.

Many people that are incarcerated turn to strenuous exercise to pass the time and to get "cut" ...especially if theyre anticipating a stay in prison.

And before someone screams racist abut my comments, diet is one of the primary contributing factors related to higher incidence of heart disease and obesity amongst African Americans.

I wonder if he can buy commissary while in solitary?

Does anyone know what a "discovery motion or discovery order" is? Thanks to anyone with more legal knowledge and background.

A motion is a request asking a judge to issue a ruling or order on a legal matter. Usually, one side files a motion, along with notice of the motion to the attorney for the opposing party, the other side files a written response, and the court holds a hearing, at which the parties give brief oral arguments. Other motions are decided by the written submissions alone, without a hearing. However, during a trial or a hearing, an oral motion may be permitted. Then the court issues a ruling (order) which approves or denies the motion. Motions are often made before trials to resolve procedural and preliminary issues, and may be made after trials to enforce or modify judgments. Motions are made in court all the time for many purposes such as to continue a trial to a later date, to get a modification of an order, for temporary child support, for a judgment, for dismissal of the opposing party's case, for a rehearing, for sanctions, and many other reasons. A motion on a factual matter usually will be filed with a supporting affidavit.

It seems to me, that the prosecution is most likely not going to offer any "deals" in this case. Therefore, the only option that Jessie's lawyers have is to plead "guilty" which will most likely end up with a maximum sentence, or plead "not guilty" and worst case get the same maximum sentence that he would have gotten if he plead "guilty". In other words, there is no up side to pleading "guilty" so they may as well come up with the best defense strategy they can and give it a shot. I can't imagine what the defense strategy will be since they don't appear to be going for "guilty by reason of insanity", so it should be interesting. I too hope it will be broadcast on TV.
