Thursday, February 25th:
*Pretrial Conference Hearing (@ am ET) – KY – Edward Dansereau (63), Pamela J. Phillips (58) & Calvin Lee Phillips (53) (Nov. 19, 2015, Pembroke) - *Christian “Kit” Richard Martin (51/now 52) arrested & charged (5/11/19), indicted (5/10/19) & arraigned (5/22/19) with 3 counts of 1st degree murder, 1 count of arson, 1 count of attempted arson, 2 counts of 2nd degree burglary & 3 counts of tampering with evidence. Plead not guilty. Held without bond, changed (10/16/19) to $3M bond.
May, 2016 was convicted of 2 counts of mishandling classified materials & 2 count of assault on a child; sentenced to 6 months in jail & discharged from the military.
Trial set to begin on 5/31/21 with jury selection, trial starts 6/1/21.

12/30/20 Update: Judge John Atkins denied Martin’s motion to dismiss charges. Judge Atkins denied Martin’s motion to dismiss for a due process violation. The judge did allow renewal of the motion at a later time if the defense wants to supplement the written motion with witness testimony. Judge Atkins set the next pretrial hearing for 1/21/21 at 1pm to hear evidence concerning Martin’s medical condition. Martin is currently suffering from kidney stones. The defense is still working with the Christian County Jail concerning Martin’s health & best way to take care of him.
1/21/21 Update: A motion filed last week in Christian Circuit Court, an analysis of "pings" from cellphone towers in and around Pembroke reportedly showed that at the time of the crimes, Martin was in the vicinity of the burned vehicle — not at home as he had claimed. The cellphone analysis purportedly showed Martin took Pamela Phillips’ phone & drove with it toward Fort Campbell, where he worked. In the motion, Griffiths says a Christian County Sheriff’s deputy got it wrong when he testified before the grand jury that indicted Martin the day before his arrest. A hearing is set Feb. 25 before Christian Circuit Judge John Atkins. A trial is scheduled June 1 in Elizabethtown, where it was moved on a change of venue. Jury selection begins 5/31/21.

I received this article this morning, but unfortunately can't access it over here - even in Outline.
If someone could give a 10% synopsis - it would be appreciated. And if there is the next court date.

“After nearly a two-hour hearing, Griffiths asked Judge Atkins to dismiss the indictment against Martin based on his belief Lt. Smith provided the grand jury with false testimony regarding the FBI’s report pertaining to Martin’s and Pam Phillips’ cell phone pings on the day of the murder”

“Whaley asked the judge to dismiss the motion because Lt. Smith did not provide false testimony. She added the conclusion is that in order to find any grounds to dismiss it would have to be shown to the prosecutor and witness that both intended to offer false testimony that would have influenced the grand jury’s decision. However, she says Lt. Smith gave a volume of other additional evidence to the grand jury in addition to the cell tower records, most importantly a shell casing found at the murder scene.”
 
It says the trial is in June but doesn’t give a specific date.

Martin Defense Attorneys Still Waiting for Evidence Reports

With the triple-murder trial of Christian “Kit” Martin a month away, defense attorneys are still waiting for evidentiary reports from prosecutors and police.

Defense attorney Tom Griffiths told Chief Circuit Judge John Atkins during Thursday’s court appearance they were made aware of a box of items that has not been inventoried by the police.

Griffiths also said a laptop computer that was used by an investigator to obtain cell phone evidence was corrupted. That computer has since been sent to the FBI Crime Lab in Quantico, Virginia, and the defense has been assured a report will be made available by next week.

Atkins said he has been assured by Hardin County judicial officials that nearly 200 potential jurors will be made available for the trial. He added that he didn’t think individual questioning of jurors about their knowledge of the case would be necessary.



So... I'm guessing that jury selection begins on 5/21 & trial starts 6/1....

With only a month to go before the trial, attorneys revealed on Thursday that a new box of evidence has just been discovered.

Attorneys also added that a laptop with critical information is now corrupted and requires examination by the FBI in Quantico, Virginia.

Martin's attorney has said that he is not pleased about the evidence they have been unable to see yet but still wants the trial to begin in early June.

Polygraph Admissibility at Issue in Martin Evidence Hearing

With just over a week until the start of the Pembroke triple murder case involving Christian “Kit” Martin, a question about whether polygraph results involving two family members who found evidence at the home will be decided before the trial.

Martin’s defense attorney Tom Griffiths also questioned the family members as to why they called a state representative to the scene along with the police.

Diana Phillips is the sister of Calvin Phillips, who was found shot in his Pembroke home in November 2015. During Friday’s evidentiary hearing in Christian County Circuit Court, she testified that she and her nephew Matt were at the South Main Street home in April 2016 doing general cleaning and maintenance. Matt is Calvin’s son.

Diana Phillips testified she found what she thought was a shell casing on the back porch. She alerted Matt, who testified it was a spent 45 caliber shell casing.

Also at issue are the results of polygraph tests given to both Diana and Matt Phillips about finding the shell casing. Assistant Attorney General Barbara Whaley objected to admitting the polygraph results since they are generally inadmissible at trial. However, Griffiths indicated that either one of both failed the polygraph and that those tests should be allowed for him to present a defense for his client.

Griffiths cited Rogers vs. Commonwealth that allowed for a defendant’s right to present a defense to trump whether scientific evidence should be introduced at trial. Judge John Atkins asked both attorneys to submit a brief with a ruling to follow before trial.
