For sure, and if he's not going to go over the evidence, what the heck is he going to talk about for the next hour???

He's going to slowly put the nails in the coffin, carefully explaining the law so that there is no just cause for appeal. If we are sweating, just think of how the two guilty parties are sweating. At least we get to walk away.

"Discussing “absurdity” of consecutive life sentences. Word absurdity used in previous cited decisions. Not Code using it. Waiting to see if he agrees"

Millard and Smich began developing their plan to steal the Dodge 3500 (truck Tim #Bosma was selling) around the time of Laura #Babcock's murder & the acquisition of the Eliminator.

"BBQ is last piece of 3500 puzzle, July mission." "I like BBQ & I like 3500," texts between Millard and Smich as they acquired the incinerator and began planning murder for truck. Judge isn't sure when the conspiracy crystallized. #Babcock #Bosma

For the above reasons, Judge is satisfied that #Bosma and #Babcock murders are sufficiently distinct to warrant consecutive sentences, "easy and overwhelmingly justified determination, in my view," judge says.

Sorry folks - I think I misinterpreted this tweet! Discussion in court is ongoing!!

But will the total sentence be unduly long or harsh? Judge asks. Still a question. Crown says judge has no discretion, the sentences have to be either consecutive or concurrent, and that 50 years without parole is a fit sentence for #Millard and #Smich anyway.

Lawyers for #Millard and #Smich say judge can decide how long the parole eligibility should be, allowing for part consecutive and part concurrent sentences.
