It is very hard for a Defendant to get a Jury to believe Abuse claims in a murder trial when there is no corroborating evidence.

In other Trials of murder of a spouse for example, you often see photos of her battered and swollen black eyes. Sisters and friends coming forward they got 2am calls of her needing help and they take her in, or try to get her to leave him.

Or they may indicate they always thought he was abusive as they were around him at Holidays and events and he was aggressive and rude, and demeaning and she was a delicate flower, afraid to talk.

Um, again, not present in this claim.

They had the perfect opportunity too, in Arias calling her mother to come out to Mesa to help her move! Sssh! They missed that one!

Why should he move on after only cross examining her for two days? I really dont understand the rush when Nurmi had Jodi on the stand on direct for 8-9 days.:waitasec:

When I say move on, I mean move on to more important topics. Stop allowing her to steer the conversation by her incessant rambling and/ or explanations. Get to the "meat" of the matter...tell the jury what they need to know in order to do their job...the pre-meditation and the vicious murder, most of which she cannot remember. They already know she is a liar and has been sexually active since the age of 17.

I worry that the jury will stop listening after awhile.

One of the brilliant posters on here remarked that JA always uses "2" when she testifies. I started listening for this, and it is so true. Thank you to whoever brought this up. I am able to listen and understand so many things better through all the educating posts here.

What do you mean she always uses 2? Can you provide examples? Thanks

I agree with all you are saying, but I cannot criticize Mr. Martinez for his "rights?". That is not meant as a direct question to the witness, IMO, but a speaking habit that is typical of most lawyers. Listen to Nurmi - he has far worse and far more irritating prefaces to his questions. Grrr! I'm sure they are drummed into everyone's mind by now. I actually shudder to think that we have to listen to that again! Juan's simple 'right?' is nothing in comparison.

JM is questioning JA in circles so Jodi will be unable to recall her memorized timeline of events and stories that she told! I understand what he is doing because it reminds me of my experience at the time I was studying classical piano, with a very stern teacher who told me that if I couldn't play the piece starting at different sections and moving back and forth between sections that I wasn't ready and didn't really know the music. In other words, i would be 'faking it', like Jodi is doing on the stand!

It's not every day a prosecutor gets to question someone like this. He has a LOT of ground to cover before he's done and it's his duty to the state of Arizona to do it.
